WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,February26,1996at6:30PMattheCityMunicipalAdministrationBuilding,161N.SectionSt.Present:ChairmanPeteWalker;membersRobertVanIderstine,JimMcClure,JoePetties,CharlieSenior.RobertLunsford,ZoningEnforcementOfficerandBettyRivenbark,SecretaryTheminutesoftheJanuary2.1996meetingweredulyapprovedaswritten.Case#577RogerBrade,257MorphyAve.AppealfromadministrativeorderMrsBradespokesayingthatsheisretiringandthatsheisabeauticianandwouldlikepermissiontodoafewlongtimefriendshairinherhome.Wheretheproblemliesinthatthezoningordinancerequirecompleteseparationfromthelivingareaofthemainbuildingandstatecosmetologyrequiresitbeapartofthemainlivingarea.Severalneighborsspokesayingtheyonlywishedtobeassuredthatthiswouldnotchangetheneighborhoodtocommercial,thatcommercialisonlyablockdownthestreetnow.Oneneighbor.TonyBradfordaskedifthisapprovedwoulditbepassedonandtheanswerisyes,itrunswiththeproperty.Mr.Walkercalledforfurtherquestionsfromtheboardoraudience.HesaidwewouldvotetoeitheroverrideBob’sorderorupholdit.RobertVanIderstinemovedtoupholdBob’sdecision,JimMcCluresecondedandmotioncarriedunanimously.Case#578NorborneStone,304GeorgeStreet,variancefromsection7.6152ChipStonespoketotheboardandtoldthemhehadpurchasedthehouseat304GeorgeStreet.Hehandedoutadrawingshowingthehouseonthelot,thepoolintherearoftheyyeardanddepictedwherehewishedtoaddon.Hehadadvertisedforavarianceinthefronttoputa7’porchonthefront.Bobcommentedthathewouldbeallowedtoarriveatanaveragedistanceonthefrontsothe7’heisrequestingwouldnotbeavarianceissue.Mr.Stonesaidontherearhewishestoadda16’additionfromtheexistingbackwallgoingthelengthofthehouse.Thiswouldhouseamasterbathroom/closetarea,breakfast/sittingroom,utilityroomandchildren’splayroom.Thiswouldputthebackofthehouseinsidethe10’minimumsetbackfromtheexistingpool.Hesaidheisnotgoingtoencroachonhisneighborsandiswellwithinthesetbacks.Bobmentionedhewouldnotbeallowedtoputanelectricaloutletwithin15ft.ofthepoolarea.Mr.Walkercalledforcomments.AWilliamHarbisonof110NicholsSt.spokesayinghehadnoproblemwithwhatplannedinthefrontbutobjectedtobackplansonpool.Chipansweredbysayingthattheadditionisonthemselvesnotanyoneelse,thatisislandscapedandplanstoputaprivacyfence.Mr.Harbisonsaidnonethelessheobjected.Itwasdeterminedthatbasicallyheisaskingfora6’variance.Therebeingnofurtherquestionsorcomments,RobertVanlderstinemovedtoapprovethevarianceasrequested.JimMcCluresecondedandmotioncarriedunanimously. .1Case#579JoAnnGrisham,205FairhopeAvenue.varianceon-siteparkingClayAdamsspokesayingheisworkingwithMs.Grishamandtheywouldliketoreplacethe1500sqftbuildingthatisthere,havearetailbusinessw/2L100sqftand2residencesonthetop.HesaidhehadtalkedwithBobandshowedhimtheplan.Hesaidtheycouldhavecomecloseronthesidesbutdecidednotto.Heshoweddrawingdepictingbeautifuloaktreeinbackthattheywishedtosaveandthatiswhatleduptovariancerequestofafewlessparkingspacesthanrequired.Whatheisshowingis5onsite(13wouldberequired)buthesaidthereisparkingallstreetinfront.Hesaidthetreecouldberemovedtogetrequiredparking.Mr.Walkercalledforanyonewhowishedtospeak.ABillSimmonsobjectedtothewaytheparkingwaslaidoutandClayagreedwithhimsayinghewishedtoamenddrawingbutthiswasnotpartofvariancerequest.TrishaLoPortospokesayingitwouldbeacrimetocutthattreedown.Mr.Walkercalledforanyfurtherquestionsoramotion.JimMcCluremovedtoapprovevarianceasrequested.MotionwassecondedbyRobertVanIderstineandcarriedunanimously.Case#580BobPope,BeachDrive,AppealfromorderofzoningofficerBobPopetalkedtotheboardsayinghewishedtobuildfromthefrontpropertylinetothebackpropertylinewitha5ft.sideallowance.Hesaidhispropertyisrightnexttothevolunteerfiredepartmentandheplanstobuildaresidencethere.Hewouldputhisparkingunderneathandliveonthefirstfloor.Hesaidwhenheboughtthepropertythereitshowedavariancegrantedin1977.Butsincethattimehetoredowntheoldstructureandbuiltanewoneabout10yearsago.Whatheisbeingtoldisthevariancewentwhentheoldbuildingwastorndown.Hesaidthebeautyparlor’snorthedgeislocatedhalfwayonthepropertyandhewouldneverhadputitthereifhethoughthecouldOtilizetherestoftheproperty.BobLunsfordsaidhehashadanumberofconversationswithBobonwhathecanandcannotdo.Thathedoesnotdoubtforamomentthathethinkshehadavariance.Mr.Walkersaidahardshipwouldhavetobeshownthatwasnotaneconomichardship.Mr.Popesaidhepaidapremiumpriceforthispropertyanditcertainlywouldbeahardshiptohim.BobLunsfordsaidhehadtalkedwithTutWynnebutdidnothaveanythinginwritingonthis.Mr.WalkeraskedifMr.Popewouldbewillingtohavethispostponedfor30daysinordertogetwithTutWynne.BobLunsfordandanyoneelsehewishedtobringtodiscussfurther.Mr.Walkersaidwemightbeinabetterpositiontodiscussin30days.Mr.Popesaidhewouldagreeto30daypostponement.Case#581JohnNelson,DelamareSt.heightvarianceGeorgeRoberdsspokeonbehalfofMr.Nelson.HesaidthisisthepropertyrightbehindthecurrentMaryAnn’sbuildingwhichfrontsonChurchSt.Hesaidthisisnotasmuchaheightvarianceasmuchasclarificationoftheordinance.Heshowedtheboardadrawingandwasokeyontheheightbuttheywanttousethespaceintheatticfora3rdstoryandtheordinancesaysnomorethantwostories.Georgesaid35ft.andBobquestionedthissaying30ft.iswhatallowedhere.Georgeaskedifhecouldmodifyhisrequestto35ft.anduponlookingatwayadvertiseditcouldbeallowed.Bobsaidthisdoesfitinwithwhatinthatarea.TrishaLoPortospokesayingshehasnoopposition.Bobsaidprobablydoubtyoucouldtellthedifferencewithotherbuildings.Therequestwasamendedtonomorethan35ftandallowtheroofareatobeusedashabitablespace.Mr.Walkercalledforanymorequestionsorcommentstherewerenone.HecalledforamotionandJimMcLuremovedtoapproveamendedrequest,RobertVanIderstinesecondedandmotioncarriedunanimously.
