TheCityofFairhopeBoardofAdjustmentsaiidAppealsmetonMonday,December19,2005at5:00PMintheCityAdministrationBuilding,DeichampsSuite,locatedat161N.SectionStreet.MembersPresent:ChairmanCharlieBassett;BeckyLundberg;RayClark;LewisAgee;TeddyJoeFaust;BarryFulford,BuildingOfficial;andKelleyChastain,PermitTechnician.MembersAbsent:BobMannich;CathySlagleThemeetingwascalledtoorderat5:00PMbyChairmanBassett.MemberswereaskedtoreviewtheSeptember19,2005minutesforconsiderationandmakeamotiontoapprove.AmotiontoapproveasnotedwasmadebyRayClark,andasecondbyBeckyLundberg.LouisAgeeandTeddyJoeFaustabstainedfromthevoteastheywereabsentattheSeptembermeeting.Allothermembersapproved.ZBA05-15PublicHeai-ingtoConsidertheRequestofMi-.RobertN.WalshSi-.toallow20footreal-setback.Thepropertyislocatedatlot242QuailCreekSubdivisiononQuailCreekDrivenextto11120NiblickLoop.QuailCreekSubdivisioniszonedR-2.R-2zoningrequiresa35’rearsetback.Mr.RobertN.WalshSr.camebeforetheboardandexplainedthereasonforhisrequest.Mr.WalshSr.madehiscasethattheshapeofhislotwouldnotaccommodatethedesiredgarageinadditiontothehousedesignhehaschosenwithouta20’i-earsetback.ChairmanBassettindicatedtheboardhadreceivedaletterfromQuailCreekPropertyOwnerAssociationhasprovidedaletterstatingtheyarenotopposedtograntingthezoningvariance.ChairmanBassettopenedthecasetothepublic.Mr.HarryMitchellof11076NiblickLoop,Lot244QuailCreek,cameforward.Mr.Mitchellownsthelotdirectlybehindthelotinquestion.Heexpressedhisoppositiontohavingthesetbackvariancegranted.Hefeelshisbackyardissmallenoughwithouthavingastructureclosei-thanallottedbythezoningordinance.Mr.ThadPateof316ClubhouseDrive,cameforwardalsoinopposition.HeisthepurchaserofseverallotsinQuailCreekSubdivision.Hehiresbuilderstobuildonthoselotsforthepurposeofsale.Hehashadtomakeadjustmentstohisplanstofitwithinthesubdivisionregulationsandcityzoningordinance.Hefeelstheownerofthepropertyinquestionshouldberequiredtomeetthosesamestipulations.QuailCreekPropertyOwnerAssociationhasprovidedaletterstatingtheyarenotopposedtograntingthezoningvariance.
