WebLinkAboutMinutesTheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,December15,2003at5:00PMintheCityAdministrationBuilding,161N.SectionStreet.MembersPresent:CharlieBassett,ViceChairman;LewisAgee;BobMannich;RayClark:ErikCortinas,CBOandBrendaHoffren,Secretary;Absent:BernieFogarty,ChairmanVice-ChairmanBassettcalledtheproceedingstoorderat5:00PM.TheminutesoftheNovember17,2003meetingwereconsidered.MotioncalledfortoacceptwithclarificationsaddedinregardtoCase#03-22byCharlieBassett.BobMannichmadeamotiontoacceptwithasecondbyLewisAgee.Allapproved.ZBA03-23PublicHearingtoconsidertherequestofGenevaBrownforavarianceat405N.Ingleside.Thiscasewasheldoverfromthepreviousmeetinginorderfortheownerandbuildingofficialtogettogetheroverachangeinherrequestforavariance.Mr.BassettaskedMrs.Browntocomeforwardandstateherrequest.ShestatedthatsheandMr.Cortinashadlookedatthesitesothatshemightbuildacarportinherrearyardinsteadofthefrontyard.Mr.BassettaskedErikforhiscomments.Erikrecappedthelasthearingstatingthattheoriginalrequestwouldintrudeintothefrontyardtoomuchtoallowavariance.Hehadsincemetwithherandlookedintothepossibilityofplacingitintherearyardwitharequestfora2’drivewaysidevariance.Shecurrentlyhas13’onthedrivewaysideinsteadoftherequired15’.Theyhadnotbeenabletodeterminetheexactlocationoftheseptictank,butgrantingherthevariancegivesheranoptionforthecarport.Oncethevarianceisgranted,shecanlookintothepossibilityoftyingontocitysewerorplacementofthecarportwhereitwon’taffecttheseptictankandfieldlines.Mr.Bassettopenedthepublichearingandaskedforcomments.Therewerenone.Thepublichearingwasclosedandamotionwasrequested.LewisAgeemadeamotiontoapprovea2’drivewaysidevariance.AsecondwasmadebyRayClark.Allapproved.Motioncarriedunanimously.ZBA03-27PublicHearingtoconsidertherequestofJamesHugginsat21OrangeAdministrativeAppealforaclarificationofthe50%ruleregardinghisproposedaccessorystructure.Mr.BassettcalledMr.HugginstopresenthiscasetotheBoard.Mr.Hugginsstatedthathehadpresentedplansforapermittobuildashedinhisrearyardtobeusedforhishobbies.Hewastoldthatitexceededthe50%ruleforaccessoriesastheaccessorywaslargerthanhisresidence.Heplanstoexpandhisexistingresidencelaterandatthattime,theaccessorywillbesmallerthanI theresidence.But,heneedsaplacetostorethingsandaplacetoworkonhishobbies,furnituremakingandstainedglass,etc.Thehouseistwostoryandcontainsmoresquarefootagethantheaccessoryheproposes,butthefootprintissmaller.Heisnowherenearthe37%lotcoverageashehasahugelot.Thebuildingwillonlyincreasethetotalcoverageofthelotby3%.Mr.Bassettopenedthepublichearingandcalledforcomments.MaryEmmaPottsof455S.MobileStreetcameforward.Sheaskedwhyhecouldn’tplacethebuildingclosertohisresidence,notwaybackonthelotnearthealley.Shefeltthatametalbuildingwasnotattractive.Therearevacantlotsacrossthealleyandpropertyownerswouldhavetolookatthebuilding.Saleofthelotswiththebuildingtherewouldbemoredifficult.Theyardisclutterednowandnotattractivetolookat.Whycan’theputhisdrivewayinonOrangeinsteadofthealley?ConnieBrandtof8BayBreezecameforwardstatingthathehasasmallshedonthepropertyalready.Hehastwolotsthatarenotbuilton.Sellingoffthoselotswilleventuallycreatemorebuildingclutter.Mr.Hugginsaskedtospeakinregardtotheirconcerns.Movingthebuildingwouldinterferewithhisplanstoexpandthehouse.Hehasalargeliveoakintherearyard.Placingtheaccessoryclosetothehousewouldcausehimtolosethetree.Heisnotbuildingatypicalmetalbuilding.Heisusinglapsidingontheexteriortomatchhishouse.Itwillhavewindowslikethehouse.ThegaragedoorswillfacetowardOrange,notthealleyway.Manyoftheitemsintherearyardnowwillgoinsidethebuilding.BobMannichaskediftherearegaragesplacedonthealleywaynow.Ms.Pottssaidno.Astherewerenoadditionalcomments,thepublichearingwasclosed.Mr.BassettaskedErikforhiscomments.Erikstatedtherequirementsforplacementofanaccessorybuilding.Tenfeetfromtheprimarystructure,fivefeetoffadjacentsidepropertylinesandfivefeetofftherearline.Theplacementofthebuildingisnotinquestion.Hedoesnothaveanycookingfacilitiesorashowerlocatedinthestructure.HeiswellwithinthesetbacksrequiredforhisbuildinginanR-2district.Thereasonforthismeetingisthequestionregardingthesizeofthebuilding.ArulingbytheBOAsaysanaccessorycannotexceed50%ofthemainstructure.Itdoesnotdifferentiatebetweensquarefootageandfootprint.Theviewofthebuildingisnotanissue.TheBoardisnotempoweredtoenforceaestheticsorpreservation.Mr.HugginshasadequatespaceforhisdrivewaytoenterfromOrange,howeverheisentitledtoaccessfromthealleywaytotherear.ThemajorquestionfortheBoardtoaddressiswhether50%inthiscaseisdeterminedbysquarefootageorfootprint.Withoutthisissueinquestion,Mr.Hugginswouldhave2 beenissuedapermitforthebuildingaspresented.RayClarksaidhewouldbeheldtoapproximately822squarefeetifdeterminedasfootprint.Mr.Bassettsaidhecoulddownsizethebuildingandnotberequiredtobeatthismeeting.Objectionsseemtobeprimarilyupontheappearance.Mr.BassettaskedMr.Hugginsifhewouldbewillingtoputupa6’privacyfencealongtheentirewidthofthealleywayandgatetheentrancetothealley?Mr.Hugginsagreedthathecoulddothis.BobMannichmadeamotiontoapprovethebuildingaspresentedcontingentontheinstallationofaminimum6’highprivacyfencespanningthealleyway.RayClarkseconded.Approvedunanimously.ZBA03-28PublicHearingtoconsidertherequestofPaulFontenotfora3’Westsideyardvarianceanda3’rearyardvarianceat252S.SectionStreet.Mr.BassettaskedMr.Fontenottocomeforwardtopresenthiscase.Hestatedthathehadpurchasedthehousenineyearsago.Thehousewasbuiltinthe1920’s.HisfamilyhasgrownandthehousecanonlyexpandtotheSouth.TheWestpropertylineisnowlocated7’fromthesideoftheresidence.Hewouldliketoexpandtheresidenceandstayinlinewiththeexistingfootprint.Theadditionwillincreaselotcoveragetoonly30%.HehasdiscussedtheadditionwithhisneighbortotheWestandhehasnoproblemwithhisplans.Mr.Bassettopenedthepublichearingandcalledforcommentsfromtheaudience.GeneFeenkerlivesat362GastonjusttotheWestoftheFontenotresidence.HestatedthathehaddiscussedtheplanswithMr.FontenotandhehadagreedtogutterthewaterontheWestsideawayfromhispropertyandthelocationoftheACunitswasnotgoingtobeaproblem.Hewasproudtoseenewgoodconstructionintheneighborhood.Astherewerenoadditionalcomments,thepublichearingwasclosed.BobMannichaskedifallhewasaskingforwas3’ontheWestsideaslookingattheplansthereseemedtobeanintrusionintotherearalso.Mr.Fontenotsaidthestructureattachedtotherearwasapottingshedforthegarden.Itcouldbedetachedifnecessary,buttheyardlooksmoreclutteredasaseparatestructure.CharlieBassettsaidthatexpansionofnonconformitiesisusuallyallowed,butalineneedstobedrawnsomewhere.Thepottingshedneedstobedetached.Mr.Ageeaskedifhewouldagreetodetachtheshed.Mr.Fontenotsaidyes,itwasjustapersonalfeelingaboutthelook.HewashappytogettheWestsidevariance.BobMannichmadeamotiontogranta3’variancefortheadditionontheWestsideoftheproperty.LewisAgeesecond.Allapproved.3
