TheBoardofAdjustments&AppealsmetMonday,November18,2002at5:00PMattheCityAdministrationBuilding,161N.SectionStreet.Present:BobMannich,Chairman;CharlesSenior,BernieFogarty,LouisAgee,SusanCunningham.CharlesBassett,ErikCortinas,ChristopherBakerandBettyRivenbarkSecretaryTheminutesoftheOctober21,2002meetingweredulyapprovedonmotionbyBernieFogarty,2bySusanCunninghamandunanimouslycarried.ZBAO2-24PublichearingtoconsidertherequestofSpectraSitefora10’heightvarianceonanexistingnon-conformingtowerlocatedat22906U.S.Highway98,Fairhope,AL.Mr.MannichaskedtherepresentativefromSpectraSitetopresenthiscase.Hecameforwardandpresentedadrawingshowingtheadditional10’whichwouldmakeit160’intheair.MiquelCruzspokeforVerizonthenewcustomerthatwouldbeontopandsaidthereisapolenorthandsouthofthisbutthereisadeadareaatthissiteandthiswouldtakecareofit.ThecurrentusersofthispoleareNextel,CellularSouth,Voicestream.Theyfeltitwouldcertainlybetoeveryone’sadvantagetoaddthe10’ratherthangotogreatexpenseintheconstructionofanewpole.Staffrecommendationwasaskedfor.Erikinreadinghiscommentssaidthisisanonconformingtowerthatwaserectedin1998astheresultofafederalcourtorderobtainedbytheownerandpriortothecreationofthecity’sexistingcelltowerordinance.Theexistingtowerexceedstheheightrequirementof130’andisplacedwithinaresidentiallyzoneddistrict.Hefurthersaidthatinterpretationofthehardshipclausestatedtherehadtobeaninherentcharacteristicofthepropertythatwouldnotallowtheapplicanttofulfilltherequirementsoftheregulationsandthereisnosuchhardshipbutthequestionbeforetheboardiswhetherornotallowinganadditional10’onthistowerwillservethepublicinterestmorethantheestheticsinvolvedwiththecreationofanothertowerasthisisaprimegatewayintoFairhope.Thepublichearingwasopenedandnoonewaspresenttospeakfororagainst.Thepublichearingwasclosedandmotionwascalledfor.LouisAgeeaskedifwewouldbesettingaprecedentandhewastoldno.Thateachcaseisconsideredonitsmeritsalone.Allquestionsbeingansweredsatisfactorily,BernieFogartymovedtoallowtheadditional10ft.ontheexistingtower.SusanCunningham2themotionanditcarriedunanimously.AnelectionofofficerswasheldandBernieFogartywaselectedchairmanbyacclamationandSusanCunninghamwaselectedViceChairmanbyacclamation.Therebeingnofurtherbusinessmeetingwasdulyadjourned.
