HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,July15,2002at5:00PMattheCityAdministrationBuilding,161N.SectionStreetintheCouncilChambersPresent:BobMannich,Chairman;CharlieBassett,CharlesSenior,LouisAgee,BernieFogarty,SusanCunningham,members.ChristopherBaker,DirectorofPlanning&Zoning,BettyRivenbark,SecretaryTheminutesoftheJune17,2002meetingwereconsideredanddulyapprovedonmotionbyBernieFogarty,2bySusanCunninghamandunanimouslycarried.ZBAO2.09PublichearingtoconsidertherequestofThomasandB.J.Danielfora2’frontyardvarianceat254N.BayviewAvenue.Mr.BakerinhiscommentssaidthatMr.andMrs.Danielshavepurchasedandarerenovatingtheresidencelocatedat254N.BayviewAvenuethatiszonedR-2.Theyarerequestinganadditional2’tothealreadynon-conformingfrontyardsetbackfortheadditionofaporch.Hecommentedthatbasedontheletterofthelaw,wearerequiredtorecommenddenialsincethecircumstancesdonotmeettherequirements,howevertheboardshouldfeelfreetoconsidertheotherfactorsandargumentsthatcanbemadeinfavoroftheproposal.LeeVernuille,architectontheproject,spokeonbehalfoftheDanielsandsaidheishopingtoaddatwostoryfrontporchtotheresidenceandshoweddrawingsandlayoutsinconjunctionwiththeadjacentproperty.Therewasnoonepresentforlagainsttheproposal.Noquestionswereraisedanditwasthegeneralconsensusitwouldbeanimprovementintheneighborhood.AmotionwasmadebySusanCunningham,2ndbyBernieFogartytoapprovefrontyardvarianceasrequested.Motioncarriedunanimously.Mr.VernuillewasremindedthatthisisanR-2zoneandthattheheightrequirementis30’.Hesaidheunderstood.Thechairmantoldtheboardmembersthatatthenextmeetingwewillbeaskedtoconsiderourfirstcaseonthefloodheightordinance,whichwesaidwewouldhandleonacasebycasebasis.Soheaskedthemtobethinkingaboutit.Alsothereisacaseinvolvinganaccessoryusebuildingthathascomeupandbroughtoutseveralissues.Thatasaresultweneedtoestablishguidelines,lookatalittlecloser,possiblypassresolutionregardingsame.Christophersaidhewilltrytohaveresolutiondraftedandgettoboardmembers.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
