WebLinkAboutMinutesTheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,July19,2004at5:00PMintheCityAdministrationBuilding,CouncilChambers,locatedat161N.SectionStreet.MembersPresent:ChairmanBernieFogarty;LewisAgee;BobMannich;CharlieBassett;RayClark;alternatesBeckyLundbergandKathySlagle;ErikCortinas,CBO;andBrendaHoffren,SecretaryThemeetingwascalledtoorderbyChairmanFogartyat5:00PM.MemberswereaskedtotakeamomenttolookovertheminutesoftheJune212004meeting.Mr.BassettaskedthattheminutesreflectMr.Clark’srequestforapetitionrelatingtotheScoutHutfromMr.Cobb.AmotiontoapprovewiththischangebyCharlieBassett.AsecondbyRayClark.Allapproved.ZBA04-21FairhopeUnitedMethodistChurchrequesttoplaceDantzlerMemorialScoutLodgeonlots76&77inColonyPlaceSID.ChairmanFogartymadeanannouncementregardingthepetitionersrequesttopostponethehearing.AcopyofthewrittenrequesthadbeenprovidedtotheBoardsubmittedbyTommyHarris,BuildingCommitteeChairmanforFUMC.AmotionwasmadebyCharlieBassetttomovethehearingtotheAugust16,2004agenda.AsecondfollowedbyRayClarktoplaceonAugustagenda.ZBA04-23BenjaminDreading462SatsumaStreetrequestforanAdministrativeAppealregardingtwolotsofrecordberecognized.ChairmanFogartyaskedMr.Dreadingtocomeforwardandpresenthiscase.Mr.DreadingindicatedhewantstomovetheresidencelocatedonthepropertyandwantstheoriginaltwolotsrecognizedThepurposeistobuildtwonewresidentialdwellings.Thedivisionwasrecordedon11/10/60.ThePublicHearingwasopened.DickAbronskiof31OrangeStreetcameforward.Hehasnoobjectiontothelotdivisionorbuildingtwonewhomes.Hisconcernisaboutdrainage.Thelotsarebelowstreetlevelandfillingwillcauseproblemsforhim.Hewantsassurancethatnofillwillbebroughtin.AcopyofhiselevationwassubmittedtotheBoard.JimHugginsof21Orangecameforward.HispropertyisjustWestofMr.Dreading.Hispropertynowholds6’ofwaterafterabigrain.SatsumastreetishigherthantheDreading,Abronski,andhisland.Healsohasconcernsregardingallowingfillonthisproperty.EithernofillisallowedorthewaterhastobechanneledintoCitydrainage.CharlieBassettaskedErikCortinasifdrainagewasn’tsomethingtakenintoconsiderationatthetimeofbuilding?Eriksaiditisregulatedatthetimeofpermitting.Itismoreappropriatewhenplansaresubmitted.Thebuildingdepartmentreceivesanycomplaintsduringthebuildingphaseandresponds.Mr.Hugginsaskedifwecanjuststopthefilling?Erikstatedthatwehavenoordinanceinplacetopreventanyonefromfilling.WedohavesomelimitedauthorityoverstormwaterissuesduringconstructionButwecannotsaynotofill.MrAbronskiaskedifthiswasn’tafterthefact?Erikstatedthatthefoundationplansfortheresidenceareakeyindeterminingwhatneedstobedone.ThePublicHearingwasclosed.ChairmanFogartyaskedErikforhiscomments.ErikindicatedthedivisionwasapprovedbythePlanningCommissionin1g60andrecordedon11/10/60.Theyarelegallotsofrecord.Amotionwascalledfor.CharlieBassettmadeamotiontoapprove.AsecondwasmadebyLewisAgee.Allapproved.L ZBA04-23AshleyMcGinnisrequestfora15footfrontsetbackvarianceat305LibertyStreetforaporchaddition.ChairmanFogartyaskedMr.McGinnistocomeforwardandpresenthiscase.MrMcGinnisstatedheandhiswifewerecurrentlylivinginCoralGables.Florida.TheyplantomovehereandwanttogivethefrontofthehousemoreofaFairhopecottagelook.Thepreviousownerplacedtheexistingpergolaoverthefrontoftheresidence.HeshowedtheBoardmembersdrawingsofthefinishedelevationsheisproposing.Thebedroomwingexistingalreadyjutsoutfivefeetbeyondtheproposedporchareahewantstoadd.CharlieBassettaskedErikifthiswasaconformingR-2lot?Erikindicatedthattohisknowledgeitis.Whywasthepergolaaddedtothefront?Erikansweredthepreviousownerwantedtoaddaporchacrossthefront:butitwasn’tallowedbecauseofthesetbackintrusion.Mr.BassettaskedifshebuiltthepergolabecauseshechosenottogototheBoard?Yes,shedid.Mr.ClarkaskedifthepreviousownerhadcometotheBoardifshewouldhavehadthesameopportunitytobuildherporch.Erikansweredthatshedefinitelyhadthatoptionandchosenottopursueit.Mr.Mannichindicatedthatlookingattheplotplanprovided,theresidencealreadyencroachesfurtherintothesetbackthanthenewporchaddition.Allowingtheporchexpansionwouldnotcreateanewfrontsetbackprecedent.Hedidn’tseeaproblemaslongasitwasn’tclosedin.QuestionswereaskedofMontyFox,whoisthebuilderforMr.McGinnis.Mr.Foxindicatedthenewporchwillbe24feetlongrunningunderthetwofrontwindows.Theexistingstepswouldberemoved.Theywon’taccessfromthefrontoftheporch.ChairmanFogartyopenedthePublicHearing.PaulRabinof303LibertystatedthathehadcomeinsupportofMr.McGinnisplan.Theywouldbepleasedtoseetheaddition.HalNormandof304Libertyhaslookedattheplansandtotallysupportstheaddition.ThePublichearingwasclosed.Erikwasaskedforhiscomments.ErikstatedthatheandMr.McGinnishadseveralconversationsregardingthisproject.Staffhastolookatitregardinghardshipsfortheproperty.Itisaconforminglot,thestructureisnot.Italreadyextendsintotherequiredsetback.Andhehastorespectfullydenyapproval.Mr.Ageestatedweareconstantlyraisingissuesofwhathasbeendonebefore.Weneedtolookateachcasebasedonitsownmerit.Allowingtheextensionontheporchwouldnotcreateanewalignmentpointforfutureresidences.Theywouldalignwiththewing,nottheporch:Amotionwascalledfor.RayClarkmadeamotiontoapprovetheadditionsubjecttoitremaininganopenporch,notanenclosedspace,withtheexceptionofscreening.Eriksuggestedtheownermakethisanadditionalclauseinthedeedsofuturebuyerswouldbeawareoftherestrictions.AmotionwasmadetosecondMr.Clark’smotionbyCharlieBassett.Allapproved.Astherewasnooldornewbusinesstodiscuss,ChairmanFogartyrequestedamotiontoadjourn.LewisAgeesomotioned.AsecondbyBobMannich.Meetingadjournedat5:40PML
