HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,April21,1997at6:30PMattheCityAdministrationBuilding,161N.SectionStreet.Present:ChairmanClaudePuckett,membersRobertVanIderstine,JoePetties,BobGentle,JimMcClure,SusanCunningham.BettyRivenbark,SecretaryandBobLunsford,ZoningOfficerwerealsopresent.TheminutesoftheMarch24,1997meetingweredulyapprovedonmotionbyJimMcClure,secondedbyRobertVanIderstineandunanimouslycarried.Case#592(Cont.)KennethRobertson,120VolantaSt.,16ft.sideyardvariancetobuildacarportThiscasewascarriedoverfromlastmonthasthiswasrepresentedtobea6footsideyardvarianceandwhencamebeforetheboarditwasdeterminedthatasitwasacornerlot(eventhoughMobileStreetisunopened)thatitwouldrequire20ft.sideyardinsteadof10feetonnormallot.Adjacentneighborswerenotified.Noonewaspresenttorepresentthiscasethereforeitbecameamootpoint.Case#593JoeFram,300GastonAvenue,SpecialExceptionUseMr.Framaddressedtheboardsayinghehadtriedtogetthisre-zonedandintheprocessfoundthatthisishotwhathewishedtodo,thatwhathewishestodoistotaketheoldbuilding(usedtobegrocerystore)remodelitandliveinitandusesmallportionforantiquebusiness,thathewillbeimprovingit,cleaningupthelotanditwillonlybeanimprovementtotheneighborhood,thatitwillnotcauseanyundueheavytrafficashewillbedoingmostofhisbusinessbycomputer.HehadcometoMr.LunsfordtoapplyforaHomeOccupationlicenseandhadbeenrefused.TherewassomeconfusionregardingtheapplicationasitwasadvertisedasapplicationforSpecialExceptionUseforhomeoccupationanditreallyshouldhavebeenadvertisedasSpecialExceptionUseappealallegeddecisionofZoningEnforcementOfficer.BobexplainedthatherefusedtoissuealicensebecauseitspecificallystatesintheordinanceSection7.64HomeOccupations....thehomeoccupationshallbeoperatedonlybymembersofthefamilyresidingonthepremises...thatinthiscasethebuildingisemptyandwouldrequireagreatamountofrestorationtoevenmakeitwhereitcouldbeoccupied.Thattheboardcouldeitherupholdhisdecision,modifyitoroverturnit,thatsincethisrequiredapublichearingonhiszoningrequesthefeltitshouldbeheardinaopenmeeting.Mr.Framsaidbeforehespentagreatdealofmoneyrestoringthebuildingthathewishedtoknowifhecouldgetahomeoccupation.Hewastoldthatisnothowtheprocessworks.Mr.Framsaidhehadbeentryingtodothissincethebeginningoftheyearanddidnotunderstandthatheshouldbelivinginitbeforeapplyingforlicense.Bobhadwrittenhimaletter(infile)andsentacopyoftheordinanceexplainingthistohimbeforeheevenfiled.Mr.Puckettcalledforcommentsfrompeoplewhomightbefortherequest.AgentlemanrepresentingtheFirstBaptist Churchsaidthattheywerenotagainstitbutalsonotforit.Aladythatsaidshedoesnotliveherewantedtosaysheisforit,thatitwoudl”definitelyhelptheneighborhoodbyimprovingtheappearanceofthesite.Anotherladyaskedwhatwouldhappenifsold,wouldthistransfertonewowner.Shewastoldno.Someoneelseremarkedthatifgrantedtheprecedentwouldalreadybeset..,shewastoldno,thateachcasestandsonitsownmeritsbutifotherpeopleintheneighborhoodaskedforhomeoccupationsandqualifiedtheycouldgetthem.Anothergentlemanspokesayinghemovedherebecauseeverythingwasestablishedandnotoverpopulatedandcommercializedandthiswouldbeputtingcommercialrightinhisneighborhood.Acoupleofothersspokesayingtheywantedittostaylikeitis,ifgrantedthereiscertaintobemoretraffic.JoeFramspokeagainsayingtherewouldbenooutsidesign.JimMcClureaskedwhowouldbeprincipleoccupantandMr.Framrespondedheandhiswife.Claudesaidagainthattheboard‘sauthorityregardingthiscaseistorespondtoBob’srefusaltoissuealicenseandthatisissue.Hecalledforanyfurthercommentsoramotion,RobertVanIderstinesaidthattheordinanceisclearandmovedthattheboardupholdBob’sdecisionfordenialofthislicense.JimMcCluresecondedandmotioncarriedunanimously.Case#594JaneCrafts,354FigAvenue,14footrearyardvarianceMrs.Craftstoldtheboardthatshewishestoputaroofoveranexistingsundeck,thatitis24yearsoldandisslippery,becomesdangerouswhenwet.Shesaidshehasa100ft.gardenleaseintherearandhasaprivacyfenceallaroundproperty.SheshowedadrawingofwhatsheisprOposing.Shewasaskedifsheplanstoenclosethisandshesaidno,haveacoveredpatio.Mr.Puckettcalledforanycommentsfromtheaudience,therewerenone.HeaskedBobifhehadanycommentsandBobsaidhehadnoproblemwithit.HecalledforamotionandJimMcCluremovedtoallowvarianceasrequested.BobGentlesecondedandmotioncarriedunanimously.AtthistimeRobertVanIderstinemovedtoapprovethenewdecisionformthathadbeenpresentedatthelastmeeting.JoePettiessecondedandmotioncarriedunanimously.Alsodiscussedwasthechangingofthemeetingtimefrom6:30PMto5:00PM.Mr.PuckettcalledforamotionandJimMcCluremovedtochangetimeto5:00PMonthe3rdMondaynightofthemonth.BobGentlesecondedandmotioncarriedunanimously.JimMcCluremovedtochangetheby-lawstoreflectthistimechange.RobertVanIderstinesecondedandmotioncarriedunanimously.Therebeingnofurtherbusinessmeetingwasdulyadjourned.
