Home My WebLink AboutMinutesTheBoardofAdjustments&AppealsmetMonday,March18,2002at5:00PMattheCityAdministrationBuilding,161N.SectionStreetPresent:BobMannich,Chairman;SusanCunningham,BernieFogarty,LouisAgee,CharlesSenior,AlternateCharlesBassett,ChristopherBaker,DirectorofPlanning&Zoning,BettyRivenbark,SecretaryTheChairmanrecognizedMr.FogartyandMr.Agee,newboardmembers.TheminutesoftheDecember17,2001meetingwereconsideredanddulyapprovedaswritten.CaseBAO2-02-RearYardVarianceRequest,DanMatthews,139McIntoshBluffRd.Dr.Matthewswaspresentandtoldtheboardheiswishingtocoverapooldeck.Thatundertherequirementshecandothisasadetachedstructurebutthathewishestoattachittohishome.Thatthismeetsthespiritoftheordinanceandhehasspokentoallhisneighborsandnoonehasaproblemwiththis.HesaidithadbeenreviewedbythearchitecturalreviewboardofRockCreekandthattheyhavegiventheirapproval.BobMannichaskedhimifhewouldbeenclosingthisonallfoursidesinthefuture.Dr.Matthewssaidno,itwillbetwobrickwallsontwosides,hehasnoplanstoenclosethis.Aletterwassubmitted(infile)fromadjoiningpropertyownersgivingapprovaltothisrequest,andalsoinfilewasaletterofapprovalfromthearchitecturalreviewboardofRockCreek.Mr.Mannichaskedifanyoneelsehadanyquestions(therewerenone)andheaskedMr.Bakertostatethecity’sposition.Mr.Bakersaidthateventhoughthisisaselfimposedhardship,thereisnoinherentcharacteristicofthepropertythatforcestheneedforthevarianceandDr.Matthewscouldeasilybuildwithin5ft.ofthepropertyline.Thatindoingsoitwouldbeclosertoadjoiningproperties,thushavingpotentiallymorenegativeimpact.Thatbyallowingthevariancethespiritoftheordinanceisbeingrespectedandsubstantialjusticeisbeingdonetotheneighbors,thereforeherecommendedapproval.Allquestionsbeingansweredsatisfactorily,BobMannichmovedtoapprovevarianceasrequested,SusanCunningham,2themotionanditcarriedunanimously.CaseBAO2-03Extensionrequest-FairhopeUnitedMethodistChurchfortemporarybuilding(generallylocatedatMorphyandSectionStreets)Mr.BakercommentedthatthechurchhadfirstcomebeforetheboardinMarchof2000andaskedtoputatraileratthissitetohousesomepersonneluntiltheconstructioniscomplete.Atthattimetheboardapprovedtherequestforaperiodofoneyearthustheneedfortheextensionrequest.NoonewaspresenttospeaktothisrequestbutaletterhadbeensubmittedsayingthattheprojectissixmonthsbehindandtheywillneeduseofthisstructureuntilAugust2002.Staffrecommendationwastoapproveasrequested.Therebeingnofurtherquestions,BobMannichmovedtoapprovethisextensionuntilAugust2002.BernieFogarty2’themotionanditcarriedunanimously.Therebeingnofurtherbusinessmeetingwasdulyadjourned.
