HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,March17,2003at5:00PMattheCityAdministrationBuilding,161N.SectionStreetPresent:BernieFogarty,Chairman;BobMannich,CharlieBassett,SusanCunningham,LouisAgee,ChristopherBaker,DirectorofPlanning&Zoning,ErikCortinas,BettyRivenbark,SecretaryTheminutesoftheFebruary17,2003meetingwereconsideredanddulyapprovedonmotionbyBobMannich,2’bySusanCunninghamandunanimouslycarried.ZBAO3-04PublichearingonAdministrativeAppealofSteveandAvaIngersollforpropertylocatedat358S.SummitStreet.Mr.Ingersolladdressedtheboardsayinghehadbeenatthispropertysince1986andthecitymapof1961hasitplattedastwolotsandintheprocessofsellingtheyfoundthatonthetaxmapitisshownasonelot.Thatthebuyerswouldlikeitshownonthemapastwolots,thatthesizeofthelotsarethesameastheonesintheneighborhood.ErikCortinasreadthestaffrecommendationwhichwastoapproveastheboardhasthepowertorecognizethedivisionofthepropertyintotwo66’lots,asshownonboththesurveyofthepropertyandthecitymapof1961.WealsohaveasurveybyMooreEngineeringshowingtwolots.Thiswasprobablynotproperlyrecorded.ThepublichearingwasclosedandinboarddiscussionBobMannichsaidthatthereisnoreasonnottoconsiderthisastwolots.CharlieBassettmovedinfavorofappealofMr.Ingersollandshowastwolotswithprovisionitberecordedassuch.SusanCunningham2’themotionanditcarriedunanimously.ZBAO3-03PublichearingrequestofRonaldKemptonforaspecialexceptionuseforthepropertyat352GrandAvenuetoallowabedandbreakfast.Mr.Kemptonspokesayingheisrequestingtohavealowkeyguestcottagelocatedintherearofthehouse6feetoffofmainlivingarea.Hesaidheandhiswifehavetwokids,thattheguestareatheywoulduseis250sqftwithaqueensizebedandbath.ThatheonlyanticipatesonevehicleandthatheisonlytwohousesawayfromSectionStreet.WilliamBradfordof350GrandAvenuespokesayingthathedidnotknowofwhatplanneduntilhereceivedletterinthemail,helivesnextdoortoMr.Kemptonandthatuponinvestigationhesawbackyardwithhugepatioandhugeconcretetable(heshowedpictureshehadtaken)andthatuponinvestigatinghefoundthiswasnotpermittedandsinceconstructionhehashadtremendousrunoffontohisproperty.Hesaidthat“lowkey”tablewillseatatleast20peopleandwastoldthiswasforpersonalusewhenheinquiredaboutconstruction.RickCunningham,neighboronoppositeside,alsospokesayinghewasfrustratedthatatleast85%ofbackyardnowconcrete.Thathehaslivedthereover20yearsandithasbeenresidentialarea,thatheisincloseproximitytothepropertylineandhewoulddeemthisrequestascommercialuseandthiswoulddowngradetheneighborhoodoropenthedoorforothercommercialusescreepingin..Hesaidhehashealth,safety,parking,andpropertyvalueissueswithwhatplanned.Thatheisadamantlyagainst.Ashowofhandswasaskedforand20peoplesaidtheywereagainstwhatplanned.VinceValentimandPaulMoselyspokecitingwhat AdjustmentBoardMarch17,2003-pagetwohappeneddownatGravelee’sonnorthMobileStandJoeBirendellispokesayingaprecedentmightbeset(thisisnotso,eachcasestandsonitsown).Mr.Kemptonspokesayingthiswaslikeasecretgarden.Hesaidheisnotabuilderbutanartist,adreamer.Hestartedoutsmallandkeptaddingtothebackandthencameupwiththeideaoftryingtodefraythecostoftheconstructionwiththebedandbreakfast,hedidnotmeantoupsethisneighbors.ThepublichearingwasclosedandPlanningDepartmentrecommendationwasgiven,whichwastodenybasedonneighborhoodresponseagainstwhatplannedandseveralviolationsrelatingtohomebusinessesasstatedinthezoningordinance.BobMannichmovedtodenyspecialexceptionuserequest.SusanCunningham2’themotionanditcarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
