HomeMy WebLinkAboutMinutesTheFairhopeBoardofAdjustments&AppealsmetMonday,March20,2000,at5:00PMattheCityAdministrationBuilding,161N.SectionStreetPresent:JimMcClure,Vice-Chairman;membersSusanCunningham,CharlesSenior,JoePetties,BobMannich.ChristopherBaker,DirectorofPlanning&ZoningandBettyRivenbark,SecretaryTheminutesoftheFebruary21,2000meetingweredulyapprovedaswritten.AtthistimeaResolutionwasreadregardingtheuntimelydeathofRobertVanlderstineasfollows:RESOLUTIONWHEREAS,thepeopleoftheCityofFairhopewereshockedandgreatlygrievedtolearnofthesuddenanduntimelydeathofRobertVanIderstine,andWHEREAS,Robertwaswellknowninthecommunitythroughhisbusiness,MarineExhaustandhisrestaurant“SpeakEasy”.Healsohadagreatloveformusicandworkedwiththeschoolsintheirmusicprograms.HefirststartedservingontheCity’sBoardofAdjustments&AppealsinNovember1990,andwasdedicatedinthisserviceovertheyearsashebelievedinthecontrolledgrowthofourgreatcity.HewasappointedChairmanofthisboardin1998andcontinuedtoservefaithfully,andWHEREAS,wemournhislossandextendtohiswifeandfamilyyoursincesympathyinthishouroftheirdeepbereavement,andWHEREAS,beitresolvedthatanofficialcopyofthisresolutionbespreadupontheminutesoftheboardofAdjustments&Appeals.SIGNEDTHISTHE20thdayofMarch,2000.JimMcClure,ViceChairmanCase#00-06SpecialExceptionUseRequestandVarianceRequest-FairhopeUnitedMethodistChurch,155S.SectionStreet.Requesttoplacemanufacturedbuildingonthesiteuntilthedisplacedfacilitiescanberelocatedtothenewlyconstructedbuildingandvarianceforparkingrequiredforfuturesanctuary.ClayAdamsspokefortheapplicantsayingthetwoissuesweretiedtogether.Thattheuseofthemodularbuildingwouldbetemporary,untilsuchtimeanewbuildingwouldbebuilttohousetheoffices.JoeBurlington,theministerspokesayingthattheyanticipate18monthsconstructiontime,butitwillbesixmonthsbeforetheybreakground.Theywereremindedthatifspecialexceptiongrantedtheyonlyhavesixmonthsuntiltheusewillexpire.Theywereaskedwhattheyplannedtobuildfirst.Theyhadamasterplan,firstphasewouldbetheeducationannexandallorpartofChristianlifecenter.Any objectionsoröommentswerecalledfor.Theplacementofthemodularbuildingwasquestionedanditwasstatedtheywillplacebehindthesanctuary,nestleduponthenarrowwidthofFelsAvenue.Christopherwasaskedifhehadanycomments,hesaidno,noissuewithwhatproposed.ThelengthoftimetoallowmodularusewasdiscussedandamotionwasmadebyCharlieSeniortoallowspecialexceptionwith20monthlimitonmodularuse.JoePettiessecondedandmotioncarriedunanimously.AKayPalmerof453ColeCourtquestionedthe2partofrequesttheparkingissue,sayingitwasnotdiscussed.Sheaskedifthechurchwasgoingtoremovethehousesallthewaytoherproperty.Shewastoldyes.Sheaskedaboutthebufferplanned.Shewastoldthattherewasa10ft.separationbetweenherpropertyandthechurch’sandthatahedgewouldbeplantedalongthatlineandthataporousparkinglotiswhatplannedtogothere.ChristopherofferedthattheP-IParkinghaspassedtheZoningCommissionandisscheduledtogobeforetheCouncilMondaynight.Ms.Palmersaidshewasworriedaboutthenoiseandtheyassuredherthatthebuildingswouldbeplacedatthefurthestpointfromherpropertyandthenoisewouldbeminimal.Shesaidshewouldlikeafenceerectedbetweenherpropertyandtheparkinglot.DeniseLoressaidshehadnoproblemwiththerequestedfence.BobbyMannichmovedtoallowthevariancerequestontheparking.SusanCunningham2ndandmotioncarriedunanimously.Case#00-07BettyKemp108KieferStreet7ft.sideyardvariancerequest.AllenMartinofBrothersConst.Saidthatthereisalreadyasunroomonthissideofthehouseandsheisrequestingtoputan8x12bathroomonthebayside.Christopherhadpicturesofthehouseandcommentswerecalledfor.Therewerenone.JoePettiesmovedtograntthevarianceasrequested.CharlieSeniorsecondedandmotioncarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
