TheFairhopeBoardofAdjustments&AppealsmetattheCityAdministrationBuilding,161N.SectionStreetonMonday,December21,1998at5:00PM.Present:JimMcClure,Vice-Chairman;membersJoePetties,BobGentle,CharlesSenior.BobLunsford,ZoningEnforcementOfficer,BettyRivenbark,SecretaryTheminutesoftheNovember16,1998meetingweredulyapprovedonmotionbyBobGentle,secondedbyJoePettiesandunanimouslycarried.Case#619DanielHerzoq,114MagnoliaAvenue,3ft.sideyardvariancerequestMr.McClureaskedtheapplicanttocomeandpresenttheircaseandClayAdams,anarchitect,saidhewasnottheapplicantbutrepresentingthemandsaidthebestwaytoexplainwastoshowthemthedrawingofthehouse.Heexplainedthatitwasaverynarrowlot,only55feetinthefront.Thatthefloorplanisonly20ft.wide.Thatthehouseisalreadyexistingnextdoor.Thattheyarenotoverthealloweddensityandafairlysimplesolutionforanadditionfromanarchitect’spointofviewwouldbetogostraightback.Mr.McClureaskedforanyquestionsfromtheboardandCharlesSenioraskedhowlongtheHerzog’shadownedthehouseandtheyrespondedtwoyears.HeaskediftheyboughtitknowingthelimitationsandMr.Herzogsaidno,heknewofthejoginthepropertybutwasunawarethattherewouldbeaproblemifhetriedtoexpand,but,heguesseditwasaself-imposedhardship.Clayspokeagainsayingthattheyarenotoverthedensityrequirementornearthe35ft.rearyardrequirement.Bobwasaskedifhehadanyproblemswithwhatproposedandhesaidno,thatthejoginthepropertylinewaswhatcreatedtheneedforavarianceandwouldnotevenbeseenfromthestreet.Mr.McClureaskedifanyoneintheaudiencewasopposed,therewasnoone.AmotionwascalledforandBobGentlemovedtograntthevarianceasrequested.JoePettiessecondedthemotionanditcarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
