HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,May20,1996at6:30PMattheCityAdministrationBuilding,161N.SectionStreet.Present:ChairmanPeteWalker;membersRobertVanlderstine,JimMcClure,JoePetties,CharlesSenior.RobertLunsford,ZoningOfficerandBettyRivenbark,SecretaryTheminutesoftheApril15meetingwereapprovedasprinted(ltwasnotedthatanalternatemadethemotiontodenythevarianceforBobPopebutthatthevotewouldnotchangeifithadbeenre-votedsothemotionandvotewillstandasitis).Case#582VivianSmith,54N.InglesideStreet(cont.fromApril15,1996meeting)Mrs.Smithaddressedtheboardsayingsheinadvertentlyleftoffpeoplefromherlistwithin300ft.there.yTheneedforrenotificationandcontinuancetothismeeting.Thatshehastalkedwithagoodamountofherneighborsandshehadalettertopresentwithsignaturesofpeoplenotobjectingtoherhavingthebed&breakfastinherhouse(letterinfile).Shesaidshehasboughtthehousefromherex-husbandandiswishingtosupplementherincomebyofferingabed&breakfastinthegarageportion,further,shewouldappreciateanyconsideration.Mr.WalkeraskedifanyoneelsewishedtospeakandAndrewLindsaycameforwardsayingheisacrossthestreetfromMrs.Smiththatheboughthishouse19yearsagoandrenovatedit.ThatheisconcernedabouttherapLdgrowthFairhopeisexperiencingasheissureweallare,healsohadaletterfromneighborswithin300ft.whoobjected(infile).Hereadtheletterandpresentedittotheboard.HesaidhefeelsthatthechangewouldweakentheintegrityoftheR-1neighborhood.MacMcCawleyspokesayinghehadadifferentinterpretationofordinancethanwhattoldbuthesaidhehadindependentlydoneasurveyofhotelsandbed&breakfaststhatwenowhaveandthattheyonlyhaveabouta40%occupancy,thatthistellshimthatwedonotneedanymoreovernightlodginginFairhope.VickyLhsayspokesayingshehadnothingpersonalagainstMrsSmithitwasjustthatwhenyoumakeanexceptionitmakesiteasiertodothatthesecondtime,thattheyaresoclosetoFairhopeAvenueandbusinessdistrictthattheywouldliketopreservetheirresidentialneighborhood.LisaBishopspoke,MrsSmith’sdaughter,sayingthatherparentsmovedthere13yearsagothatshehasmanyfondmemoriesinthathouseandthathermotherisonlytryingtosupplementherincomesincesheandherfatherhavesincedivorced.ABrendaLambertspokesayingshehadthepropertyadjoiningMrs.Smith’sandthatshehasabeautyparlorinherhomeandseesnoproblemwithwhatMrs.Smithproposes.Vivianspokeagainsayingthatthiswillnotchangetheneighborhood,thatshefeelssomeareunderthemisconceptionthatitwill,thateachcasestandsonitsown.Mr.Walkerreiteratedthatandaskediftherewereanymorequestionsorcomments,therewerenone,hecalledforamotion,RobertVanIderstinemovedtodenyspecialexceptionuserequest.CharlesSeniorsecondedandmotioncarriedunanimously. Case#583DavidBarnette,515N.SectionStreet-Varianceforstudyinatticof2-storyhomeBenCummings,architectforMr.Barnette,spokeshowingtheplanshehaddrawnedupwhichreflectedthe1!?storytheywishedtouseasastudyintheattic.Heiswithintheallowable30fttheplansare28ft.HesaidMr.BarnetteworksoutofhishomeandjustrecentlyMr.Barnettelearnedthatshecouldtooworkoutoftheirhome,sothisareawouldbeusedforherwork.Bobcommentedthattheyfallwithinthedefinitionoftwostoryandrequirements,thathepersonallybelievesthatbystayingwithinthe30ft.requirementtheycanuseatticaccessanywaytheywish,occupyornot,willnotchangeappearanceoutside.DavidBarnettespokesayingthiswasanafterthoughtbutthehouseiswithinboundariesandtheyarekeepingalotofgreenspace,hegrewuphereandwantstokeepitnice.Mr.Walkercalledforanymorequestionsorcomments.Therewerenone.Hecalledforamotion.JimMcCluremovedtograntvarianceasrequested.RobertVanIderstinesecondedandmotioncarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
