WebLinkAboutMinutesTheFairhopeBoardofAdjustments&AppealsmetMonday,June16,2003attheCityAdministrationBuilding,161N.SectionStreetat5:00PMPresent:BernieFogarty,Chairman;RayClark,LouisAgeeErikCortinasBuildingInspectorandBettyRivenbark,SecretaryAbsent:BobMannich,CharlieBassett,SusanCunningham.TheminutesoftheMay19,2003meetingweredulyconsideredandapprovedaspresented.ZBAO3.08Publichearingon2’rearyardsetbackvariancerequestofWeezieandJasonPhillipsat108AtkinsonLaneMr.FogartyopenedthemeetingandinvitedMs.Phillipstotelltheboardwhatsheisproposing.Shetoldtheboardthattheywouldliketoaddanadditiontothesideandneedanadditional2’attherearoftheresidencetoprovideafootingforthetotaladdition.Thiswouldbringthemto25.5oftherearpropertylineanditwasnotedallothersetbacksassociatedwithboththeexistingbuildingfootprintandproposedadditioneithermeetthesetbackrequirementsorarepreexistingandwillnotbealtered.ShefurtherstatedthattomakeanychangewouldrequirethemtoseekavariancebecauseeventhoughtheyareinanR-2zonethatmanyofthehousesinthisneighborhooddonotmeetR-2requirementsastheirlotssimplyarenotbigenoughandwereexistingbeforezoningestablished.Mr.Fogartycalledforanyoneintheaudiencewhowishedtospeakfor/againstthisrequestandMs.EraNorwoodof111AtkinsonspokesayingthatanythingdonebyMs.Phillipswouldonlyimprovetheneighbàrhood,shewasforwhatproposed.ItwasalsonotedthattheLoudermilchshadcalledandsaidtheyhadnoobjectiontowhatproposedandMrs.Hamilton,aneighbortotheeast,objectedtochange.Thepublichearingwasclosedandthememberswereaskediftheyhadanyquestionsorcomments.Therewerenone.Mr.Cortinaswasaskedtogivethestaffrecommendationandsaidthestrictapplicationofthehardshipclausewouldprecludethevariancefrombeinggrantedasthisisaself-imposedhardship.Hesaidthereareadditionalconsiderationsthatcouldbetakenintoaccountinmakingadecision.Onebeingthattheexistingfootprintis27.5’fromtherearpropertylineandwasconstructedpriortotheareabeingzonedwiththeneteffectbeingvariancewouldbe2’intrusionpasttheexistingfootprint.Second,R-2requires10,500sqft.andtheoveralllotsizeis6510squarefeetbutrequiredfrontageof75’ismet.Thisisbecausethelotlacksdepthinproportiontothewidth,whichlimitstheapplicant’sabilitytomeettherequiredfront/rearsetbackrequirements.Mr.FogartycalledforavoteandMr.Ageesaidduetofactonlyonenotedoppositionandnooneelseinneighborhoodobjected,hemovedtograntvarianceasrequested.RayClark2ndmotionanditcarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjournedat5:15PM TheFairhopeBoardofAdjustments&AppealsmetMonday,May19,2003at5:00PMattheCityAdministrationBuilding,161N.SectionStreetintheCouncilChambersPresent:SusanCunningham,Vice-Chairman;CharlieBassett,LouisAgee,BobMannich,RayClark,BettyRivenbark,Secretary.Absent:BernieFogartyTheminutesoftheApril21,2003meetingwereconsideredandapprovedaswrittenonmotionbyCharlieBassett,2byRayClarkandunanimouslycarried.CaseZBAO3-06PublichearingtoconsidertherequestofDyasDevelopment,LLCforpermissiontoplaceatemporarybuildingforoperationasabankduringconstructionofapermanentbuildingatthenortheastcornerofGreenoRdandEdwardsAvenue.MrDyaswaspresentrepresentingthebank.Mr.CortinassaidthattheplacementofatemporarybuildingisundefinedintheZoningOrdinanceandtheboardhastheauthoritytoeitherallowordisallow.Hesaidfurtherhistoricallythecityhasnotallowedtheuseoftemporarystructuresduringconstruction,thecaseoftheMethodistchurchwastwo-fold:thatchurchisnotconsideredabusiness,andtheywereactuallydisplacedduringconstruction,thereseemstobenoreasontodosonow.Hecitedproblemsassociatedwithsiteaccessascustomerandcontractorparking,materialstorage,aswellasthegeneralsafetyconcernsinvolvedwithcustomersbeingallowedonaconstructionsite.LouisAgeeaskedMr.Dyashowlongheanticipatesneedforstructure.Mr.Dyasrespondedpossibly6-8months.RayClarksaidhewasaretiredbankerandaskedwhatprovisionwouldbemadeforsecurity.Craigsaidhedidnotknow,ChristopherBakerwasaskedaboutlandscaperequirementsandhesaidifapprovedthattheywouldhavetoadheretothem.FurtherdiscussionledtoamotionbyRayClarktodenytemporarystructureforcommercialpurpose,BobMannich2themotionanditcarriedunanimously.CaseZBAO3-07PublichearingtoconsidertherequestofBarryTuvesonfora5’frontyardsetbackvarianceat366SSchoolStreet.Mr.Tuvesonspokeonhisbehalfsayingthattheypurchasedthislotandisplanningtobuildahousebuttheywishtosavealargeoaktreeintheyardanditwouldmeantheywouldhavetomovethehouse5ft.forward(35’to30’)inthefrontyard.Hesaidthefrontofhishousewillalignwiththecornerlotonthesidesotherewillnotbearowofunevenhouses.BobMannichsaidhehadbeenbythelotandaskedifthetreesinthefrontwouldstay.Mr.Tuvesonsaidsomeofthemwouldhavetoberemovedbuthewillsaveasmanyashecan.ErikCortinasreadtherecommendationfrom hisofficesayingthatitisinthepublicinteresttopreservetreeswherewecanandthispositionhasbeentakenwithsimilarrequestsinthepast.Further,thata5’frontyardsetbackvariancerequestisminimalinregardstotheoverallpropertyandthiswouldnotharmthecharacteroftheneighborhood.Therehadbeennocallsormailreceivedaboutthiscase.LouisAgeemovedtoapprovevarianceasrequested.BobMannich2ndthemotionanditcarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
