explainthatconstructionplanswerebegunafterconsultingwiththeCityandaproposedsiteplanwasapproved.Basedonthistheywishtobeabletobuildtheproposedbuildingsusingthezoningrequirementsinplaceatthattime.Enclosedisasurveyofthefootprintoftheformerstructureshowingthepreviousbuildingcoveredapproximately45%ofthesitewithasinglebuilding.Theproposedsiteplanwillcoverapproximately40%withatotaloffourbuildings,sotheoveralllotcoveragewillbediminishedfromlheoriginalsite.TheprimaryconcernwehaveistheamountoftimelhathaselapsedsincetheinitialmeelingwiththeCityandthestatedapprovalofthesiteplanin1992.Inthe12yearssincethesediscussionstherehavebeennumerousamendmentsandrevisionstotheZoningOrdinanceandtwocompleteeditionsoflheStandardBuildingCodepublishedbytheSBCCIandadoptedbytheCity(1994and1997).WhileI’msurethattherewerecostsincurredtodesignthebuildingsin1992,theamountoftimeandregulatorychangesthathaveoccurredwillrequireacompletelynewsetofconstructionplanstomeetthecurrentbuildingandlifesafetycodesinanycase.Thereforeitstandstoreasonthatallcurrentcodesandstandardsshouldbemetbythedesign,includingZoninganddrainageandlandscapingstandards.Basedonthisinformationwefindthatthereisnothingthatcanbecalledahardshipassociatedwiththiscaseandwerecommenddenialoftheapplicationaspresented.IftheBoarddecidesthatthepublicinterestwillbeservedandsubstantialjusticedonebygrantingrelieffromtheZoningrequirements,wewouldrespectfullyrequestthatstipulationsbemadethatallcurrentbuilding,lifesafety,landscaping,anddrainagecodesandregulationsbemet.Wewouldfurtherrequestthatatimelimitbeplacedonthestartofconstructionsothatwewillnotbefacedwithasimilarsituationintheyearstocome.QuestionswereaskedofErikandMr.Niemeyerregardingsetbacksforaccessorystructures;abilitytobringthestructuresinlinewithsetbacks;Mr.Niemeyersaidthecarriagehouseisnotaproblem,butthemainstructurewillhavetoberedrawntocomply.Hewouldliketokeepthegaragesinplace.Theyareinlinewithsetbacks,buttheyputtheprojectoverthe30%limit.Hefeelsthe30%coverageistoolittleforaB3A.NeighboringR-2propertiesareallowed37%coverage.CliffDriveisaseldomtraveledrightofwaywithnobuildableareaononesideduetothegully.TheCrumpropertyat50FairhopeAvenuehas60-70%coveragealready.Othersarealsoinexcessof50%.Itisnotarequestoutoflinewiththeneighborhood.BobMannichstatedhehadlosthisnonconformingfootprintapprovalwhenthedemolitionexceededtheoneyearallowedtobuildback.Hefeelsthesetbacksneedtobeadheredto.Hemadeamotiontodenytheapplication.CharlieBassettsecondedthemotiontodeny.Allapprovedthemotionfordenial.Old/NewBusinessChristopherBakerremindedtheBoardthatvotingfornewofficerscomesupinOctober.AmotiontoadjournwasmadebyCharlieBassett.AsecondfollowedbyRayClark.Allapproved.Meetingadjournedat5:35PM.TheseminutesreflectchangesmadebytheBoardofAdjustmentsattheOctober20,2004totheminutesregardingColonialInn,LLCwhichwereadoptedatthe10/20/2004meetingoftheBoardofAdjustments&Appeals.ChangesweremadeasdirectedbySecretary,BrendaHoffren
