HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,July21,2003at5:00PMattheCityAdministrationBuilding,161N.SectionStreet.Present:SusanCunningham,ViceChairman,CharlesBassett,BobManning,RayClark,LouisAgee.ChristopherBaker,DirectorofPlanning&Zoning,BettyRivenbark,SecretaryTheminutesoftheJune16,2003meetingweredulyconsideredandapprovedonmotionbyRayClark,2byCharlesBassettandunanimouslycarried.Mr.BakeraskedifhecouldbeheardoftheapplicationofMsMarciaCoatesonanadministrativeappealfor211FigStreetourcaseZBAO3-10.HesaidsincethetimeoftheapplicationandadvertisingoftherequestanamendmenttotheZoningOrdinancedated12/97hasbeenfoundthatprovidesthefollowingdefinition:Yardminimumexterior:Thatspaceremainingbetweentheminimumrequiredsetbacklineandthepropertylineforaparticularfront,rear,interiorsideorstreetsideyard.Thesurveyonthispropertyshowstheresidenceislocated49.7’behindtherequired35frontsetbackline.BasedonthisinformationifMs.Coatessubmitsanapplicationforanattachedordetachedgarageorcarport,andthestructureisbehindthe35’setbackline,thenshehasalegalrighttoabuildingpermit.Heaskedtheboardtoaffirmhisaction.ACharlesMooreheadspokesayinghehadsubmittedpicturesandalettersignedbyseveralresidentsagainstthissayingthistypeofstructuredrovepropertyvaluedown.BobMannichmovedtoacceptthisinterpretationofMr.Baker,LouisAgee2ndandmotioncarriedunanimously.ZBA03-11LesandCaroleKing22’rearyardsetbackvariance,407BooneLane.Mr.BakersaidtheKingsowntheR2zonedpropertyatthisaddressandarewishingtobuildanattachedcarportonthenorth-eastcorneroftheproperty.Hesaidfurtherunderstrictinterpretationofthelawthisshouldbeadetachedcarportbutwouldrequirethecuttingdownofseveraloaktreesontheproperty.Alsotherearedocumentedproblemswithstormwaterdrainageontheadjacentpropertyandtherehasbeenbuiltadirtembankmentwhichdivertswaterfromtheirpropertytotheirneighborsthatwouldhavetobedisturbedtobuildadetachedgarage.Recommendationwastoapproverequest.MrandMrs.Kingspokesayingtheywishedtoputarooffromtheirnewadditionoverthecarport.Andtheysaidtheywouldhavetoremovethetreesanddisturbtheembankment.Thepublichearingwasheldandnocommentsfor/againstwererecorded.RayClarkmovedtoapprovevarianceasrequested.BobMannich2ndthemotionanditcarriedunanimously. ZBAO3-12G.H.K.Development,lnc(dbaWaigreen’s)foradditionalsignageat2SouthGreenoRd.Mr.Bakersaidtheyarerequestingtoinstalla9.2’X6.25’electronicsignona12’singlepylonsignontheNEcornerofthepropertyalongGreenoRd.TheadditionofthesignagewillexceedtheallowablesignagepertheCityZoningOrdinance.Hesaidthisisaself-imposedhardshipasthereisnoinherentcharacteristicofthepropertythatforcestheneedforthevariance.Basedonthesefactorsandpastenforcementoftheordinancedenialwasrecommended.RoyRobinsonofVictorSignCo.spokesayinghewasonewhofilledoutapplicationandthatWalgreensfeelsitfitsthecorporateimageofothermunicipalities.Hesaiditwouldbealaborsavingsnottohavetheemployeeshavetogooutandchangethesign.ChristopherBakerreadtheportionoftheordinancethatpertainstothis.Mr.Robinsonwasaskedwheretheyplantoputitandheexplained.BobMannichsaidwehavebeenstrictaboutthisinthepastandnotallowedbiggerthanallowedsigns.Thepublichearingwasheld,twoneighborsspokesayingthattheyhavebeengoodneighborsbutagainstmoresigns.FurtherdiscussionledtoamotionbyLouisAgeebasedonpastcaseshemovedtodenyadministrativeappeal.CharlieBassett2’themotionanditcarriedunanimously.ZBAO3-09MarthaWatkinsvariancerequest357SatsumaStreetforrear,sideanddrivewaysidesetback.Mrs.WatkinswasnotpresentbutMr.BakersaidthatwecouldholdthepublichearingandgetinputthatMs.Watkinsplanstobuildanewsinglefamilyresidenceat357SatsumaStonherR2property.Thatthereisanexistingresidenceontherearthatwillbetorndown.Thatthisisapieshapedlotwith52’streetfrontageandtapersdownto36’attherear.Thereisalsoalargeoaktree30’fromthefrontpropertyline.Theproposalistomovetheresidencebackto40’(35’required)Thisshiftwillrequirea10’rearyardsetbackvariancewiththebuildingsittingapproximately25’fromtherearpropertyline(35’required).Thesideyardsetbackswillrequirea6.5’varianceontheeastsidewiththebuildingsitting3.5’fromtheline(10’required)anda6’drivewaysidesetbackvarianceonthewestsidewiththebuildingsitting9’fromthepropertyline(15’required).Mr.Bakersaidhehasconcernwithreducingthe15’drivewaysidesetbackreducedto9’ontheeastside.Ms.Watkinsproposestouseagraveldriveway(pervioussurface)insteadofconcretesoastonotaggravatedrainagefromherpropertytoothers.Hesaidtheboardshouldtakeintoaccounttheshapeofthelot,theimpact,ifany,totheneighboringproperties,andwhethersubstantialjusticeisdoneingrantingthesevariancerequests.ThepublichearingwasheldandAnnaEtheridgeof355SatsumaandDianeOwenof359SatsumaStspokeagainstherbuildingwithinthesidesetbacksallowed.CharlieBassettmovedtotablehervariancerequestsfor30daystogiveherachancetocomeandspeak.RayClark2rdthemotionanditcarriedunanimously. ZBAO3-13SpecialExceptionUserequestofRivieraUtilitiestoconstructanewelectricalsubstation(GenerallylocatedsouthofHwy104andeastofGreenoRdonAuburnproperty)DonBoonewaspresentrepresentingRivieraUtilities.Mr.BakersaidthisisRIpropertythatMr.BoonehasbeenbeforethePlanning&ZoningCommissionandgottentheirapproval.Herecommendedapproval.BonBoonespokesayingthattheyaretryingtoupgradetheirsubstationcapacity.Hewasaskedifthisisthesamesizeasthesubstationatthesouthendoftownandhesaidyes,BobMannichaskedifwehadawatertankplannedbythisandwastoldyes.Hewasaskedifthiswasforfutureuseandhesaidno,neededitnow.Thepublichearingwasheldandnoonespokefor/against.BobMannichaskedifitwouldrevertbacktoRIiftheyvacatepropertyandwastoldyes.HemovedtogranttheSpecialExceptionUse.LouisAgee2”’themotionanditcarriedunanimously.BAO3.14PublichearingonanAdministrativeAppealofMs.EllenWellerforherpropertyat150FreedomStreet.Mr.BakersaidthispropertyiszonedB3A-TouristResortLodgingandR2SingleFamilyResidential.Thepropertyisrecordedas2lotsofrecordandoneofthepropertylinesrunsrightthroughthemiddleofthehouse.Hesaidtheycouldapprovealterationofapropertylineifnoadditionallotsarecreatedandthezoningdistrictstandardsaremet.Ms.Wellerwantedtomovethepropertyline23’totheeastinordertogetthelineoutfromthemiddleofthehouse.However,thiswouldmeanthatLot7,whichalreadydoesnotmeetR2requirementswouldbereducedinsizeevenmore.HerecommendedtheR2lotbereducedinordertogetthepropertylineoütoftheexistinghouse.TheB3Alotstillevenwiththelargersqftmeetsalltherequirementstocreateanadditionallot.Thus,thepropertycannotbefurthersubdivided.SteveDunnamwaspresentrepresentingMs.McLendon.Hesaidalloftheselotsaresubstandard.HepresentedadrawingtotheboardcallingitplanBwhichsuggestedmovingtheline5ft.tothewest.Hesaidthispropertyisnoteligibleformoresubdivisionandthisdivisionwillnotaffectanyoneelse.ChristopherBakersaidlookingatitthatPlanBwouldmaketheR2lotmorefunctionallot.RayClarkaskediftheyareplanningonselling.SteveDunnamrepliedno.Thepublichearingwasheldandoneladyspokesayingshewasnotobjectionabletoareasonabledecision.CharlieBassettmovedtograntrequestforPlanB.RayClark2’themotionanditcarriedunanimously.SteveDunnammentionedtoboardthechangingofthenameofFairhopeTitleandSurveytoArnold&AssociatesinhonorofClaudeArnold.Theboardcongratulatedthemonthisventure.Therebeingnofurtherbusiness,meetingwasdulyadjournedat5:35PM.
