HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,July17,2000attheCityAdministrationBuilding161N.SectionStreetinCouncilChambersat5:00P.M..Present:JimMcClure,Chairman;membersBobMannich,JoePettis,CharlesSenior,SusanCunningham,alternateCharlieBassett,DirectorofPlanning&BuildingChristopherBakerandBrendaHoffrenasactingSecretaryforBettyRivenbark.ThemeetingwascalledtoorderbyChairmanJimMcClure.TheminutesoftheJune19meetingwereconsideredandapprovedonmotionbyBobMannichand2”bySusanCunninghamandunanimouslycarried.CaseBA00-13-JaleenBradley394S.Ingleside-PublicHearingforSpecialExceptionUserequesttoallowtheoperationofadaycareinanR-2ResidentialDistrict.Mrs.BradleywasrecognizedbyMr.McClureandaskedtoexplaintotheBoardwhatshewasrequesting.Mrs.BradleystatedthattheDayCaretheyhadoperatedbeforeatanotherlocationwasclosedinDecemberof1999.Theyhadrecentlyaddedaroomtotheresidenceat394S.Inglesidetoaccommodate12children.InordertogettheirapprovalfromDHR,theyhadtoobtainCityapproval.TheBradleysstatedthattheyhadplannedtocarefor12childrenandwishedaspecialexceptionfor12.Mr.BakerexplainedtherestrictionsplacedonherrequestundertheZoningOrdinance.Itwillallowamaximumof6children,theyardmustbefencedandallactivitiesmustbeconductedinside.Mr.McClureaskediftherewasanyonepresenttospeakfororagainsttherequest.Noonewaspresent,howeverMr.B’akerstatedthathehadreceivedaletterfromMr.VanFingerinoppositiontotherequestbecauseofthelocationandtheoperationofabusinessinaresidentialdistrict.Mrs.BradleyrequestedacopyoftheordinancefromMr.Baker.Mr.McClurecalledforanycommentsfromthepublicoramotionontherequest.BobMannichmadeamotiontoapprovetherequestuponproofofDHRcertificationandcompliancewiththezoningrestrictions.JoePettis2ndandallapproved.CaseBA00-14-John&HeleneTaylor-105NorthAvenue-PublicHearingforaRear&SideYardVariancetopermitadditiontoexistingresidence.Helene&JohnTaylorwereaskedtopresenttheircasetotheBoard.Mrs.Taylorexplainedtheirlotwas93’x100’withaningress/egresseasementontheEastside.Originalconstructionplacedthefrontoftheexistinghouseat46’.Therearsitswithintherequiredrearsetbackasalegalnonconforminguse.Mrs.Taylorhassomehealthproblemswhichrequiretherapyeverydayinatherapeuticspa.TheywishtOconstructthisspaunderrooflineontheNorthwestcornerofthehouseinalignmentwiththeexistingfootprint.TheyalsowishtoaddontotheWestsideofthehousewhentheyconstructtheirsecondstory.TheTaylorsaskedtheirneighborMr.Noltetospeakforthem.HeindicatedthathewastheirneighbortotheWest.Hefelttheadditiontheyplannedwouldbeacredittotheneighborhood.Mr.Bakerindicatedthat theCityAttorney,TutWynne,hadadvisedthathevariancerequestedbytheTaylorswasnotoutoflinewiththosegrantedbypreviousrulingsoftheCourtinsimilarcircumstances.Herecommendedapprovaloftherequest.Mr.McClureaskedforanyothercommentsfromthepublic.Therewerenone.AfterclarifyingwithChristopherandtheTaylorstheextentofthevariancesrequested,amotionwascalledfor.SusanCunninghammovedtoapprovetherequest.21byCharlesSenior.Motioncarriedunanimously.ChristopherBakeraskedthattheChairmanintroduceCharlieBassettasthenewalternateontheBoardofAdjustment.Therebeingnofurtherbusiness,amotionwasmadeforadjournmentbyCharlieBassettand2’’byBobMannich.
