HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,June17,2002at5:00PMattheCityAdministrationBuilding,161N.SectionStreet,intheCouncilChamberPresent:BobMannich,Chairman;SusanCunningham,CharlesBassett,BernieFogarty,CharlesSenior.ChristopherBaker,DirectorofPlanning&Zoning,BettyRivenbark,SecretaryTheminutesoftheApril15,2002meetingweredulyapprovedaspresentedonmotionbySusanCunningham,2dbyCharlesBassettandunanimouslycarried.Note:Thefourcasestonightrepresentvariancerequestson4lotsbyAdamsHomes(Lots,2,3,6SpringLakeandLot6inSouthlandPlace)regardingmovingthesetbacksinordertosaveexistingtrees.Christopher,TutWynne,andBobMannichhadwrittenaletter(infile)whichauthorizedthemtopullpermitsandproceedbutthatthefinalvariancerequestwouldrequireactionoftheboardattheJunej7thmeeting.BA2-05PublichearingtoconsiderrequestofAdamsHomesfora3’frontyardvarianceonLot6inSpringLake(generallylocatednorthofTwinBeechandeastofGreeno).Mr.BakerhadcommentedthatAdamsHomesareconstructingthehomesinSpringLakeandthepropertyiszonedR3PGH.Theyarerequestinga3’frontyardvarianceinordertopushthehomeclosertothestreetinordertosaveatreeintherearyard.Herecommendedapproval.Mr.Mannichopenedthepublichearingandatthistime3residentsintheSpringLakeareaexpressedtheiroppositionsayingthathousesarealready.underconstructionanditcertainlygivestheimpressionofadonedeal,whyweretheynotified,andwhyweretheyallowedtoproceed.Mr.BakeransweredtheresidentsstatingfortheirbenefithowAdamscameforwardrequestingthevariancesandhowtreesareanassettothecommunityandthecitylookedfavorablyonsavingthetreesasthecitydoeshaveatreeprotectionordinancebutitdoesnotapplytoresidentialpropertysotheycouldhaveclearcutthepropertyiftheywantedtoanditisinthecity’sbestinteresttosavetrees.ThattheCityAttorneyandmayorreviewedthisandsaidtheymetthecity’scriteriaandthattreesareaninherentcharacteristicoftheproperty.Astowhytheyarealreadyunderconstructionhesaidthehomesaresoldandtheywereundercontracttohavethembuiltbyacertaindatesotheyweregivenpermissiontopullpermitsbuttoldthiswassubjecttothefinaldecisionoftheboard.TheirwasnodiscussionfromtheboardandamotionwasmadebyCharlieBassetttograntthevariance.SusanCunningham2rdthemotionandmotioncarriedwithonenayvotebyCharlesSenior.BA2-06PublichearingtoconsidertherequestofAdamsHomesfora4’frontyardvarianceonLot3SpringLake(GenerallylocatednorthofTwinBeachRdandeastofGreeno.OnceagainChristopherrecommendedapproval.AmotionwasmadebyCharlesBassett,2ndbyBernieFogartytoapproveandpassedwithoneabstentionbyCharlesSenior. BA2-07PublichearingtoconsidertherequestofAdamsHomesfora3’frontyardvarianceonLot2SpringLake(generallylocatednorthofTwinBeechandeastofGreeno)Christopherrecommendedapproval.AmotionwasmadebySusanCunningham,2ndbyCharlesBassetttoapproveandpassedwithoneabstentionbyCharlesSenior.BA2-08PublichearingtoconsiderrequestofAdamsHomesfora2’rearyardvarianceonLot6,SouthlandPlace(generallylocatedsouthofthehighschoolontheeastsideofGreeno)Christopherrecommendedapproval.AmotionwasmadebyCharlieBassetttoapprove,BernieFogarty2ndandmotioncarriedwithoneabstentionbyCharlesSenior.UndernewbusinessChristopherBakersaidthatthecityhadreceivedacopyofthenewFloodPlainrequirementsputoutbyFEMAenforceabletodayandthatinsomeareastherecouldbemajorchanges.Thatheisseekingguidancefromtheboard,dotheywishtosetapolicy?Hesaidthatnowreadsbottomofhousehastobe1fthigherthanfloodline,thatthebuildingcodesaysnaturalgradetomidroofline.Dowewanttoadd1fttobuildingheight?Heforeseescaseswherepeoplecomerequestingvariancesduetohardshipputonthembynewregulations.Furtherdiscussionbytheboardledtodecisiontohandleonacasebycasebasisuntiltheboardgottolookatthechangesandthendecidewhatpolicytheywouldliketofollow.Therebeingnofurtherbusiness,meetingisdulyadjourned.
