HomeMy WebLinkAboutMinutesTheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,September15,2003at5:00PMintheCityAdministrationBuilding,161N.SectionStreet.MembersPresent:BernieFogarty,Chairman;SusanCunningham,ViceChairman:BobMannich;CharlieBassett;LewisAgee;RayClark;ErikCortinas,CBOandBrendaHoffren.SecretaryChairmanFogartycalledtheproceedingstoorderat5:00PM.TheminutesoftheAugust25,2003SpecialMeetingwereconsideredandapprovedmotiontoacceptbyBobMannichandasecondbyLewisAgee.ZBA03-18RequestofRussellWalkerfora3’sideyardvariancetoconstructanadditionat208S.BayviewStreet.ChairmanFogartyopenedthePublichearingandaskedMr.Walkertopresenthiscasebeforetheboard.Mr.Walkerstatedtheirneedforadditionalspaceinanexistinghomewhichhadbelongedtohisfather.Thehousealreadysitsapproximatelyseven(7)feetofftheNorthpropertyline.Thesmalladditionwillfollowthisline.Theplumbingforthewaterandsewerarealreadylocatedonthisside.Therooflinewillbeeasiertoextendfromthislocation.Neighborstothissidehavebeenconsultedandtheydon’tfeelthereisaproblemwithhisrequest.CommentswererequestedfromthepublicbyChairmanFogarty.Therewerenone.ThePublichearingwasclosedandstaffcommentswererequested.ErikCortinassaidtherearenoissuesconcerningfireseparation;allproposedconstructionwiththeexceptionofthesmalladditionmeetsrequiredsetbacks.Itshouldhaveminimalimpactontheadjacentproperty.Herecommendedapproval.AmotionwasrequestedbytheChairman.RayClarkmadeamotionforapprovalaspresented.CharlieBassettseconded.Themotionpassedunanimously.ZBA03-19RequestofDr.JosephGravleefora5’heightvarianceat411N.SectionStreet.ChairmanFogartyopenedthePublichearingandaskedDr.Gravleetocomeforwardtopresenthiscase.Dr.Gravleeandhisagent.AndyBurrellofGouldTurnerofBirminghamcameforwardwithapreliminarydrawingshowingtheproposedelevationofthebuilding.Mr.Burrellindicatedthattheyplannedtodigdownintherearforthefoundationtherebyloweringthefrontfaçadesotheadditionalheightwouldnotbeasnoticeable.Heshowedacomparisonoftheallowed35’andthe40’required.Themedicalequipmentforthesurgerycenterproposedrequiresgreaterheight.ChairmanFogartyaskedforcommentsfromthepublic.JoeBoykin,whoowns406&408CircleDrivetotherearofGravlee’sproperty,cametothepodiumtospeak.Hequestionedhowclosetheycouldcometotherearpropertyline.Andwilltheyhavetoputupafence?Whatwillbedoneaboutdrainage?ChairmanFogartyaskedEriktocommentwithregardtoMr.Boykin’sconcerns.ErikconsultedwithChristopherBaker,PlanningDirector,regardingI thebufferrequiredforscreeningincompatibleuses.Aten-footwidebufferalongthecommonpropertyline(providingasolid,unbrokenscreenof6’feetinheightatinstallation)isrequired.Thisincludesfencing.ErikassuredMr.Boykinthatdrainagecalculationswillberequiredwhensubmittalsarepresentedforabuildingpermit.Mr.Burrellstatedtheyareawaretheycannotplaceadditionalwaterontoadjacentproperties.Withregardtofencing,AndyBurrellindicatedthata6’fenceisnowinplaceattherearoftheproperty.Mr.Boykinsuggestedthatitshouldbe8’.BobMannichaskedaboutlightingintherearforsecuritypurposes.Mr.Burrellsaidtheyareusing“0”(zero)backdroplighting.ItwillfocusthelightsawayfromadjacentpropertiesandontoDr.Gravlee’sbuilding.Astherewerenoadditionalcomments,thePublicHearingwasclosed.Erikwasaskedforhisreport.Heindicatedthatmedicalusesoftenrequireadditionalheighttoaccommodatetheequipmentassociatedwiththebusinessandthatvarianceshadbeengiveninthepastforothersimilarbusinesses.Inaddition,thisissuehadbeenaddressedatthepreviousPlanningCommissionmeetingduringaninformalreviewoftheproperty,andthePlanningCommissionhadgivenunanimoussupportforaheightadjustmentforthebuildingbuthadbeenreferredtotheZBAforaformalruling.Withthatbeingsaid,Erikrecommendedapprovaloftherequest.TheChairmanrequestedamotion.BobMannichmadeamotionforapprovalaspresented.LouisAgeeseconded,andthemotionpassedunanimously.Innew!oldbusinessitwasstatedthatthiswouldbeSusanCunningham’slastmeetingasamemberoftheBoard.ChairmanFogartyandMr.BakerexpressedthankstoheronbehalfoftheCityforheryearsofserviceontheBoard.Itwasalsodecidedthatnominationsfor2004BoardOfficerswouldbeheldoverforthenextmeeting,andthetermsofthememberswouldbeclarifiedbeforethattime.Therebeingnofurtherbusiness,CharlieBassettmadeamotiontoadjourn.SecondbyRayClark.Themeetingwasadjournedat5:25PM2
