TheFairhopeBoardofAdjustmentsandAppealsmetMonday,October21,2002at5:00PMattheCityMunicipalComplex,161N.SectionStreetinCouncilChambers.Present:BobMannich,Chairman;ChariesBassett,CharlieSenior,BernieFogarty,ErikCortinas,BuildingInspector;BrendaHoifren,ActingSecretary.Absent:LouisAgee,SusanCunningham,andBettyRivenbarkChairmanBobMannichcalledthemeetingtoorderat5:00PM.HeaskedifallhadreadandapprovedtheminutesoftheSeptember16,2002meeting.Allpresentindicatedapprovaloftheminutesaswritten.ZBA02-22Mr.&Mrs.JohnPershinaat6WhiteAvenueVariancerequestformaximumbuildingcoverageincreaseandsideandfrontyardsetbackvariances.ChairmanMannichaskedthePershinastoaddresstheBoard.(Seeletterofrequestinvariancecasefile).Theysubmittedpictures,asiteplan,andaletterstatingthereasonstheyleftthevariancerequestsshouldbeallowed.Theywereseekingapprovalforadditionalstorageadjacenttotheirpresentgarage,asecondstoryadditiontotheexistinggarage,acoverfortheircarintherear,andatoweradditionatthefrontwestcorneroftheresidence.Aftersomediscussion,ChairmanMannichaskediftherewasanyoneelsepresentwhowishedtospeakfororagainsttherequest.Ms.BeverlyCourtrightwhoownsthepropertytotheEastofthePershinas,spokeindicatingthatshedidnotwanttoseethelargepecantreeintheiryardcomedowntomakewayforasecondstoryonthegarageasitprovidedshadeforherpropertyaswellastheirs.ShewouldalsoloseherviewoftheBayfromthebalconyofthegarageapartmenttotherearofhermainhouse.Shehadnoproblemwithsomeoftheotherimprovementstheywantedtomake,butfelttheyweretryingtooverbuildthesmalllot.AlexDondevilleof12WhiteAvenuespokenextsayingthePershinasweretryingtobuildtoomuchonasmalltot.ChairmanMannichaskedthatthestaffrecommendationberead.StaffrecommendationwasfordenialasthebuildingsinplacealreadyexceedthelotcoveragepercentageforanR-2lot.Aftersomediscussionamotionwascalledfor.BernieFogartymovedtoacceptstaffrecommendationanddenytheapplication.CharlieBassettseconded.Themotioncarriedunanimously.ZBA02-23Mr.&Mrs.WilliamMartiniereat121CypressLanerequestforanapproximatesix-foot(6)rearyardsetbackvarianceforacoveredpatio.ChairmanMannichaskedtheMartiniere’stoaddresstheBoard.TheystatedthatAdamsHomeshadbuilttheirhouseandthedecktotherear.Becauseofamedicalcondition(multiplesclerosis)sufferedbyMrs.Martiniere,shehastolimithertimeinthesun.TheyaskedtheagentforAdamsifaroofcoverfortheirdeckwasallowed.AdamsindicatedtheyneededpriorapprovalandpresentedtheMartiniere’swithadocumentinsinuatingapproval.TheMartiniere’shadacoverconstructedoverthedeckbuiltbyAdamsHomeswiththeassumptionthattheyhadapproval.Duringthecourseofinspectionsinthearea,thebuildinginspectorsawthecoverandinquiredaboutthepermit.TheintrusionintothesetbackswasdiscoveredandtheMartiniere’s PagetwowereadvisedtosubmitanapplicationtotheBOA,asapermitcouldnotbeissuedforanillegalstructure.TheChairmanaskedifanyonewerepresenttospeakfororagainsttherequest.Mrs.Sneligroveof136CypressLanespokeindicatingthatshehadnoobjection.ChairmanMannichcalledforstaffcomments.Mr.Cortinasreadhiscommentsstatingthatextenuatingcircumstancescametolightinregardtothisrequest.HeaskedtheBoardtoconsidertheminregardtotheirdecision.TheBoardwasinagreementthatavarianceshouldnotbeapprovedforanillegalstructure.But,theyagreedthatmakingtheMartiniere’stakedownthecoverwasnotagoodalternative.Itwasagreedthataninstrumentistobefiledwiththeprobatejudge,whichwillnotifyanyonedoingatitlesearchthatthecoverhastoberemovedifthepropertyeverchangeshands.TheChairmancalledforamotion.CharlieBassettmadeamotiontodenythevariance,butallowtheMartiniere’stokeepthestructuresubjecttoitsremovalwhentheyselltheproperty.CharlieSeniorseconded.Motioncarriedunanimously.ElectionofOfficerswaspostponeduntilsuchtimeasabsenteememberswerepresentforavote.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
