TheFairhopeBoardofAdjustments&AppealsmetMonday,April19,1999,at5:00PMattheCityAdministrationBuilding,161N.SectionStreetintheCouncilChambersPresent:ChairmanRobertVanIderstine;members,JimMcClure,CharlesSenior,JoePetties,BobGentle,AlternateSusanCunningham.ZoningOfficerChristopherBaker,SecretaryBettyRivenbarkTheminutesoftheMarch15,1999meetingweredulyapprovedonmotionbyJimMcClure,secondedbyJoePettiesandunanimouslycarried.BA99-O1BobPope,4BeachDrive-Frontandrearyardvariance(continuedfromMarch15,1999meeting)Mr.Popewasaskedtoaddresstheboardandtellthemwhat,ifany,changeshehadmadesincehislastpresentation.Hesaidhehadcutbackthesizeofwhathewouldliketodo.Hehadadrawingthathehadmadeshowingwherethebuildingisnowandwherehewouldliketoplacethenewbuilding.Hesaidthathispropertyis44ft.fromfronttobackbutnowwhatproposeddoesnotprotrudeoverthepropertyline,basicallyputontheslabasitexistsnow.Thatitisadding2ft.toonesideand2ft.totheback.Thatthegrassyareatothenorthwillremainthesame.Halfthesizeofbuildingproposedbeforeandessentiallynotcoveringanymoregroundthanwhatisthere.Hewasaskedwhatbuildingmaterialshewasproposingtouseandhesaidprobablybrickveneerandmaybestuccouponfrontofbuilding.Therewasnoonetocommentfromthefloorandnocommentsfromthecommissionmembers.ChristopherhadsaidthatthisisinaB3bzonewhichhassetbacksof20’frompropertylinerearyardsetbackof18’.Thattherearenaturalfeaturesthatcontributetotheoddshapeofthelot,i.e.thebluff,andthenewproposalisonehalfofthatproposedbefore.Thatthisisamanmadehardshipbutitwillnotnegativelyimpactanyadjoiningpropertyownersandhesaiditwouldbeinthebestinterestofthecitytoallowtheredevelopmentoftheland.Hehadrecommendedapproval.AmotionwascalledforandJimMcCluremovedtoapprovethenewvariancesasrequested.BobGentlesecondedthemotionanditcarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
