WebLinkAboutMinutesTheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,March8,2004foraSpecialMeetingat5:00PMintheCityAdministrationBuilding,161N.SectionStreet.MembersPresent:BernieFogarty,Chairman;BobMannich;RayClark;BeckyLundberg,alternate;CathySlagle,alternate;ErikCortinas,CBOandBrendaHoffien,Secretary;AbsentwereCharlieBassettandLouisAgee.At5:00P.M.themeetingwascalledtoorderbyChairmanFogarly.MemberswereaskedtoreviewtheFebruary16,2004minutesforconsiderationandmakeamotiontoapprove.AmotiontoapproveaswrittenwasmadebyRayClark,andasecondbyCathySlagle.Allapproved.ZBA04-10Jonathan&ReneSlioltisrequestforarearanddrivewaysideyardvarianceforthepropertyat13CambridgeCourt.ChairmanFogartyaskedMr.Sholtistocomeforwardandpresenthisrequest.Mr.Sholtisgavehispresentaddressas1504CaptainONealDriveinDaphne.TheyhavealotinCambridgeCourttheywishtobuildon.Restrictivecovenantsforthesubdivisionrequirethatthegaragenotopenonthefrontofthelotandtheyhaveasquarefootagerequirement.Intryingtomeettheserequirementsandthesetbackrequirements,theyfoundtheyrequiredavariance.Mr.Sholtisindicatedthatinadditiontotherequiredlettersmailedoutbythecity,hehadmailedoutalettertoeachaskingthemtorespondwithanycommentstothebuildingdepartment.Thecityreceivednounfavorableresponsesorcalls.Hefelttheresponsefromhisneighborswasthemostcompellingreasonforapprovaloftherequest.Second,thepieshapeofthelotwillrequirethemtodoadetachedgarageintherearifthevarianceisntapproved.Itwouldbenecessarytocutdownsometreesandthedetachedgaragewouldbeclosertoneighboringpropertiesthanitwouldbeattachedinitsproposedlocation.Theyhaveworkedreallyhardtocomeupwithplanstofitinwiththeexistinghomesintheneighborhood.Theyfeelthisisthebestplanandneighborsagree.Thepublichearingwasopened.Noonewaspresenttocomment.However,ErikindicatedtheresponsesreceivedfromneighboringpropertyownerswereinsertedintheBoardmemberspacketsandwereallpositive.Sincethepacketswentout,therehavebeenadditionalresponsesreceivedbymailandphoiewhichhavealsobeenpositive.Thedepartmenthasreceivednonegativecomments.Thepublichearingwasclosed.CommentsweresolicitedfromtheboardbyMr.Fogarty.QuestionswereaskedofMr.Sholtisrelatingtothesquarefootagerequired;(2400H&C);theorientationofhisgarageopening;(sideentry);andthesquarefootageofhisproposal;(3000sq.ft);isitcommensuratewiththerestoftheneighborhood;(yes,2062onfirstfloorand950onthesecond);isthereenoughturningradiusforasideentrygaragewithL Ageestatedthattheexistingprivacyfencehidestheaddition.Mr.Fogartycalledforamotion.CharlieBassettmadeamotiontoapproveassubmitted.LouisAgeesecond.Allapproved.ZBA04-08Chatliam/DenhamAdministrativeAppealre:UseinaB-3BDistrict.CharlieBassettaskedtorecusehimselfashehadapersonalinterestinthecase.Hesteppeddownfromthedais.ChairmanFogartyaskedalternate,BeckyLundbergtovoteinMr.Bassett’sstead.BobChatham&DonaldDenhamcameforwardtopresenttheirrequest.Mr.Chathamintroducedhimself&Mr.Denhamsayingtheywereplanningtobuythepropertyat116FairhopeAvenue.Theyproposetousethebuildingforadesignandaccountingbusiness.Inreviewingthezoningordinance,theyfeltitwasacompatibleuseinaB3Bastherearealreadybusinessusessuchastheirsontheblock.TheyweresenttotheBoardforclarificationontheiruse.ChairmanFogartyopenedthepublichearingandaskedifanyoneintheaudiencehadcomments.LeaVerneuilleofWalcottAdamsVerneuilleArchitectsstatedthathewastheretoviewhowtheBoardmayruleonthiscase.ThezoningordinanceleadsyoutobelievethatanofficeuseisallowedinaB3B.Isthisgoingtobedoneonacasebycasebasisorwillwegel,aclarificationtonightforfutureuses?Mr.FogartyindicatedthattheBoardwouldtrytoclarifyittonight.WalterS.Pattonof109FairhopeAvenuecameforward.Hesaidhelivesontheoppositesideabouttwodoorsdown.Heaskedaboutthenumberofemployeesthesebusinesseswouldemployandiftheyplannedtomixcommercialandresidential.Mr.ChathamsaidsixandMr.Denhamindicatedhehadone.Mr.Chathamsaidheisnotlookingtogrowatthislocation.Heisactuallylookingtodownsize.Thebuildingwillnotbeusedforaresidence,onlythecommercialuse.Mr.Pattonsaidthereisa“slipperyslope”inFairhope.Therearefamilyhomesinthisareathathavebeenlivedinforgenerations.Thesefamilieshavechosentostayandinvestintheirhomes.ItwillbeagreatlosstoFairhopeifitevolvesintoatotalbusinessarea.HewelcomesChatham/Denhamasanewneighborandwishesthemwell.Astherewerenoadditionalcomments,thepublichearingwasclosed.CommentsweresolicitedfromtheBoardmembers.RayChtrkaskedifitwasappropriatetorequirethetenanttoprovideparkingintherearforemployeesandcustomers.Erikexplainedthattheseissueswouldbelookedintowhenthebuildingpermitwasissued.RayClarksaidparkingintherearwouldmaintaintheresidentialneighborhoodflavor.Mr.Chathamindicatedhewouldhavenoproblemencouraginghiscustomerstoparkintherear.Hewouldputupasmallsignindicatingthatparkingintherearwasavailable.ErikstatedthatpublicparkingisavailableonFairhopeAvenueinfrontofthestructure.We7 cannotprohibitparkinginapubliclydedicatedspace.InregardtoMr.Patton’scomments,thezoningintheneighborhoodiscommercial,notresidential.TheCitycan’tdenypermitsandlicensesforthosecommercialusesallowed.Erikreadhiscommentsexplainingthatthereappearedtobeaconflictintheordinanceinregardtousesallowed.It‘asfeltthatthismattershouldbeclarifiedbytheBoardofAdjustments.UsesallowedinaB-4wouldincludethetypeofbusinessMr.Chatham&Mr.Denhamareproposing.BobMannichmadeamotiontoapprovesayingthataB-4useisallowedinaB3Bandsuggestedoffstreetparkingshouldbeprovidedforemployeesandcustomersintherearforthislocation.LouisAgeesecondedthemotion.Themotioncarriedwithnoopposition.ZBA04-09CraigTappan6’streetsideyardsetbackfor116OakStreetChairmanFogartyaskedMr.Tappantopresenthiscase.JoeSledgeof2l1PiercameforwardasMr.Tappan’srepresentative.Mr.SledgeindicatedalargeoaktreeintherearontheWestpropertylinetheywishtosave.Tokeepittheyarerequestingastreetsidevarianceforthedetachedgaragetheypropose.Itwillsitapproximately14’fromthepropertylineborderingonSummitStreet.Thepublichearingwasopened.Astherewerenopubliccomments,thepublichearingwasclosed.CommentswereaskedfromtheBoardmembers.Mr.MannichaskedifMr.Tappanwasplanningtoremovetheexistingstructureandusethegrandfatheredsetbacks.Mr.Sledgeansweredtheywouldbeusingonlyaportionofthegrandfatheredsetbacks.Theyarematchingthefrontsetbackofaneighboringpropertyandremovingothernonconformingareasentirely.BeckyLundbergaskediftheyhadplansfortheproposedstructure.Mr.Sledgeindicatedtheyonlyhadaproposedfootprinttoobtainthevariance.Mr.Ageestatedthathefeltthenewconstructionwouldreducenonconformitiesandimprovetheappearance.Eriksaidtheoaktreeinquestionismorethan36”indiameter.Thevariancerequestisforthedetachedaccessoryonly.CharlieBassettaskedifthecarportasattachedasthefootprintdoesn’tshowhowitisattached.Eriksaiditwasattachedbyanopenwalkwayonly.AmotionwasrequestedbytheChairman.CharlieBassettmadeamotiontoapproveaspresented.BobMannichsecond.Allapproved.Old/New’BusinessErikstatedthathewouldliketoclarifyarulingfortheNovember2003meetingforcase#ZBA03-22AliezeCapell.ShewasgrantedavarianceforconstructionofaresidenceonFrederickStreetlot7.Thepurposewasmovingtheconstructionoutofthefloodwayontheproperty.Movingthestructurewouldallowthemtobuildwithoutano—risecertificate.Eriksrecollectionwasthatthehousewastobeconstructedtotallyotitofthefloodway.Anyintrusionintothefloodwaynegatedtheirvarianceandtheywouldberequired-3
