WebLinkAboutMinutes9TheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,September20,2004at5:00PMintheCityAdministrationBuilding,CouncilChambers,locatedat161N.SectionStreet.MembersPresent:ViceChairmanCharlieBassett;LewisAgee;RayClark;alternatesBeckyLundbergandCathySlagle;ChristopherBaker,PlanningDirector;andBrendaHoffren,SecretaryAbsent:BernieFogarty;BobMannich;ErikCortinasThemeetingwascalledtoorderat500PMbyViceChairmanBassett.Theapprovalofthereadingoftheminuteswaswaivedastheywerenotavailableatthemeetingforreview.Mr.BakerexplainedthatHurricaneIvanhaddelayedputtingtogethertheusualpacketsavailabletotheBoardmembers.Heapologizedtotheboard.ZBA04-25PublichearingtoconsidertherequestofMr.Hollingerat60WhiteAvenuefora5footseparationvariancebetweenaproposedadditionandaccessorystructure.Mr.Bassettaskedfortheowneroragenttocomeforwardtopresentthecase.Noonewaspresent.AmotionwasmadebyLewisAgeetotablethecaseuntilnextmonthtogivetheownerachancetoattend.Duetothehurricane,theymayhavehadproblemsgettingtothemeeting.AsecondbyRayClarktotableAllapproved.ZBA04-26PublicHearingtoconsidertherequestofMr.&Mrs.NelsonforanAdministrativeAppealtoallowtheconstructionofanaccessorybuildingtobeoccupiedtemporarilyuntiltheprimarystructureisrenovatedlocatedatS.SectionStreet.Mr.&Mrs.Nelsoncameforwardandexplainedtheyhadpurchasedthishomeandhadahomeinspectionwhichindicatedtherewerenosignificantproblems.Therealestateagenthadassuredthemthepropertywaszonedtoallowagarageapartmentinadditiontotheprimaryresidence.Theyboughtitwiththatunderstanding.Theyfoundsignificantdamagetothefloor,heating&air.andelectrical.Whentheycameintothebuildingdepartmenttoinquireaboutpermits.BrendaHoffrensaiditwasasinglefamilydistrictandsuggestedtheyapplytotheBoardofAdjustmentstoallowthetemporaryoccupancyofaaccessorystructure.Theywishtobuildasinglestory24x24garagewithshowerfacilitiesandalaundryroom.Theyhadmovedfroma4000squarefoothomeintothisonejustover1100squarefeet.Theywillagreetoremovetheshowerafterthecompletionofthehouse.Theymayusetheaccessorythenasstorage,ahobbyshop,butnotaslivingspace.ThepublichearingwasopenedbyMr.Bassett.Noonewaspresentintheaudiencetospeak.ThePublichearingwasclosedandcommentswererequestedfromtheBoardmembers.Mr.Clarksaidtheapplicantskeptreferringtotheaccessoryasagarage.butthelayouttheypresentedmadeitdifficulttoconvertittoagaragelater.Thebathroomwasinthecenterofthestructure.Howdidtheyplantoparkcarsinitwiththisinthecenter.Thelayoutdoesnotsuggestalateruseasagarage.TheBoardassumesyouaregoingtodowhatyousay,butanewownermayeasilyconverttoasecondresidentialuselater.Mr.Nelsonindicatedthelayoutwasoptional.Theyhadafriendhelpthemputittogethertryingtogetasmuchworkableareaastheycouldoutofthespaceavailable.Mr.Bassettsaidthatlookingatthefloorplan,itindicatesaresidentiallayoutwithlivablespace.notaneasilyconvertedgaragespace.Future conversionisadefinitepossibility.Mr.Bakerindicatedthatanaccessorystructure[ailsunderthe50%rule.Hebelievedtheirplanexceededthis.Theyshouldchecktheirsquarefootageandreducetheirproposedfootprint.Mr.AgeeaskedifwhattheyproposedcompliedwithusespermittedinanR-2district.Christopherstatedtheycouldhaveastudio,recreationroom,orofficespaceaslongasitcontainednocookingfacilitiesorfullbathfacilitiesanddidn’tcreateacommercialuse.Mr.AgeeandotherboardmembersfelttheNelsonsshouldbegivenachancetorethinkwhattheysubmitted.Theydidn’twanttojustsaynobasedonwhattheplansshowed.Thesubmittalofplansmoreinlinewithaconvertibleaccessorystructurewouldbebetterreceived.TheNeisonsagreedtoresubmitadifferentplanforconsideration.Mr.AgeemadeamotiontocontinuetotheOctobermeeting.AsecondwasmadebyRayClark.Allapproved.Mr.Bassettrecognizedalatearrival,Mr.Hollinger.Case#ZBA04-25RayClarkmovedtountablethecase.AsecondbyLewisAgee.Mr.BassettaskedMr.Hollingertopresenthiscasetotheboard.Mr.Hollingerstatedhewishedtoaddabedroomandutilityroomtohishouse.Healsowantedtoconstructadetachedgarage.Thezoningordinancerequiresa10’separationbetweenthehouseandaccessorystructures.Hehadroomtomoveittherequired10feetaway,butwouldlosesomelargedogwoodtrees.Hehopedthattheboardwouldallowhimthe5feetofseparationifheprovidedafirewallandnowindowopeningsnexttotheaccessorystructure.Thepublichearingwasopen.Noonewaspresenttospeak.Thepublichearingwasclosed.AdiscussionfollowedinwhichMr.BakerstatedtheplanscouldbeapprovedbythebuildingofficialatthetimeofpermittingforcompliancewithnumberofopeningsandfireseparationTheseparationrequirementinthezoningordinanceisfire&safetyrelatedaswellasopenspace.LewisAgeemadeamotiontoapprove.AsecondfollowedbyRayClark.Allapproved.ZBA04-27PublicHearingtoconsidertherequestofMr.Grayforacitysewerconnectiontolot4VolantaViewSubdivisionlocatedonCreekDriveandfrontingonFlyCreek.Mr.GraystatedheownedahouseboatparkedinasliponFlyCreekadjacenttohisproperty.Hehadthemotorremovedtoallowhimtobacktheboatintotheslip.Hecannolongertraversethechanneltoemptyhisholdingtank.Oneofhisneighborsonlot3hadsewerinstalledafewyearsago.Hewantedtodothesamething.Hedoesnotintendtobuildanythingonthelot,justwantstobeabletohookontocitysewer.ThepublichearingwasopenedbyMr.Bassett.MikeGordanof300CreekdrivesayshealsoownslotsonCreekDrive.HewouldliketohaveclarificationonzoningandusesofthelotsinVolantaView.Hewouldliketoseesewerthereforallthelots.Heknowsabuildingisalreadythereandbeinglivedin.ThisestablishedaprecedentintheneighborhoodandMr.Grayshouldhaveaccess.Othersarelivingontheirhouseboatsintheareaandhavenosanitaryfacilities.TyingontotheCitysewerisabetteroption.Mr.Gordansaidhehadreceivednonoticeoftheseproceedings.Incheckingtherecords,hisaddresswaslistedasHomewood,ALonCountyrecords,insteadofDaphne,AL.Hiscertifiedletterwasreturnedtousasundeliverable.JeffJonesof258S.SchoolStreetspokeforpropertyownerCynthiaWebsterasshewasunabletobethere.Sheisinsupportofthesewerconnection forMr.Gray.ShewouldalsoliketobeonCitysewer,buthasbeentoldaswasMr.Gordanthatitisnotavailable.Thepublichearingwasclosed.Mr.BakersaidthepossibilityoftyingontothesewerlineasMr.Grayintendedmaynotbepossible.Itsoundsasifheisproposingtotieontothelateralrunningontolot3belongingtoMrTrione.TheCityrequiresthatlateralsberuntothemainforconnectiontothesewerline.Toomanyconnectionsonalaterallocatedonprivatepropertycouldcauseproblemsinthefuture.Thepossibilityofaleakorstoppageinthelinecouldcauseallresidencestobackupwithnoonebeingsurewhoisatfault.AdiscussionwithDanMcCrory,Water&SewerSuperintendent,needstotakeplace.ThereisthepossibilityofextendingthemaintoaccommodateMr.Grayandothers.RayClarkwasconcernedthatthehouseboatbeingconnectedtothesewerconstitutedaresidenceonasubstandardlotinanR-1district.Mr.Bassettaskedaboutthebasefloodelevationforthisproperty.AmotionwasmadebyCathySlagletotablethiscaseuntiltheOctobermeeting.ThiswillgivetheownertimetomeetwithMr.McCroryandhaveMr.BakercheckthesubdivisionplatforVolantaView.AsecondfollowedbyRayClark.Allapproved.OldINewBusinessChristopherBakerremindedtheBoardthatvotingfornewofficersisrequiredattheOctober18,2004meeting.TheymaywanttoappointacommitteeorjustdecidewhotheyarenominatingforChairman.ViceChairmanandSecretary.AmotiontoadjournwasmadebyRayClark.AsecondfollowedbyLewisAgee.Allapproved.Meetingadjournedat6:11PM
