TheBoardofAdjustments&AppealsmetMonday,February16,1998at5:00PMattheCityAdministrationBuilding,161N.SectionStreetPresent:ChairmanClaudePuckett;membersRobertVanIderstine,JimMcClure,JoePetties,CharlesSenior,AlternatesSusanCunningham,BobGentle.BobLunsfordZoningEnforcementOfficer,BettyRivenbark,SecretaryTheminutesoftheJanuary19thmeetingweredulyapprovedonmotionbyRobertVanIderstine,secondedbyJimMcClureandunanimouslycarried.Case#604J.E.Malone/GavinHunter-Lot#5lnglesideTerrace-8ft.Frontyardand8ft.RearyardvarianceMr.Malonespoketotheboardsayingthisisapieshapedlotthatwiththerequiredfrontandrearsetbacksthattheywouldhavetobuildalongnarrowhouseandwiththeeightfootfrontandrearvarianceitwouldbeabetterdesignforthehouse.Mr.PuckettaskediftherewereanycommentsandaDottieLongspokesayingshelivedtothewestofthislotandhadalettershewishedtopresentwiththesignaturesoftheotherresidentsonthestreetopposingthevariance(letterinfile).HopAllenaskedatthistimewhatthecity’srequirementswereandBobresponded,40frontand35rear.CarterBrownspokesayingheandhiswifeliveontheothersideandhisfatherinlawalsohasapieceofpropertynexttohisandheagreeswithLong’sletter.Mr.PuckettaskedforcommentsfromtheboardandatthistimeBobreadhismemofromthePlanning&ZoningMeetingwhenthedevelopmentofthisstreetandinitiallotsfirstcameupin1992anditwaspointedouttothemthenthattherewasaproblemwiththislotanditcouldbecorrectedbeforeplansfinalizedtogivethislotmorebuildingspacebyshorteningthestreet.Thiswasnotdone,thustheproblemisfacingusasavariancerequestthisevening.BobsaidthiswasadesignerrornotaThurdenonthelot.JimMcCluresaidthatbeingadesignfailureitisnotuptotheboardtocorrect.Mr.PuckettcalledforanymorecommentsoramotionandRobertVanIderstinemovedtodenythevariancerequest,JimMcCluresecondedandmotioncarriedunanimously.Case#605WendellBarnhill/GeoNet-SpecialExceptionUse7625ParkerRoad-toerectacommunicationstowerWendellBarnhillspokesayingitwashisproperty,heintroducedPaulReynoldsofGeoNetwhosaidtheywerelocal,outofMobile,thattheywishedtoerectacommunicationstoweronMr.Barnhill’spropertyclosetoRockCreekthatwouldservebetweenDaphneandFairhopeandthebayarea.ThattheynowhaveleasesforantennaesontwotowersinFairhope,heintroducedBarryLuftonfromtheirengineeringgroupwhotalkedatlengthaboutwhatplanned.Heshowedpicturessayingitwouldbeconcrete,150ft.Tall,asmallcompoundthatwouldbefenced,holdacoupleofmetalbuildings,verylowprofile.Healsoshowedpicturesofsurroundingareaandwhatnowthere.Andsaidthatitwouldbeverylowtraffic,onlymaintenancepeople.Hesaidthetowerwouldbeembedded35feetandmeetsallcodes,thatitisgovernedbyfederalcodenumberEIA222Fandwouldnotrequirelighting.AGaryHicksspokesayinghelivesinRockCreekandhasnoproblemwithwhatplanned.He‘hadaöhancetolookattheinformationregardingit.AKimBurdettewholiveson SouthDrivequestionedwhetheritwouldinterferewithothertransmissions,andtheysaidno.ItwasalsoaskedifthetowerwouldbevisiblefromRockCreekandMr..Luftonshowedadrawingtheyhadmadethatitwouldnotbevisibleduetopresenttreebuffer.Itwasalsobroughtupwhatifpropertysoldandtreescutdownandcouldthisaffecttheirpropertyvalues.Theyanswerednotothisdevaluingtheirproperty.AMr.JohnsonspokesayinghelivedonHighRidgeRoadandaskedthemagainifthisrequiredlightingandtheysaidno,nothighenough.TherebeingnofurtherquestionsJimMcCluremovedtograntthespecialexceptionuseasrequested.Whenthevotewascalledforonashowofhandsitwasasfollows:for-J.McClure,RobertVanIderstine,JoePetties.Against-CharlesSeniorandabstainClaudePuckett.Ittakesfourconcurringvotesformotiontopasssoitwasdenied.(LoriMontz.205YoungStreet.SpecialExceptionUse-DayCareMs.Montzsaidshewouldliketorunahomedaycareandthatshewouldhave6childrenthatshekeepsduringtheday.Shewasaskedwhathoursandshesaidfrom7:30AMto5:30PMfivedaysaweek.Shewasaskedifshecouldkeepmoreandshesaidifshe.hiredasecondpersonthatshecouldgoupto12inherhome.Mr.LunsfordpointedoutthatshehadbeenkeepingchildreninaformerresidenceonSectionStreetandshesaidyesshehad.TheresidencenowisacrossfromStimpsonField.Mr.Puckettaskedifanyonehadanyquestions.Mr.Boromsaidhispropertyabutsintherearandhehadnoobjection.Theresidentat201YoungStsaidheandhisneighborat203YoungSthadnoobjection,theywereusetochildrenat.StimpsonField.Therewerenomorequestions,andRobertVanIderstinemovedtograntspecialexceptionuseasrequestedwiththeconditionthatnomorethansixchildrencouldbekept.JimMcCluresecondedandmotioncarriedunanimously.ôiLindaBadinger,556MiddleStreet,2.8ft.SideyardvarianceMs.Badingerspoketotheboardsayingshehadthepropertyat556MiddleStreetandthatsheisseekinga2.8ft.Sideyardvariance.Bobwasaskedhowmanyfeetisrequirementandhesaidtoputacarportoverexistingdrivewayitisonlyfivefeetsideyardrequirement.Mr.andMrs.ArchieLawrencewerepresentandsaidthatthisisoverontheirproperty.ItwasexplainedtoMr.andMrs.Lawrencethatwhattheyaretalkingaboutisashedthathasbeenremovedandiftheyhaveaboundarydisputethatthisisnotthebodytotakeitto.ThatwewouldaddressMs.Badinger’scaseasitappliestoher.Ms.Badingersaidthatsheelectedtoputthecarportupinhopesofstoppingafloodingproblemthatshehasonherproperty.Thatthewaterstandsaroundthebottomofherconcretehouseonthissideanditrotstheboardsinside.Thatshethoughtthatshecouldputtheconcretecarportanditwouldhelpalleviatethisproblem.Sheadmittedthatshedidstarttheworkwithoutfirstobtainingpermitsthough.Thatshecompletelyforgotaboutthis.Itwasestablishedthatshehadreccvcastoporderonthisproject.Mr.PuckettcalledforanyfurtherquestionsorcomrnentTherewerenone.HecalledforamotionandRobertVanlderstinemovedtoapprävevariancerequestasaskedfor.JimMcCluresecondedandmotioncarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
