HomeMy WebLinkAboutMinutesTheCityofFairhopeBoardofAdjustmentsandAppealsmetforaspecialmeetingonMonday,August25,2003at5:00PMintheDeichampsSuiteintheCityAdministrationBuilding,161N.SectionStreet.MembersPresent:BernieFogarty,Chairman;BobMannich;LewisAgee;RayClark:ErikCortinas,CBOandBrendaHoffren,Secretary.AbsentwereCharlieBassettandSusanCunningham.ChairmanFogartycalledtheproceedingstoorderat5:00PM.TheminutesoftheAugust18,2003regularmeetingminuteswereconsideredandapprovedwithamotionbyLewisAgeeandasecondbyBobMannich.ChairmanFogartyaskedthattheBoardconsidernominationsforofficerstobeplacedonthenextregularboardmeetingagendaonSeptember15,2003.CaseZBA03-16forJim&SuzetteLowreywasfirstontheagenda.TheLowreycasewasheldoverfromtheAugust18thmeetingtogiveMr.Lowreytimetocomeupwithanalternateplanforhiscarport.ChairmanFogartyopenedthePublichearing.Mr.LowreypresentedtwonewoptionswiththecarportattachedtotheFigStreetfrontage.PlanBwouldrequireafrontsetbackvariancefromtheFigStreetsideofapproximately18feet.PlanCwouldplacetheattachedcarportontheFigStreetfrontage,withintherequired35’frontsetback,butintrudingontheinteriorsidesetbackbyapproximately7.5’.Theexistinghouseisintrudingintothesetbackonthissidealreadybyapproximately5feet.Adiscussionfollowedregardingbuildingcoderequirementsforplacingastructurethisclosetothepropertylineanddrainageconcerns.Eriksubmittedthatthisisanopenstructureandassuchhasnorequirementforfireratingthisclosetotheline,butitmustremainopen.Gutteringtherunoffagainstthepropertylineshouldberequiredtotakethewaterawayfromtheadjacentpropertyowner.BobMannichstatedthatPlanBwasthesameastheLibertyStreetproposal.Itintrudestoomuchinthestreetfrontagerequired.HewouldratherseethePlanC.RayClarkaskedaboutthepavingontheLibertyStreetsideandifitwasgoingtoberemoved.Mr.Lowreyindicatedthatitwouldbeeventually.Astherewerenoadditionalcomments,ChairmanFogartycalledforamotion.BobMannichmadeamotiontoapprovePlanCwhichplacesthecarportontheFigStreetfrontageandrequiresa7.5’variance.SecondbyRayClark.Motionpassedunanimously.Case#ZBA03-17RequestofCraigDyasforaheightvarianceforlot18inTrentinoSubdivision.ChairmanFogartyopenedthePublicHearing.CraigDyasandBobChathamwerepresenttopresentthecase.CraigindicatedthatI theTrentinoPUDwasdesignedasaverticalelevationsubdivision.Itisanextremelytopographicalarea.TherewasanerrorintheoriginalPUDsubmittalstothePlanningCommissionwhichdidn’taddresstheheightissue.ThiswasbeingtakencareofwithasubmittaltobeplacedontheSeptember2,2003PlanningCommissionagenda.Inthemeantime,heneededavarianceforthisparticularlotsothebuildercouldobtainabuildingpermit.TherequesttothePlanningCommissionwillaskfora35’heightforresidencestobemeasuredasfollows:thebuildingheightofanystructurewithinthiszoningdistrict(theTrentinoPUD)shallnotexceed35feetasmeasuredfromthefinishedfirstfloorelevationtoapointmidwaybetweentheeaveandthehighestroofridge.ThisdefinitionisintheproposedamendmentgoingbeforethePlanningCommission.Mr.Dyasisaskingforavarianceforthishousebasedonthisheightandthismeasurement.Theproposedhousecurrentlymeasures38’asmeasuredunderthedefinitionintheamendingzoningordinance#1102datedJanuary22,2001:theverticaldistancemeasuredfromthenaturalelevationofthelotatthefrontofthebuildingtothehighestpointoftheroofIfapproved,theresidenceonlot18wouldberequiredthroughthebuildingpermittomeasure35’asdefinedbythefirstdefinitionabove.Thiswillbeaddressedattimeofpermitting.WaitingforPlanningCommissionapprovalwilldelaythisprojectuntilpossiblylateNovemberorlater,asitwillalsohavetobeadvertisedforPublicHearingbyCityCouncilforafinaldetermination.ChristopherBaker,PlanningDirector,spokewithregardtothePlanningCommissionsubmittals.HeindicatedthathehadspokentoalloftheCityCouncilmembersandnearlyallthePlanningCommissionmembers.Onlyonehashadanobjection.BobMannichsaidtheydidnotwanttojumpthegunonthePlanningCommission.ChristophersuggestedapprovingthevariancebasedonthePlanningCommissionsrecommendationtotheCityCouncil.BobChathamexplainedthedifficultyofdesigninghousestofitthecriteriafora30’houseusingthewayitismeasuredatpresent.HousesinTrentinoarerequiredunderrestrictivecovenantstohave12’ceilingsdownstairsand10’ceilingsupstairs.Addthistothetopographyofthisparticularsubdivisionandyoucanseethedifficultyinbuildingahouseunderthisrestriction.ChairmanFogartyclosedthePublicHearingandcalledforamotion.BobMannichmadeamotiontoapprovetherequestsubjecttoapprovalofMr.Dyas’ssubmittalstothePlanningCommissiononSeptember2,2003.SecondbyLewisAgee.Passedunanimously.Astherewasnofurtherbusiness,LewisAgeemadeamotiontoadjourn.SecondbyRayClark.Meetingwasadjournedat5:45PM.2
