HomeMy WebLinkAboutMinutesTheFairhopeBoardofAdjustments&AppealsmetMonday,September16,2002at5:00PMattheCityMunicipalComplex,161N.SectionStreetintheCouncilChambersPresent:BobMannich,Chairman;CharlesBassett,BernieFogarty,ErikCortinas,BuildingOfficial,BettyRivenbarkSecretary.Absent:CharlesSenior,LouisAgee,SusanCunninghamZBAO2-20PublichearingCathydineLloyd,GreenoLane,appealfromadministrativedecision.InthecommentsbyMr.CortinashestatedthatMs.LloydhadappliedtothebuildingdepartmentforabuildingpermitfortheplacementofamobilehomeonanunaddressedlotlocatedonGreenoLane.Thatbecauseofthezoning(R-1)itisnotauseallowedalthoughthereareatleast3mobilehomesonthisstreetatthepresenttime.WhenthiswasannexeditwasannexedinasRI.Ms.Lloydhassaidthatshewishestobuildapermanentresidenceonthispropertybutatthistimecannotaffordtodoso.Staffrecommendationwastoapprovesincetherearealreadysimilarstructuresonmanyofthesurroundingpropertiesitwillhavelittleornoimpactonthesurroundingneighborhood.Ms.LloydspokesayingthisstreetrunsdownbesideDanny’sandthispropertyonrightsideclosetoIngleside.Thepublichearingwasheldandtwoneighborsspokeaskingwhatproposedthere.AfterdiscussionBernieFogartymovedtoapprovethereversaloftheadministrativedecisionandallowthemobilehome.CharlieBassett2’themotionanditcarriedunanimously.ZBAO2-21PublichearingtoconsidertherequestofFrederickNailHollisfor7’8”sideyardsetbackandacoveredaccessorywalkwayvariancesat204N.BayviewStreet.MacWalcottandRyanBakerwerepresentrepresentingMr.Hollis’requests.Mr.Walcottpassedoutadrawingshowingtheplannedrenovations.Mr.Cortinas’recommendationfollowingthestrictinterpretationofthehardshipclausewastodeny,Mr.Walcottexplainedwhatproposed-toconnectanaccessorybuildingalongtherearalleywaytotheprimarystructure,bothofwhichareexistingandarenotbeingenlarged,andallowtheconstructionofanopenportecocherealongthenorthsideoftheproperty.DiscussionfollowedandMr.Walcottwasaskediftheycouldturntheproposedstepsandmaybegainafootintheportecochereareaandinstallaguttertokeepwaterfromrunningonhisnextdoorneighborandalsousefireregardantmaterialsintheconnectionoftheaccessorybuilding.Mr.Walcottsaidthiscouldbedone.Noonewaspresentfor/againstthiscase.AmotionwasmadebyCharlieBassetttoapprovewiththecontingentupontheabovementionedconditionsbeingadheredto.BernieFogarty2ndthemotionanditcarriedunanimously.SusanCunninghamarrivedat5:18PMZBAO2-18PublichearingofSpencerJohnsonfora5’rearyardsetbackvarianceforthepropertyat307N.SummitStreet.Thisisarequestfora10’X20’additiontoawoodworkingshopinhisbackyard.Thereisanexistingliveoaktreenexttotheexistingshopthatwouldprecludeexpansionofthebuildingtotheeastwithoutremoval BoardofAdjustments&AppealsSeptember16,2002-Pagetwoofthetree.Underinterpretationofthehardshipclausetherehastobeaninherentcharacteristicofthepropertythatwillnotallowtheapplicanttofulfilltherequirementsoftheregulationsandinthiscasethatwouldbetheexistingoaktree.BobMannichreclusedhimselffromparticipatinginthiscase.SusanCunninghamasVice-Chairmanopenedthepublichearingandtherewasnoonepresentfor/againstthisrequest.CharlesBassettmovedtoapprovevarianceasrequested.BernieFogarty2ndthemotionanditcarriedunanimously.Underoldbusiness-LeaVernuillerepresentingRalphReynoldscasethatwascarriedoverfromthelastmeetingwaspresentandreportedafterwritingletterstotheBaldwinCountyHistoricPreservationReviewBoardfoundthatthisstructurewasoneof28consideredhistoricinPointClearandeventhoughrenovationwasproposedthiswasstillwithintheguidelinesofthehistoricpreservationofthestructureandwouldstillmaintainthehistoricintegrity.Thereforetheoriginalrequestwaswithdrawnandthepointismoot.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
