HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,October19,.1998at5:00PMattheCityAdministrationBuilding,161N.SectionStreetPresent:ChairmanClaudePuckett;membersRobertVanlderstine,JoePetties,CharlesSenior,JimMcClure.AlternatemembersSusanCunningham,BobGentle.RobertLunsford,ZoningEnforcementOfficer,BettyRivenbark,SecretaryTheminutesoftheSeptember21,1998caseweredulyapprovedaswrittenonmotionbyRobertVanIderstine,secondedbyJimMcClureandunanimouslycarried.Case#615DawnMoffit,205CainLane,appealfromtheorderofthezoningofficerregarding#1WinterhavenCourt.Ms.MoffitaddressedtheboardsayingshehadboughtalotonCainLanenextdoortoWinterhavenTrailerParkandbuiltherhousein1994.Shesaidatthetimeshebuilttherewasasmalltraveltrailerparkedinthelotnexttoherandtheresidentsdiedabouttwoyearsago.Thattherewasnothingthereuntilabouttwomonthsagowhenthetrailerparkownersmovedahugemobilehomeinthislotanditisnow41inchesawayfromherpropertyline.Thatshebegininvestigatingatthattimeifitwaslegalforthemtohavemovedthishugetrailerthereinsuchasmallspaceandsoclosetoherproperty.ShecontactedthecityandMr.LunsfordinformedherthatthetrailerparkwasgrandfatheredinandthatheronlyavenueifshewishedtopursueitfurtherwouldbetheBoardofAdjustments.Thatiswhysheisbeforeustonight.Bobhadwrittentoherandtoldherthatshemustpresentevidencethatthiswilltrulyaffectherpropertyvaluesandthatjustsayingsowouldnotbesufficientwithoutsupportingevidence.Ms.Moffitsaidshehasspent$3,000onaprivacyfence.Mr.Pucketttoldheragainthatthishadbeengrandfatheredin,probablytherebeforetherewasevenazoningordinance.Thatiftheymoveanditisvacantayearthentheywouldhavetoconform.BobGentleaskedherwhatshewishedtooccur.Shesaidsheseesthisbighugetrailer41inchesawayfromherresidence,shedoesnotthinkitislegalforthemtohaveputitthereandshewantsthecitytomakethemmoveit.Mr.PuckettaskedBobtorespondandhereadamemorandumhehadwrittenregardingthiscase(infile).ThequestionwasaskedifthiscomplieswithoriginallayoutoftrailerparkandBobsaidno.Thereisa20ft.Frontyardrequirementthatwassetoutin1963.Bobwasaskedifitcomplieswiththatandhesaidno.RobertVanIderstinesaidhethoughtitwaswisetoseektheattorney’sopiniononthisandsomovedthatwecarryoverfor30daysandhavehimheretoadviseus.JimMcCluresecondedandmotioncarriedunanimously.Case#616MichaelMay57FelsAvenue-BackYardseparationvariance.Mr.Mayspoketotheboardsayingheandhiswifehadboughtthehouseandwereintheprocessofrenovatingit.Thattheywishedtoextenditintheback4ft.undertherooflineandthiswouldencroachinthe10ft.rearyardrequirementbetweenthehouseandgarage.Itwouldleave5ft.Heshowedthempicturesaswellaspresenteddrawingsofwhattheyproposed.Mr.Puckettcalledforanycommentsfromtheaudienceorcommission.Therewerenone.RobertVanIderstinemovedtograntthisvarianceasrequested,JimMcCluresecondedandmotioncarriedunanimously. Case#617CharlesCarpenter461SatsumaStreet-SquarefootacjerequirementMr.Carpenterspoketotheboardsayinghehadgottenthecitytovacateaneasementandthatwiththiseasementheisstillshort300ft.oftherequirementtobuildahouseonthisproperty.Heneeds10,500feet.Hewishestobuildanewresidence.Hewasaskedifhewasgoingtobeabletomeettheotherrequirementsonsetbacksandherepliedyes.Thatthelotis85ftonthefrontand120ftdeep.Mr.Puckettcalledforanycommentsandseveraloftheneighborsgotupandsaidthattheyhadfloodingproblemsnowandthatthisvacationofeasementwasprobablygoingtomaketheproblemworse.Theyaskedhimwhereheisgoingtoputthehouseontheland.Couldhepossiblymoveittooneside.Mr.Carpenterhadnoproblemwithmovingit.Mr.Pucketttoldthepeoplethathesympathizeswiththeirproblemsbutwecandonothingabouttheirdrainageproblems,theyneedtocometothecity.TheyaskedMr.LunsfordtoworkwithMr.Carpenteronthedrainagesituationwhenheappliedforhispermit.FurtherdiscussionledtoamotionbyRobertVanIderstinetoapprove300ft.varianceasrequested.JimMcCluresecondedandmotioncarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned. withalternatememberGentlenotentitledtovote.Case#618JonGosnell-365So.GreenoRd-SpecialExceptionUseforusedcarlotMr.Gosnelladdressedtheboardsayingheownsthebusinessnowat365So.GreenoRoad,FairhopeFastLube,andthathewishestoputalatemodelusedcarlotattherearofthisproperty.Thathewillhavenotmorethan10-15vehiclesanditwillbefencedin.Thatitwillnotdeterfromtheappearanceandheplanstocomplywithallrules.Hewishestoplaceasmallbuildingontheproperty.Bobspokesayingthathehadnoproblemaslongasthisapprovedwithconditionthatnostreamers,bunting,mobiles,orattentiongettersbedisplayedandheconformtolandscapeordinance.Mr.Gosnellsaidhehadnoproblemwiththat.FurtherdiscussionledtoamotionbeingmadebyRobertVanIderstinetograntthisasausepermittedonappealwithBob’sconditions.JoePettiessecondedandmotioncarriedunanimously.Therebeingnofurtherbusinessmeetingwasdulyadjourned.
