TheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,June21,2004at5:00PMintheCityAdministrationBuilding,161N.SectionStreet.MembersPresent:CharlieBassett;BobMannich,LouisAgee;RayClark;CathySlagle,alternate;ErikCortinasandBrendaHoffren,Secretary;Absent:BernieFogarty&BeckyLundbergAt5:00P.M.themeetingwascalledtoorderbyMr.Bassett.MemberswereaskedtoreviewtheMay17,2004meetingminutesforconsiderationandmakeamotiontoapprove.CharlieBassettaskedthatainsertionbemadeforcase#04-15LarryThomaswithregardtothestreet,SagginoaksCourt,beingaCityofFairhopeROW,butnotmaintainedbytheCity.BrendaHoffrenindicatedthechangewouldbemadetotheminutes.Amotionwasrequestedforapprovaloftheminuteswithoneminorchange.MotionbyBobMannich.SecondbyRayClark.Allapproved.ZBA04-20VariancerequestofJamesMcDonoughforfront&rearsetbackvariancesforintrusionsat429ClubhouseDriveinRockCreek.ChairmanBassettaskedMr.McDonoughtocomeforward.Mr.McDonoughwasnotpresent.Mr.BassettaskedErikforhiscomments:McDonoughHomes,Inc.builtthehouselocatedat429ClubhouseDriveinRockCreekS/D,whichiszonedasaPlannedUnitDevelopment(PUD).Therequiredsetbacksforthelotare30forthefront.30fortherear,and10fortheside.Atsomepointduringthelayoutandconstructionofthefoundationthemeasurementswereincorrectandithasresultedinthebuildingbeingoverthesetbacklinesonthefrontandrear.ThehousehassincebeenpurchasedandtheBuildingDepartmentcannotapprovethezoningportionoftheCertificateofOccupancysincethesetbacksarenotcorrect.STAFFCOMMENTS:Followingstrictinterpretationofthehardshipclause,therehastobeaninherentcharacteristicofthepropertythatwillnotallowtheapplicanttofulfilltherequirementsoftheregulations.Inthiscasethereisnosuchhardship;thereisaconstructionmistakethathasresultedinanon-compliantstructureTheprimaryconcernatthispointisthatthenewownersofthehomecannotobtainacleantitleforthebuildingwithoutthezoningapproval.Neithersetbackintrusionimpactsanyutilityordrainageeasementsontheproperty.Howeversincethesurveyshowsthatthebuildingisnotincompliance,regardlessoftheamountoftheintrusion,wecannotsignacompliancecertificatefortheproperty.Legalnotificationshavebeenmadetoallpropertyownerswithin300’andwehavereceivednoobjectionstotherequest.Basedonthis,andinthebestinterestsofthenewowners,werecommendapprovaloftheapplicationaspresented.Erikindicatedthattheintrusionwas6inchesonthefrontand2inchesontherear.Thisisaminorintrusion,butazoningcompliancecertificatecannotbesignedwhenthebuildingexceedsitssetbackminimums.EventhoughMr.McDonoughfailedtoshowup,itstillleavesthenewownerneedingarulingregardingthevariancetoclearhistitle.Thepublichearingwasopened.DannyCalhounwaspresentwithMr.&Mrs.JohnCasto,ownersoftheresidence.HeaskedthattheBoardtakenoactionadversetotheCastos.Mr.CalhounwastheclosingattorneyforthepropertyrepresentingtheCastos.Astherewerenoadditionalcomments,thepublichearing‘asclosed.TheBoardrequestedthattheminutesreflectMr.McDonoughsfailuretoshowupforthepublichearing.ChristopherBaker addressedtheBoard.HeindicatedMr.McDonoughhasahistorywiththebuildingdepartmentofnotobtaininghiscertificatesofoccupancywhenhecompletesaresidence.Thiscausesfrequentproblemsfornewowners.HehasbeenputonnoticebytheBuildingDepartmentthatcontinuingthispracticewillcauseasummonstoMunicipalCourt.ThisvariancerequestisduetoMr.McDonough’serrorinlayingoutthefoundationofthehouse.HesuggestedthattheBoardrequirestakeoutsurveysonMr.McDonough’shomesbuiltinourjurisdiction.ErikCortinasstatedthatrequiringanafterfoundationsurveyinsteadofafinalstakeoutwilltellyouwhereyouare.Duringthelayoutofthefoundation,careshouldbetakentoconsidertheadditionalwidthoftheexteriormaterial.Ifaproblemshowsupwhenthefoundationissurveyed,analternateexteriormaterialcanbeusedorthefoundationadjustedtocompensate.Aftersomediscussion,amotionwasmadebyRayClarktorequireasurveyattimeoffoundationinspection.AsecondbyBobMannich.Allapproved.AnadditionalmotionwasmadebyBobMannichtoapprovethesetbackvariancerequest.AsecondbyCathySlagle.Allapproved.Toclarify,asurveywillberequiredpriortopouringconcreteonallMeDonoughHomesinCityofFairhopejurisdictionforpermitting.ZBA04-21SpecialExceptionRequestofFairhopeUnitedl’IethodistChurchforpermissiontorelocateDantzlerMemorialScoutLodgetolots76&77inColonyPlaceSID.TommyHarris,ChairmanoftheBuildingCommitteeandDeniseLoresforFairhopeUnitedMethodistpresentedthecaseforthechurch.ScoutTroop47isachurchsponsoredactivity.ThetroophasbeenactiveinFairhopefor75years.TheyhavebeensponsoredbytheChurchformanyofthose75years.Thechurchisundergoingexpansion.AnewChristianLifeCenterandeventuallyanewsanctuaryareproposed.Thelodgeneedstobemovedfromitslocationonchurchpropertytoprovideaccessforupgradingdrainage,parkingandsitepreparationforthenewconstruction.FairhopeSingleTaxCorporationhastentativelyapprovedthenewlocationinColonyPlace.HepassedtheBoardmembersasiteplanshowingthefootprintoftheproposedstructureandproposedlandscaping.PhotosofthecurrentlocationandnewlocationweregiventotheBoardmembers.Alleffortswillbemadetocreatearesidentialfeelfortheproperty.ThePublichearingwasopen.AllenCobb,builderandrealestateagentofP.O.Box324Fairhope,addressedtheBoard.HehasahomeunderconstructiononRockwellLane.HeturnedinapetitionsignedbyallthepropertyownersinColonyPlacetotheMayorandCouncilstatingtheirobjectiontothehomesbeingmovedintoColonyPlace.Someoftheownerswerepresentwithhimtonight.HecontendedthattheaveragevalueofthehomesinColonyPlaceareintheS13O-$45,OOOrange.Bringinginthemovedhouseshascausedtheirpropertyvaluestogoclown.Hewasunableto2 buyoneofthelotsproposedfortheScoutLodgelocationasiiwasonholdbyFSTCforthelodge.OnepotentialbuyerdecidednottopurchasefromMr.CobbbecauseofthependingScoutlodge.Mr.CobblovestheBoyScouts,butresidentsdontwantthenoiseandintrusionintheneighborhood.Theresidentsdon’twantit.butFSTCownstheproperty.andtheresidentsfeeltheyhavenosayintheirneighborhood.TheyhopetheCitywilllistentothecommunity.Mr.MannichaskedifthepetitionwasrelatedtotheScoutlodgeorusedstructures?Mr.CobbindicatedtheinitialissuewithFSTCwasregardingmovinginoldstructures.Theyareinvaryingdegreesofcompletionandcreateaneyesore.TheScoutlodgeissuewasjustonemoreholeintheboat.CouncilmembersindicatedtherewereotheroptionsavailableforScoutlodge.ResidentsaskedifitcouldbeplacedintheFoundersParkareaadjacenttoballfields,butweretoldthattheCitycannotallowtheplacementofprivatelyownedstructuresonCityproperty.GeneBrabstonof506N.SectionspokefortheTroop.HeindicatedtheresidentsoppositionattheFSTCmeetingwasnotagainsttheScoutTroop,butthebuilding.TheScoutsarealwaysunderadultsupervision.Useofthepropertyisminimal,justafewhoursaweek.Hefeltthepumpstationlocatedadjacenttothesitewouldbeanegativeforaresidence.TheScoutLodgewouldprovideagoodbufferfromthepumpstationandhighschoolpropertytotheWest.Mr.Mannichaskedaboutplansforimprovingthebuilding.Couldtheypossiblybeheldtoahigherstandardforlandscapeandmaintenanceofthebuilding?ErikandCharlieBassettindicatedthatallcomponentsoFthebuildingwillhavetobebroughtuptocurrentbuildingcodeminimumsbeforeitisallowedtobeinhabited.AsitisbeingusedforanAssembly,thismeanscommercialcode.TommyHarrisstatedthechurchhasmoneybudgetedtoupgradethebuilding.Theyalsobudgetmoneytokeepupthelawncareandmaintenanceofthestructure,justasthechurchpropertyismaintained.DeniseLoresof200ContiCourtspokefortheChurchregardingthesite.Inalltheyearstheyhavebeenonthechurchproperty,nocomplaintsaboutnoiseorbehaviorhaveeverbeenreceivedabouttheScoutTroop.Grasshasbeencutonaweeklybasis.Ms.Slagleaskedaboutfrequencyofmeetings.RayClarkaskedaboutparkingandthepondarea.Willtherebecommunityaccessforthesite?Mr.Brabstonindicatedthemeetingsaregenerally2hoursorless,twoeveningsaweek.Thereareoccasionallyspecialevents(usually3-4timesperyear).Mr.HarrissaidtheywerelookingtoaccessthepropertyfromManleyRoad,sotherewouldbenodrivewayonRockwellLane.TheparkingwouldbeontheSouthside,thepondareawouldbemaintainedasanaturalareaaspartofthelandscape.Andthesiteisnotforthecommunity,justBoyScoutactivities.L
