HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,March15,1999attheCityAdministrationBuilding,161N.SectionStreetat5:00PM.Present:ChairmanRobertVanIderstine;membersJimMcClure,CharlieSenior,JoePetties,BobGentle.ZoningOfficialChristopherBaker,SecretaryBettyRivenbarkTheminutesoftheJanuary1999meetingweredulyapprovedaswrittenonmotionbyJimMcCluresecondedbyBobGentleandunanimouslycarried.BA99-01-BobPope,4BeachDrive,20ft.frontand18ftrearyardvarianceMr.Popepresentedhisrequestforhisvariancessayingthathispresentbuildinghadbeentheresince1984.Thattheordinancecallsfora20ft.frontyardand20ft.rearyardthathehasnotbeenabletousethewholepieceofproperty.Hewishestobuilda80X42footbuildingandwouldratherputhismoneyintoanewbuildingratherthananoldbuilding,ifhegoesbythesetbacksitwouldleaveonly4feetfromthefrontpropertylinetothecurb.Hewishestoputaroofthatwouldhaveanoverhangandputinapublicsidewalk,andsaiditwouldhelppeoplewhoareoutintheweather.HesaidhisdesignismoretypicaltoFairhope.Hewasaskedwhathisintentforusewasandhesaidwhateverallowedinthatzone.Thathiscaféthatispresentlytherewouldliketohavemoreroom.TheChairmancalledforanycommentsfromtheaudiencethatwouldbefor/against.Therewerenone.HeaskedMr.Bakertocomment,hesaidthatthisisaB-3bCommercialzone,therearenootherexistingbuildingsotherthanthefirehallthatthiswouldmakeaprecedentthatthishadbeenbeforetheboardin1996andhadbeendenied.Thatunderthestrictinterpretationoftheordinancethereisnohardshipbutacompellingargumentcouldbemadethatitisinthebestinterestofthecitytograntthevariance.BobGentleaskedifhehadaplan,BobPopeshowedwhatheisproposingsayingthatlasttimehehadaskedforatwostorysohecouldusetheupstairsforlivingarea,thatwhenhepurchasedthepropertytherewasavariancegrantedbutthathewasunawarethattherewasatimelimitonthevariancesoitlapsed.Thatnowheisproposingonestory.TheChairmancalledforanymorediscussion/comments.Therewerenone.Hecalledforamotion,therewasnoneforthcoming.Mr.Vanlderstinesaidsincetherewasnomotionrequestforvariancesweredenied.Mr.Popecouldwetellhimwhyitwasdenied,saidheneededsomedirection,wheregofromhere...Mr.BakersaidMr.Popecouldaskforalesservariance.Mr.Vanlderstineofferedthatheisaskingforquitealargevariance.Hewasaskedifheconsideredgoingupwithhisproject.Aftermorediscussion,JimMcCluremovedtocontinuethisfor30daystogiveMr.Popemoretimetoexploreavenuesopentohim.BobGentlesecondedandmotioncarriedunanimously. BA99-02-CVSPharmacylWricoSicinCo.-51S.GreenRd.sicinvarianceSandraWrightofWricoSignsaddressedtheboardsayingthatsheunderstandsthattheothersignsintheshoppingcenterweregrandfatheredinbuttheyaremuchbiggerthanthepharmacyandthatRite-Aidhadjustbuiltanewbuildingdowntheroadwithamuchlargersign.Theyarerequestingtodoublethesizeoftheletterstheynowhavewhicharecurrentlythesizeallowed.Mr.VanIderstinecalledforanyquestionsorcomments.Mr.Bakercommentedthattheycurrentlyhavethemaximumsizeallowed,thattheratioisIfttoevery2ftoffrontage.Itwasbroughtoutindiscussionthattherehasbeenmuchconcernaboutgrantingvariancesonsignsinthepast.Thatnohardshipcouldbeproved.TheysaidagainthatRiteAidisjusttwoblocksawaywithlargesignandJimMcClureremarkedthatthereisquiteabitofdifferenceintheybuildingandC’Slocation.Mr.VanIderstinecalledforamotionandJimMcCluremovedtodenyvariancerequest.BobGentlesecondedandmotioncarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
