TheBoardofAdjustments&AppealsmetMonday,December17,2001at5:00PMattheCityAdministrationBuilding,161N.SectionStreetPresent:BobMannich,Chairman;SusanCunningham,JimMcClure,CharlesBassett,JoePetties.ChristopherBaker,DirectorofPlanning&Zoning,BettyRivenbark,SecretaryTheminutesoftheOctoberandNovembermeetingsweredulyapprovedwith2notedchangesonmotionbyJimMcClure,2byCharlesBassett.Motionmovedunanimously.Case01-10(continuedfromNovembermeeting)LeeandBeckieErickson,Rearyardvariance,361GastonStreet.TamWilliamswaspresenttonightrepresentingtheErickson’sandsaidsheisdesigningtheirrenovationsattheresidence.ThattheywishtoaddontotherearofthehouseaL-shapedconfiguration.Theywouldbeconvertingtheexistinggarageintolivingarea,addingasmallpool10x20ftandhaveamastersuiteonthesecondstoryoftheadditionoverlookingthepool.Thattheporchwouldbelocatedbelow.Itwasaskedifheightwasanissueandtheanswerwasno.Anymorequestionswereaskedforfromtheaudienceorboardandtherewerenone.Staffcommentedthatthisisaselfimposedhardship-thereisnoinherentcharacteristicofthepropertythatforcestheneedforthevariance.However,theboardcouldarguethatthecontinuingimprovementofpropertiesinoldFairhopeisintheinterestofthecityandrecommendeddenial.BobMannichmovedtoapprovethevariancerequestwiththerestrictionthattheporchinbacknotbeclosedin.Motionpassedunanimously.Case01-11HarryJohnsonSpecialExceptionUsetoallowaministorage,cornerofBrownStreetandFairhopeAvenue.Mr.Johnsonwaspresenttotalkabouthisrequest.Hesaidhewishedtobuildtwobuildings,usingbrickandstuccowithtwoofficesinthefrontfacingFairhopeAvenueandstoragebehind.Itwasnotedthatthereisan18ft.dropbehindthepropertyonthesouthpropertylineandonthewestsideisBrownStreet.Mr.JohnsonsaidhewasinformedthattheEastsidewouldneedtobebuiltwithfirewallwhichwasnoproblem.Thatheproposespeoplewithstoragecoulddriveintothebackandturnaround.Parkingwasaskedaboutandhesaidhewouldadjustdrawingstowhatneededandalsosaidhewouldputupfencingwhereneededandlandscape.Nofurtherquestionswereforthcomingfromtheboardoraudience.Staffrecommendationwastoapprovethespecialexceptionrequestasitisagoodcompromise.BobMannichmovedtoapprove,JimMcClure2motionwithamendmentthatnothingbestoredinrearofpropertysoastoallowvehiclemovement.Mr.Johnsonwasfinewiththis.Motioncarriedunanimously.Therebeingnofurtherbusinessmeetingwasdulyadjourned.
