TheCityofFairhopeBoardofAdjustmentsandAppealsmetonTuesday,January20,2004at5:00PMintheCityAdministrationBmlding,I61N.SectionStreet.MembersPresent:CharlieBassett,ViceChairman;LewisAgee;RayClark:BeckyLundberg;ErikCortinas,CBOandBrendaHoffren,Secretary;Absent:BernieFogarty,ChairmanandBobMannich.Vice-ChairmanBassettcalledtheproceedingstoorderat5:00PM.Mr.BassettannouncedthatCase#ZBA04-01regardingaspecialexceptionforachurchonthecornerofGreenoandGayferhadbeenwithdrawn.Anyonepresentforthoseproceedingcouldleaveiftheywished.TheminutesoftheDecember,2003meetingwereconsidered.ArequestforacoupleofminorchangesftomCharlieBassettandRayClarkwerenoted.MotioncalledfortoacceptbyCharlieBassett.RayClarkmadeamotiontoacceptwithasecondbyLewisAgee.Allapproved.ZBA04-01PublicHearingforaSpecialExceptiontobuildachurchoilthevacantpropertylocatedontheSWcornerofGayferaiiclGreenoRoadsubmittedbyDr.JimStrickhausen.ThissubmittalwaswithdrawnbythepropertyowneronFriday,January16,2004.(Letterofuithdraiia!incasefile,)ZBA04-02PublicHearingfora3’frontyardvarianceforlot17,220Spring[SakeDrive,attherequestofAdamsHomes,LLC.JackPruittandDannyPierce,generalmanager,6475SpanishFortBlvd.,SpanishFortcameforwardtorepresentAdamsHomes,LLC..lackstatedtheshapeofthelotwastoosmalltoplaceahouseon.Mr.Piercesaidtheirsubdivisionrestrictionsrequireaminimumsquarefootageof1400squarefeet.Allofthehousesinthesubdivisionareonestory.Theonlyalternateplantheyhavetofitonthislotisatwostory.Itwouldnotfitinwiththerestoftheneighborhood.Mr.Bassettopenedthepublichearing.IdaConnellyof213SpringLakeDrivelivesacrossthestreetfromthislot.Shestatedsherepresentsthepropertyownerswithinherneighborhoodandtheyfeelthereisnoroomtoplaceahouseonthislot.Theyweretoldthislotwouldbesetasideascommonareatobeusedbytheneighborhoodandwouldnotbebuilton.AhouseonthisJotwilldetractfromtheneighborhood;thereisnoroomforadriveway.Carswillhavetobeparkedonthestreetandthatisagainstrestrictions.Theydontwantahousebuiltonthislot.DannyPierceaskedtorespondtohercomments.TheareaMrs.Connellyisreferringtoisthecommonareaadjacenttolot17.Thecommonareaisthe onesetaside.Lot17isaplattedlotofrecordandnopromisesweremadeinregardtobuildingonit.Adamsdoesn’twanttobuildatwostoryonthislot.Thereisplentyofroomforadrivewaywiththeextrafootageatthefront.Inlookingattheplotplansubmitted,youcanseethatthisisthewidestanddeepestportionofthelot.Twocarswillfitinthisareaendtoendwithoutbeinginthestreet.RayClarkaskedwhathewascallingextrapropertyatthefront.Mr.PierceindicatedtheportionoftheROWlocatedatthefrontwherethedrivewaycomesinisexcessofwherethepropertystakesarc.Mr.Piercesaidanotheralternativewouldbeavarianceontherearofthepropertytoallowthemtobuildwithin12’oftherearpropertylineinsteadofthe15’required.Thenthefrontsetbackwouldnotaffectthestreetfrontage.Mrs.ConnellysaidtheneighborswouldhavenoobjectionifAdamsiswillingtoaskforavarianceontherearinsteadofthefront.Publichearingwasclosed.CharlieBassettaskedMr.Bakeraboutthenoticerequiredtochangethevariancerequest.Howdoesthisaffectthepropertyownertotherearwhowasnotifiedaboutafrontvariance?Mr.Bakerstatedthatthisisaperplexingproblemforcaselaw.Somestatethatre-advertisingisrequiredtonotifyofthechangeinrequest.Othersstatethatnotificationwasgiventoallpropertyownersandtheyweregivenachancetoattend.TheBoardisgrantedwidelatitudeandoncethehearingisheldtheymaygrantwhatevervarianceisrequired.EriksaidthatadditionalstepsfornoticewouldbeoutsidetherequirementsforBoardofAdjustmentssubmittals.ErikreadhisrecommendationinresponsetotherequeststatingthatthelotmeetsallrequirementsforR3pghlots.Thisisaselfimposedhardshipandnothingforcestheneedforavarianceexceptthedesiretobuildalargersquarefootagehousethanthelotwillhold.Recommendationfordenial.Mr.Bassettcalledforamotion.Mr.Ageemadeamotiontodenytherequest.RayClarkSecond.Allapprovedfordenial.ZBA04-03PublichearingtoconsidertherequestofChristopherandRuthanneWelchfora7’rearyardvarianceat117AshleyDrive.Mr.Bassettexplainedthatthepublichearingwasgoingtobeopenedforthiscase,butnodecisioncouldbemadetonight.BoardmemberBeckyLundbergisaneighbortotheWelch’sandmustabstainfromvoting.Wehavethreeabsenteestonight.Fourmembersmustvoteforadecision.Thehearingwillbeheldasadvertised,butwillbetableduntiltheFebruarymeetingforavote.Thepublichearingwasopened.Mr.Welchsaidtheirhomewasbuiltinthe1970s.Thei-earvai-datthattimewasoppositeAshleyinsteadofKurlane.Thehousesits28’fromthepropertylinetheyconsideredtheirsideyard.Theywanttoaddaroominthisareafortheirphysicallyhandicappedson.Thisadditionwillmakeiteasierforhimtomaneuverinthehouse.Mr.Bassettcalledforcommentsfromanyonepresent.Therewerenone.Thehearingwasclosed.Erikreadhiscommentsstatingthattherewasalowpotentialforadverseimpacttotheneighborhoodforthisaddition.PlacingtheadditionL2 elsewherewouldrequiretheremovalofsometrees.Assuch,thebuildingdepartmenthasnoobjection.Mr.Bassettcalledforamotiontotable.RayClarkmadeamotiontotableuntilnextmeeting.LouisAgeesecond.Allapproved.ZBA04-04PublichearingtoconsidertherequestofTerryandJanHikerforadetachedaccessoryintheminimumexteriorfroiitsetbacklocatedat355EquityStreet.DougWard,contractorandTerryF-lilyer,owneroftheproperty,explainedthatthelothasnoactualstreetfrontage.ItisaccessedbyaprivatelaneoffEquityStreet.Whensubmittingtheplansforreview,setbackswereestablishedfortheresidencewiththefrontbeingtheNorthportionoftheproperty.TheHilyersdecidedtoacidaseparatedetachedgarage.Thisistheonlylocationitcanbeplacedduetothetopographyandhouseplacement.Mr.Bassettopenedthepublichearingforcomments.Therewerenone.Thepublichearingwasclosed.Erikwasaskedforhiscomments.Heexplainedthathehadbeenouttolookatthesite.Ithasnotruefrontageuponastreet.Baseduponhisobservationandthesurroundingvegetativebuffer,thebuildingdepartmenthasnoobjectiontothevariancebeinggranted.Mr.BassettaskedhowclosetotheNorthlinethiswillplacethegarage?Mr.Wardstateditwouldbeapproximately15’.Amotionwascalledfor.LouisAgeestateditdidnotappeartohaveanimpactonneighboringpropertiesandmadeamotiontoapprove.RayClarkmadeasecond.Motioncarriedunanimously.ZC04-05Publichearingtoconsideraspecialexceptionforadetachedguesthouselocatedat8825MorphyAvenueforRobertandStephanieHerron.RobertHerronexplainedtheirneedforlivingquartersforMrs.Herron’sparents.Theexistinghouseisbuiltinsuchawaythataddingontoiiwoulddistortthelayoutofthehouse.Theyhaveapoolattheendoftheresidence.Theywouldliketoconstructa1200squarefootsuiteforherparents.Mr.Bassettopenedthepublichearingforcomments.Therewerenone.Thehearingwasclosed.Erikwasaskedforhiscomments.Hestatedthatpreviouspermitsrequestedformother—in-lawsuitesinresidentialareashavemostlycomefromareaswherehomesareiiiclosel)roXiiflitYandthereisagreaterchanceofcreatingproblemsinclenselpopulatedareas.Thel-lerron’shaveaR-Aparcelwhichcontains5acres,whichmakesitdifferentfromtheintentionofaddedrequirementsforaccessorystructuresasitcreatesnodensityproblems.Thetopographyofthelotalongwiththeshapeofthehouseandtreescreatesauniquecharacteristicforthelot.Thismakestheendofthepoolareathebestlocation.Thebuildingdepartmenthasnoobjectiontotheconstructionasproposed.3 AmotionwascalledforbyMr.Bassett.LouisAgeecommentedtheutilitiesshouldremainunderthesamemeters.RayClarkmadeamotiontoapprove.AsecondwasmadebyLouisAgee.Allapproved.ZBAO4-06PublichearingtoconsidertherequestofJaneFingerfora10’sideardvarianceforthepropertylocatedat206FeIsAvenue.JaneFinger,owneroftheproperly,statedthatshehadherbuildercheckonsetbackswiththebuildingdepartmentfordeckswhenshewasdesigningthehouse.LippincottBuilderstoldheradeckcouldgoallthewaytotheproperlyline.But,shehasfoundoutthatthisisabalconyonthesecondfloorandnotadeck.Shefeelsabalconyherewouldmaintainmoreprivacyforherselfandneighboringpropertiesasitisplacedwherethemostprivacyismaintainedforeachpropertyowner.PicturesareinBOAJule.Ifitisplacedinthebackoftheresidence,itistoofarawayfromthekitchenareaanditwouldoverlookneighborspatio.Accesswouldalsohavetogothroughherbedroom.Mr.Bassettopenedthepublichearing.CorrineRammingof200Felscommentedthatsheownsthepropertytwodoorsdownandshefeltitwasnotdetrimentaltotheneighborhood.Shefeltitshouldbeapproved.Astherewerenoadditionalcomments,thepublichearingwasclosed.Erikwasaskedforhiscomments.TherearenoinherentcharacteristicsofthelotwhichrequirethisvarianceotherthanMs.Fingersdesiretobuildoutsideoftheguidelines.Adeckindicatesanopenareaatgroundlevel.Theproposeddeckistwostories,whichcreatesacoveringforthelowerdeckandmakesthelowerdeckaporchandtheupperareaabalcony.Thiswouldtakethebuildingfootprintallthewaytothepropertylineinsteadoftherequired10.Setbacksaretakenfromtheverticalsupportpoststothepropertyline.Ms.Fingerhasnearly23’ofadditionaldepthintherearoftheresidencetoutilizeinordertomeettherequirementsoftheordinanceforherbalcony.Eventhoughneighboringpropertyownershavenoproblemwiththeconstruction,thereisapotentialforproblemsinthefuture.Thebuildingdepartmentwouldliketoseeherplaceitthere.Assuch,thebuildingdepartmentstronglyrecommendsdenialoftheapplicationaspresented.Mr.Ageequestionedifshewasaskingfora0sideyardsetback.Erikindicatedthatshewas.CharlieBassettaskedifawalkwaytothebalconyontherearwasanoption.Possiblygrantingavarianceforanaccesswalkwayof2-3feetinwidthwouldhelp.Ms.Fingerindicatedthatshewouldliketohavethisoptioniftherequestedvariancewasn’tgranted.Mr.Ageequestionediftheywereallowedtograntanalternatetothevariancerequestedasitwasnotadvertised?Mr.BakersaidtheBoardhasthelatitudetograntavariancefor“lessthanwhatisadvertised”.Ms.Fingerbroughtacopyoftheconstructionplanstoshowtheboardmembersthelayoutofthehouseonthelot.Mr.Bassettcalledfora4
