TheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,May17,2004at5:00PMintheCityAdministrationBuilding,61N.SectionStreet.MembersPresent:BernieFogarty,Chairman;CharlieBassett;BobMannich,LouisAgee;RayClark;CathySlagleandBeckyLundberg,alternates;ChristopherBaker,PlanningDirectorsittinginforErikCortinasandBrendaHoffren,Secretary;Absent:ErikCorlinas,CBOAl5:00P.M.themeetingwascalledtoorderbyChairmanFogarty.MemberswereaskedtoreviewtheApril19,2004meetingminutesforconsiderationandmakeamotiontoapprove.CharlieBassettmadeamotionforapprovalaswritten.SecondbyLouisAgee.Allapproved.ZBA04-15RequestofLarryThomasof56SagginoaksCourtforafrontyardsetbackvariance.Mr.Thomascameforwardandstatedhishomewaslocatedinasmallcul-desac.HehadnotbeenintheCitylimitswhenthehousewasbuilt.HeownsallthesurroundingpropertyanddidtheoriginaldivisionofSagginoaksS/D.Hisin-lawsoccupiedoneoftheadjacentproperties.Hehaspurchasedapermitforrenovatingthestructure,exceptforthechangeinthefrontporch.Hishousewasbuilt42’offtheRowwhenpermittedinthecounty.Withtheadditiontothegableandchangestotheporch.hewillintrude7’intorequiredCitysetbacksinanR-1district..HesubmittedhisplanstotheBoardmembers.Whenheannexedin,hecameinasanR—1non—conformingsubdivision.SagginoaksCourtisa50footCityROW,butisnotmaintainedbytheCity.ThePublichearingwasopened.Noonewastheretospeak.Publichearingwasclosed.TheBoardhadabriefdiscussionregardingthefactthathehadnoimmediateneighborsandownedalltheproperty.CharlieBassettmadeamotiontoapproverequest.LouisAgeesecond.Therewerenoneopposed.ZBA04-16RequestofCalBuildersforafrontardsetbackvarianceat656FairhopeAvenue.C.W.Bunkley,representativeforCalBuilders,saidtheyarecurrentlyrenovatingthehouse.Itissetbackat32/2feetfromthepropertylinefrontingonFairhopeAvenue.Allfloorswererottenbecauseofwaterconstantlydrainingunderthehouse.Theyhavenowmadetherepairstothefloorandwanttoadda4footporchadditionacrossthefrontofthehouseandbuildupthegradetodivertthewatertotheEastandSouthofthehouse.Gutterswouldhelpwiththerainwater,butsurfacewateristhebiggestproblem.RayClarkaskedifhecouldnotdoadecorativelandscapewallinsteadoftheporch.Mr. Bunkleystatedthehousehasastemwallwhichundercutsthefooting.Theyfeeltheyneedtogofurtherouttodivertthewaterandthewoodwouldbedrier.RayClarkaskedifanengineerhadlookedattheproblem.Hehadconcernsregardingcompoundingtheproblem.Mr.Bunkleystatedhehadbeenbuildingfor40yearsandfeltcomfortablethatitwouldhelp.CharlieBassettsaidthedirectionoftherunoffseemstomaketheproblemworse.Mr.AgeeaskedifMr.Bunkleywouldbewillingtoconsiderotheralternatives.Ifhewithdrawsbeforethepublichearingisopen,hemaycomebackforconsiderationoftheseotheralternatives.Mr.Bunkleyagreedtoconsiderotheroptionsandpossiblycomeback.Herequestedwithdrawal.ZBA04-18RequestofJuliaDriverfor1footfreeboardfloodzoneelevationvarianceforthepropertylocatedat16433ScenicHighway98inPointClear.Ms.DriverandLeeVerneuilleaddressedtheBoard.TheystatedtheconstructionproposedwillmeetallminimumelevationFEMArequirements.Theyareaskingforreliefonlyfi-omtheCityofFairhoperequirementforanadditionalfootoffreeboardinafloodzone.Thisreliefwouldapplyonlytotheexistingsunroom,existingstudyandexistingporches.Elevationfortheexistingiscurrentlyat11.07feetandtherequirementwithfreeboardis12feet.Thepublichearingwasopened.Noonewaspresenttospeakandthehearingwasclosed.CharlieBassettaskedifthiswastheNewberryhousebuiltaround1989.Mr.Verneuillesaiditwasandthepresentownersaretryingtoleveloutsomeoftheareasinthehouse.Mr.MannichaskedwhytheCityhasarequirementfor/afootoffreeboard.ChristopherBakerexplainedthatthisisstronglysuggestedbytheStateFloodplainCoordinator.Thecityadoptedthemodelcoderequirementsandthefootoffreeboardispartofit.Itgivesallfloodpolicyholdersinthecommunityanadditionaldiscountonpremiums.Mr.MannichaskedifgrantingtherequestedvariancewouldjeopardizetheCity.Mr.Bakersaidno,theyarestillmeetingtheFEMAminimumsrequired.Mr.Bakerstatedthebuildingdepartmenthasnoobjectionstotherequest.AmotionwasrequestedbytheChairman.CharlieBassettmadeamotiontoapproveasrequested.AsecondbyRayClark.Allapproved.ZBA04-19RequestofCurtCloningerforauAdministrativeAppealforrecognizingtwooriginallotsofrecordfortheparcellocatedat304S.Bayview.L RobertCloningerwaspresenttospeakonbehalfofhisbrother,CurtCloningerwhocouldnotbepresent.Hestatedthetwolotsdatebackto1913.Hisbrotherwouldliketobuildononeandhasabuyerfortheother.Thereisanexistingcottageonthepropertywhichiscurrentlybeingrented.Thepublichearingwasopened.Noonewaspresenttospeakandthehearing\VSclosed.MrAgeestatedhefelttheapprovalshouldbecontingentuponthecottagebeingremoved.Astherewerenoothercomments,amotionwasrequested.BobMannichmovedtoapprovecontingentuponthecottagebeingremoved.AsecondbyMr.Agee.Allapproved.Astherewasnooldornewbusiness,amotiontoadjournwasmadebyCharlieBassett.AsecondbyRayClark.Meetingadjournedat5:33PM
