TheBoardofAdjustments&AppealsmetMonday,June17,1996,at6:30PMattheCityMunicipalComplex,161N.SectionStreet.Present:ChairmanPeteWalker;membersRobertVanIderstine,ClaudePuckett,JoePetties,CharlesSeniorTheminutesoftheMay20,1996meetingweredulyapprovedonmotionbyClaudePuckett,secondedbyRobertVanlderstineandunanimouslyCarried.Case#584B.ChalmersFrazer,107N.SummitStreet31/2ft.sideyardvarianceMr.Frazerspokeonhisbehalfsayingheboughtthehouselastyearandithasanoldexistinggaragethatistotallyunuseable,thathehaditinspectedanditisnotworthsavingbecauseitisinsuchastateofdisrepair.Hesaidhehadstudiedvariouspossibilitiesandcomeupwithpossiblyputtingacarportovertheexistingdrivewaywhichwouldtakecareoftheircarsandgivethemaccessthroughtheirkitchendbor.Hesaidthatthisisanarrowlotandiftheycoverthedrivewaytheycannotstaywithinthe5ftrequired.Thathewouldremovetheoldbuildingandbringthedrivewaytotherearandthattheywouldbewithintherequirementsintherearyard.Mr.Walkeraskedifanyonewishedtospeaktothis.Mrs.Ewingwaspresentandsaidsheisforit.Mr.Walkercalledforanyquestionsfromtheboard,therewerenone,andthenhecalledforamotion.ClaudePuckettmovedtoapprovevarianceasrequested,RobertVanIderstinesecondedandmotioncarriedunanimously.Bobatthistimementionedthecopiesofproposedamendedby-lawsthatwehadpassedouttothemembersbeforethemeetingaskingthattheylookoverthemandwewilladvertiseforapublichearingonthe22ndofJulyandifnoproblemstheywillbeadoptedatthattime.RobertVanlderstinemovedtoadvertiseforJulymeetingatwhichtimetheywillbeconsideredforadoption.ClaudePuckettsecondedandmotioncarriedunanimously.Bobalsobroughttotheboard’sattention2casesthathadbeenheardin1993regardingspecialexceptionuses,onebeingCharlesSmithforrequestforBed&Breakfast;theotherbeingMaryAnnLapezealsorequestforBed&Breakfast.Hesaidthatheisnotaskingforare-hearingbutthequestionhascomebackaretheystillviableuses?Thatnousewasmadeineithercaseandnotimelimitationwasputonwhentheseweregrantedthespecialexceptionuse.Thattheonlyprohibitionfromtheby-lawswouldbeifnotusedin6monthsnobuildingpermitcouldbeissuedandnobuildingpermitwasrequiredineithercase.Hesaidunlesstheboardtellshimdifferenthewouldgoaheadandendorsebothapplications.HesaidinthecaseofMr.Smiththerewasoneotherconsideration,someonehadnotbeennotified,thatthestatuteoftheStateofAlabamaonlyrequiredtheboardtoadvertisethisnotice,thatitisthezoninglawthatrequiresnotificationofresidentswithin300ft.andtheappellatecarriestheburdenoffurnishingnamesandaddressestotheboard.Andinthiscasetheboardactedtothebestofitsknowledgeinitsconsenttoissuethelicense.ClaudePuckett saidthattheboardneededsomecontrol,possiblywhenchangeofownershiphavetoreapply,woulditbepossibletopassaresolution-ifnotusedin6monthshavetocomeback.Hesuggestedgettingwiththecityattorneyandgetanansweronthis.Hesaidheobjectedtospecialexceptionusebeingpasseddownfrompersontoperson.Mr.Walkerpointedoutthatwhenadoptamendmentstothebylawsthiswillbetakencareof.HesaidBobdidneedtoanswerthesetwo,ifwedenywhatbasisdowedenyon?BobsaidtheonlyquestionhehadforTutonthesetwowasdueprocessinthenotificationonMr.Smith’scase.ClaudequestionedthefactthatMrs.Smithhadnowcomebackontheircase.AMr.JimCurentonspokeforMrs.Smithsayingshewasjointownerofthepropertywhenthecasecameupin1993.Claudestillmaintainedthiswasachangeinownership.BobsaidhecouldgetwithTutWynne,thecityattorney,inthenext2-3daysandhavehimhavesomethingforusatthenextmeetinginJuly.Allagreedthiswouldbesatisfactory.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
