Home My WebLink AboutMinutesTheBoardofAdjustments&AppealsmetMonday,July15,1996at6:30PMattheFairhopeCivicCenter161N.SectionStreetPresent:ChairmanPeteWalker,membersClaudePuckett,RobertVanIderstine,JimMcClure,JoePetties,CharlieSeniorRobertLunsford,ZoningOfficerandBettyRivenbark,SecretaryIheBoardonmotionbyClaudePuckett,secondedbyRobertVanIderstinemovedtoapprovetheminutesoftheJune17,1996meeting.Mr.Walkersaidthattonightwasthenightweweretoconsidertheadoptionoftheamendedby-lawsfortheBoardofAdjustments&Appeals.Hesaidhewouldentertainamotion.RobertVanIderstinemovedtoadopttheamendedbylawsaspresented(copyinfile),JimMcCluresecondedandmotioncarriedunanimously.Mrs.McClintocaskedwhatwerethechangesandMr.Walkersaidthatintheamendedby-lawsofficerswillbeelectedinOctober,thatclarificationisbeingmaderegardingspecialexceptionuses.AtthistimeTutWynne,theCityAttorney,whowasaskedtobepresenttonighttoclarifywhatBobhadexpressedattheJune17thmeeting...hehad2casesofspecialexceptionusesthathadbeenactedonin1993,MaryAnneLapezerequestingaBed&BreakfastandCharlesSmithrequestingaBed&Breakfast,bothintheirhomes,bothhadbeengrantedbuthadneverbeenactedon.Ourbylawssaythatifvariancesorspecialexceptionsshallexpireiftheapplicantfailstoobtainabuildingpermitwithin6monthsfromthedateofauthorization,but,inboththesecasesnopermitwasneeded....hisquestiontoMr.Wynnebeingaretheystillviableuses?Thatnousewasmadeineithercaseandnotimelimitationwasputon.Mr.Wynnesaidhewasaskedtolookat2questions.Onebeingtheallegedfailureinnoticerequirement.Hesaidinreviewingthestatecodethat“reasonablenotice”isallthatisrequiredandthatwasmetbutitistheCityordinancethatdefinesthisfurtherandonepersonsaidhedidnotgetnotice,thatthenoticeispublishedinthenewspaper.InthecaseofMr.Smithsubstantialcompliancewasmade.Mr.Wynnesaidinresearchinginotherstates,citiestheyhadatimelimitandthatthenewby-lawswillhaveatimelimit,6months.ThatMr.Lunsfordcouldendorsebothapplicationsasstillbeingvalidinthiscase.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
