Home My WebLink AboutMinutesTheFairhopeBoardofAdjustments&AppealsmetMonday,January18,1999at5:00PMattheCityAdministrationBuilding,161N.SectionStreet,CouncilChambersPresent:ChairmanRobertVanIderstine;membersJimMcClure,CharlesSenior,JoePetties,BobGentle,SusanCunningham.RobertLunsford,ZoningEnforcementOfficer,BettyRivenbark,SecretaryTheminutesoftheDecember21,1998meetingweredulyapprovedonmotionbyJimMcClure,secondedbyJoePettiesandunanimouslycarried.Case#620JudyBarriefrontyardvariancepropertyatGrandAve.&BonSecourMs.BarrieaddressedthememberssayingthatthepropertyinquestioniszonedR-4thatwhenshecametothezoningofficeshefoundthattherequirementwas75ft.frontfootageplusanadditional5ft.perunit.Thatsheisrequestingavarianceonthefontfootageasthereis66ft.frontagenowandonlyoneunitwillbefacingthefrontonGrandAvenuesoshedoesnotthinktheadditionalfootagerequirementapplies..Shewishestobuild8unitstotal,adjoiningbutindividuallyowned.Thathersetbackswouldworkwiththe8unitssheplanstobuild.Shepassedoutasheettothecommissionmemberswithaletterexplainingwhatshewishedtodoandaplotplan.Mr.VanIderstineaskediftherewasanyonefromtheaudiencewhowishedtospeakandGregGinderwholivesatthecornerofRosaandSectionstreetsaidthatallthewaterfromthesurroundingareacollectsatthispointandhehasencounteredtremendousamountsofrunoffaswellaswashingandaskedifthereisanymonitoringonclearcuttingorstudybeingdoneonstormwaterrunoff.ThathehadnotedthatthejobatFrederickhadbeenstopped.Bobrespondedhedidnotknow.fanystudiesbeingdone.MichaelBarrieshowedadrawingofstormwaterrunoffthathadbeendonebyanengineeronaprevioussubdivisionsubmittal.Hesaidthatsome1400acresdrainintothisarea.BarryCoronaspokesayinghewasrepresentingseveraloftheneighborsandheagreedwiththegentlemanwhospokefirst,allthewaterdoesruntothisareaaddedtothetriangleareathathadbeencleared,andtheyareagainstwhatproposedforthisreason.Mr.VanIderstineaskedBobLunsfordtoexplainissuesandhesaidthatbothfrontageandareawereaproblem,75ft.frontageversusthe66ft.shehas.Thatshedidneedthe5ft.additionalforeachunit-(6unitsX5=30ft+75ft=105ftfrontfootage)thatsheneedsafullacrefor8unitsandshehasonly0.81ofanacresoshewouldalsobeaskingforanareavariance.Aladyspokefromtheaudiencesayingthedrivewayshownonherdrawingrunsalongtherightofwayandthatitisverysandysoilandwouldnotsupportadrivewayandthatthewaterrunsalongthissoitwouldalsobeblockinganaturalwaterflow.Mr.BarrieandBoblookedatthemapanddeterminedthatthedrivewasontheeasternedgenotwest.Mr.VanIderstinecalledforanyfurthercomments,therewerenone,hethenaskediftheboardwishedtomakeamotion,andJimMcClurespokesayingthattheboardhadenvironmentalconcernsbutalsothereweretoomanyvariancesbeingsoughtforthisarea,toomuchdensity.Hemovedtodenythevariancerequested,BobGentle2ndmotioncarriedunanimously.Theapplicantwasnotifiedofoneyearwaitingperiodbeforeresubmittalandalsonotifiedofrightofappealoftheboard’sdecisiontotheCircuitCourt.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
