ZBA04-23AshleyMcGinnisrequestfora15footfrontsetbackvarianceat305LibertyStreetforaporchaddition.ChairmanFogartyaskedMr.McGinnistocomeforwardandpresenthiscase.MrMcGinnisstatedheandhiswifewerecurrentlylivinginCoralGables.Florida.TheyplantomovehereandwanttogivethefrontofthehousemoreofaFairhopecottagelook.Thepreviousownerplacedtheexistingpergolaoverthefrontoftheresidence.HeshowedtheBoardmembersdrawingsofthefinishedelevationsheisproposing.Thebedroomwingexistingalreadyjutsoutfivefeetbeyondtheproposedporchareahewantstoadd.CharlieBassettaskedErikifthiswasaconformingR-2lot?Erikindicatedthattohisknowledgeitis.Whywasthepergolaaddedtothefront?Erikansweredthepreviousownerwantedtoaddaporchacrossthefront:butitwasn’tallowedbecauseofthesetbackintrusion.Mr.BassettaskedifshebuiltthepergolabecauseshechosenottogototheBoard?Yes,shedid.Mr.ClarkaskedifthepreviousownerhadcometotheBoardifshewouldhavehadthesameopportunitytobuildherporch.Erikansweredthatshedefinitelyhadthatoptionandchosenottopursueit.Mr.Mannichindicatedthatlookingattheplotplanprovided,theresidencealreadyencroachesfurtherintothesetbackthanthenewporchaddition.Allowingtheporchexpansionwouldnotcreateanewfrontsetbackprecedent.Hedidn’tseeaproblemaslongasitwasn’tclosedin.QuestionswereaskedofMontyFox,whoisthebuilderforMr.McGinnis.Mr.Foxindicatedthenewporchwillbe24feetlongrunningunderthetwofrontwindows.Theexistingstepswouldberemoved.Theywon’taccessfromthefrontoftheporch.ChairmanFogartyopenedthePublicHearing.PaulRabinof303LibertystatedthathehadcomeinsupportofMr.McGinnisplan.Theywouldbepleasedtoseetheaddition.HalNormandof304Libertyhaslookedattheplansandtotallysupportstheaddition.ThePublichearingwasclosed.Erikwasaskedforhiscomments.ErikstatedthatheandMr.McGinnishadseveralconversationsregardingthisproject.Staffhastolookatitregardinghardshipsfortheproperty.Itisaconforminglot,thestructureisnot.Italreadyextendsintotherequiredsetback.Andhehastorespectfullydenyapproval.Mr.Ageestatedweareconstantlyraisingissuesofwhathasbeendonebefore.Weneedtolookateachcasebasedonitsownmerit.Allowingtheextensionontheporchwouldnotcreateanewalignmentpointforfutureresidences.Theywouldalignwiththewing,nottheporch:Amotionwascalledfor.RayClarkmadeamotiontoapprovetheadditionsubjecttoitremaininganopenporch,notanenclosedspace,withtheexceptionofscreening.Eriksuggestedtheownermakethisanadditionalclauseinthedeedsofuturebuyerswouldbeawareoftherestrictions.AmotionwasmadetosecondMr.Clark’smotionbyCharlieBassett.Allapproved.Astherewasnooldornewbusinesstodiscuss,ChairmanFogartyrequestedamotiontoadjourn.LewisAgeesomotioned.AsecondbyBobMannich.Meetingadjournedat5:40PML
