HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,June21,1999at5:00PMattheCityAdministrationBuilding,161N.SectionStreet.Present:ChairmanRobertVanIderstine;membersSusanCunningham,JimMcClure,JoePetties,BobGentle,CharlesSenior.ChristopherBaker,Planning&ZoningOfficial,BettyRivenbark,SecretaryTheminutesoftheApril1999meetingweredulyapprovedaswrittenonmotionbyBobGentle.Case99-03ChildrenoftheWorld/HowardB.Shelton,611PensacolaAvenueSpecialExceptionUseVarianceJoyHilleyspokerepresentingChildrenoftheWorldsayingtheyareaninternationalAdoptionReliefAgency.Thattheyhaveonstaff3fulltimeand3parttimeemployees.ThattheypresentlyoccupyaspaceattheMethodistchurchbutthatissoontobetorndownandthattheyneedthespace,arenotafulltimebusiness,atthemostinterviewmaybefourfamiliesaweekinaconfidentialsettingsotheywouldnotbegeneratingmuchtraffic,residentialiswhattheyenvision.Thatthelocationisattheendofthestreet.Theyarenon-profit.Ms.Hilleysaidtheywouldbewillingtosetsomethingupthatsaidthataftertheyvacatethepremises,beit6monthsor5years,thatthepropertywouldrevertbacktoresidential,notpermanentlybeabusinesslocation.TheChairmancalledforanyonepresentwhowishedtospeakontherequestandMs.VanAntwerpspokesayingsheisimmediatelybehindthispropertyandhasnoobjections.Mrs.Cunninghamspokesayingsheisawidowandwouldnotliketheideathatitgeneratedtrafficintheirquietneighborhood,MildredClayspokesayingshehasnoobjections,3letterssentthroughthemailwerenoted(infile).Christopherwasaskedtocommentandhadsaidthatheinformedthemtheyhadtwooptions:seekazoningchangeorappealhisdecisiontonotissueacertificateofoccupancy.TheychosetocometotheAdjustmentBoard.Thatiftheboarddoesinfactgranttheirrequestthatadeedrestrictionshouldbemadeandrecordedthatthispropertywouldinfactrevertbacktoresidentialif/whentheyleave.Hehadfurtherrecommendeddenialoftheirrequestasitisaselfimposedhardshipunderthestrictinterpretationofthelaw.ThechairmancalledforamotionandBobGentlemovedtodenytherequest,JimMcCluresecondedsayingitwasspotzoningandnotincompliancewiththecomprehensiveplan.Motioncarriedunanimously.Case99-04BettyJoHaynie15NorthSectionStreet5ft.heightvariancerequestMartyReed,anarchitect,spokeonbehalfofMs.Hayniesayingthattheywishedtoextendthebuildinginheightinordertoconstructapartmentsinthisstructure.Thatitwouldresemblethewelcomecenteracrossthestreet.Hepassedoutsketchesshowingwhatproposed.Itwasdeterminedthatthepitchoftheroofwaswhatwouldactuallybetheviolation.ChristopherwasaskedtocommentandsaidthatthebottomisusedforacommercialbusinessandzonedB-2.ThatthePlanningDepartmentsupportstheconstructionofresidentialunitsinthedowntownareaasitprovidesmoreviabilityand longevityandadditionalpeoplesupportthedowntownbusinesses.However,thereisnounnecessaryhardshipandunderthestrictinterpretationofthelawthevarianceisself-imposedandherecommendeddenial.Thechairmancalledforanydiscussion,therewasnone,thenhecalledforamotionandJimMcCluremovedtodenytheheightvariancerequest,SusanCunningham2ndandmotiontodenycarriedwithC.Senior,J.Petties,S.Cunningham,J.McClurevotingformotion.99-05MikeMcElmurry,Jr.Variance,6ft.FrontYardSetbackRequirementLot,6,Unit4,LeabrookSID-8899LeabrookDr.Mr.McElmurryspoketotheboardsayinghewasthebuilderofthehomebutwhenhisfatherdiedsuddenlyhismotheraskedhimtomoveinwithherandhedecidedtosellthishome.Whenhewenttogetcleartitleandthelandsurveyedhefoundhehadanencroachment.Mr.McElmurrywasaskedifhedidnotcometocityhailandgetapermittoconstructthehomewithintheallowedboundariesandhesaidyes,butduetotheirregularshapeofthelotwhenhebuilthedidnotrealizehehada6ft.encroachmentontherightside.HesaidfurtherthattheLeabrookarchitecturalreviewcommitteehadacceptedthisknowingtherewasanencroachment.Thathenowhasapurchaserforthepropertyandtheyhavenoobjectiontowhereitisplacedonthelot.Christopherhadcommentedthatherecognizedthatthisisadifficultsituationbutitisaself-imposedhardship.Underthestrictinterpretationofthelawherecommendeddenial.Thechairmancalledforanymorecommentsoramotion.JimMcCluremovedthatduetothecurveofthestreetandlothemovedtograntvarianceasrequested.Motioncarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
