TheBoardofAdjustments&AppealsmetMonday,September20,1999,at5:00PMattheCityAdministrationBuilding,161N.SectionSt.Present:RobertVanIderstine,Chairman;membersJimMcClure,JoePetties,BobGentle,CharlieSenior,SusanCunningham.ZoningEnforcementOfficerChristopherBaker,BettyRivenbark,SecretaryTheminutesoftheJuly19,1999meetingweredulyapprovedaswrittenonmotionbyJimMcClure,2ndbyBobGentleandunanimouslycarried.CaseBA99-08RussellB.Harper,111N.SummitSt.Avariancetoallowtheimprovementofanon-conformingdriveway.Mr.Harperaddressedtheboardsayinghehasanexistinggraveldrivelocatedonhisnorthpropertyline.Asthisisnonconforminghecouldcontinueindefinitelytouseasis,buthewishestopaveit.Healsomadeknownhisdesiretoteardownthehouseandrebuild.Hewasaskedifheplannedtorebuildonthethumbprintoftheoldhouse(whichwouldbeallowed)andhesaidhewouldliketogoback10-15ftandaddontosideofhousebutthenorthsidewouldremainthesame.AfterMr.Harperspokethechairmancalledforanycommentsfromtheaudienceandfromtheboardmembers.Staffhadcommentedthatthestrictinterpretationofthelawwouldnotjustifygrantingthevariancerequestasitisaself-imposedhardship,butbyapprovingthevariancethetreesmightbeprotected,andfurtherrecommendedapprovalasthespiritoftheordinancewouldbeobserved.Itwaspointedoutthatifapprovalgivenitwouldbesubjecttohimdesigningthedrivewaysothatnowaterwoulddraindirectlyontheadjoiningpropertyowner.JimMcCluremovedtoapprovevariancerequestsubjecttodesignbeingsuchthatnowaterwillrunontheadjacentpropertyowner.JoePetties2andmotioncarriedunanimously.CaseBA99-09Raymond&PatriciaClark,103OldMillRoadAvariancetoaltersetbacksonLot164PhaseIofRockCreek.ChristopherhadinformedtheboardthattherearenoimprovementsonthepropertynowbuttheClarkswanttobuildahome.Thepropertywasplattedwithoriginaldevelopmentintheearly90’s.TheirrequestistochangethesetbackssothefrontofthehouseisonOldMillRoad.Christopherhadsaidthataccordingtothestrictinterpretationofthelawthecaseshouldbedenied,butitdoesnotviolatethespiritoftheZoningOrdinancetogranttheirrequest,theonlypersonaffectedisthenextdoorneighborwhowouldratherseethesideofahousethanthebackofitandsentalettersayingso.Mr.Clarkaddressedtheboardsayingthattheypurchasedthelotin1994butwerenotreadytobuilduntilnow.Thattheyweretoldthattherearandsidesetbackswereincorrectlydrawnontheoriginalplat.HehadreceivedapprovalfromtheArchitecturalReviewBoardofRockCreekandthebrokertoldhimtherewouldbenoproblemingrantingthevariance.ThatthiswouldalsoconformwiththeresidencesalongOldMillRoad.Mr.Clarksaidfurtherthatthelotisabout10’abovestreetlevelatthecornerandabout3’attheotherend,thatitwasclearedinthemiddlealreadybutisheavilywoodedaroundtheperimeter.Thattheyhavechosenplansthatwouldalsofitthelotandpreservethetreesastheyare.If variancegrantedtheywouldnotbackuptoaneighbor’shouseoneithersidenortotheedgeofthecartpathwhichrunsalongonelotline.TreyCorte,spokesayinghewastheprojectmanageratthetimeRockCreekwasdevelopedandthathewasalsoassuredtherewouldbenoproblemwhenthetimecametorequestthisvariance.Theaudiencewasaskediftheywishedtocomment.Noonedid.AmotionwasmadebyBobGentletograntthevariance,2byJimMcClure,motioncarriedunanimously.BA99-1OSpecialExceptionUseRequestTommyHams(Brazeal&Harris)toallowconstructionofnursinghomeinR-IDistrict(OnCtyRd44,eastofHwy98,nexttohighschool)Mr.HarrisspokesayingthistheSnyderpropertyandcontainedalittleover11acres.Thatoneofthelocalnursinghomeswishedtorelocatetothisarea.ThatbackwhentheywerebuildinghighschoolMs.Snydergranted10ft.easementtocitysothehighschoolcouldbeannexed,remainderofpropertyisoutsidethecitylimits.ChristopherhadremarkedthatthisstiprunsthroughthepropertyoutsidethecitybutannexedpropertyunlessotherwiseindicatediszonedRI-SingleFamilyResidentialandanursinghomeispermittedbySpecialExceptioninaRIdistrict.Therebytheirneedtoseekaspecialexceptionuse.Mr.Harriswasaskediftheywouldbebuildingonthisstripandhesaidpossibly,itwasmentionedmakingsuretherearenocityutilitiesinthisstrip,andMr.Bakersaidhewouldmakesure.Commentswerecalledforandnoonespokeagainstit.AmotionwasmadebyCharlieSeniortograntspecialexceptionuseasrequested.2byJimMcCluremotionpassedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
