HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,December16,1996attheCityAdministrationBuilding,161N.SectionStreetat6:30PM.Present:ClaudePuckett,JimMcClure,JoePetties,RobertVanIderstine,CharlieSenior.BettyRivenbark,SecretaryandRobertLunsfordZoningEnforcementOfficerTheminutesoftheAugust19.1996meetingwereconsideredandapprovedaswrittenonmotionbyJimMcClure,secondedbyRobertVanIderstineandunanimouslycarried.Anelectionofofficerswasheldasfollows:-ForChairman-ClaudePuckettwasnominatedbyRobertVanIderstine,JimMcCluremovedthatnominationsbeclosedandMr.Puckettwaselectedbyunanimousvote.ForVice-Chairman-JoePettiesnominatedJimMcClure,RobertVanIderstinemovedthatthenominationsbeclosedandMr.McClurewaselectedbyunanimousvote.Continuedfromthelastmeetingduetoalackofaquorum-Case#587MikeStuardi,454IvyCircle.20ft.rearyardvarianceMikeStuardiaddressedtheboardsayingthathisresidencenowhasanon-conforming8footrearyardvarianceandthatheiswishingtoextendfurtherintotherearyardfor12additonalfeet.Thathewishestoaddautilityroomandporch.Claudecalledforcommentsfromtheaudienceandtwowomenspoke,onesayingthatthiscouldsetaprecedentgrantingspotvariances,andtheothersaidshewishestopreservetheneighborhood,keephomogeneous.Bobspokesayingthatthiscanbeshownasahardshiponthepropertyasthiswasoriginallybuiltwitha62ft.frontyardandthiswasdonepriortoadoptionofOrdinance557,thatitisaself-inflictedhardshipbutthattheappellantasabuyerincourseinheritedthehardship,butdidnotcreateit.Hesaidfurtherthatitistheminimumpracticalandamounttoanincreaseof13percentandresultsintotallotcoveragefarbelowthemaximumof5037squarefeet.RobertVanIderstineaskediftherewasanywaytoputtheadditiononthefrontandMr.Stuardirepliednotwithoutdoublingtheexpense,thattheywishedtotieintothepresentroofline.FurtherdiscussionledtoamotionbyJimMcCluremovingtograntthevarianceasrequested,RobertVanIderstinesecondedthemotionanditcarriedunanimously.Case#588AppealbyBudHamiltonallegingerrorinissuanceofbuildingpermitNumber96-7655toWeezieBrabnerat110AtkinsonLaneAllenChasonspokefortheHamiltonsandaskediftheboardwishedtoviewphotographsMr.Puckettsaidno,thattheyhadallbeentothesite.Mr.PuckettcalledforanycommentsfromtheaudienceandthentoldMr.Chasonhecouldproceed.Hesaidthisisanon-conforminguse,thattherehadbeenalterationsapprovedin1986anextensionofthebuildingtowardsstreet.Thatitiswithinafewinchesofthepropertylinewitha6”overhangontheHamiltonproperty.Thatthequestioniswhethertoleaveitlikeitisorchange.Hereadportionsofthezoningordinance414Non-Conformanceandsaidthisboardshouldendeavortoeliminatenon-conforminguses.Claudesaidtheordinancealsohasprovisionsthatitcanbealtered.Mr.Chasonsaidthatundertheordinanceanon-conformingusecanbestructurallyalteredandexpandedbut.mustconformwiththeside,frontandrearrequirementsnHt Thatifyoucan’textendhorizontallyhowcanitbeextendedvertically.Thatdoesnotmakesense.Thattheordinancespecificallyaddressesthissituation.Bobread4.1111sayingabuildingcanbealtered.Claudesaidin1986Ms.Brabnerwasgivenapermittoreplacethebuildingandwhenshecamein1989itwasdecidedherrequestwasamootpoint.Mr.ChasonsaidtheHamilton’sarerequestingnottomakeitworsebyallowinghertogoupanotherstory.Mrs.Brabnerstatedherchangesweremadeonlytoanexistingbuilding.ClaudePuckettaskedherifanychangemadetotheslab,shesaidno.Mr.Chsonsaidshecan’tgouporoutonthepropertyline.BobLunsfordsaid4.4addressestheeliminationofnon-conforminguses,thatistheintentoftheordinance,addressesuse.Hisinterpretationwhenissuedpermitwastha’titagreedwiththeheightordinance.Mrs.Hamiltonsaiditlookedtoherlike2ft.hadbeenaddedtothebuilding.ClayAdams,anarchitect,saidhehasbeenworkingwithMrs.Brabnerandthattheyhavetrimmedtheoverhangandhavefurtherdesignedthebuildingwhere•therewillbenorunoffontheHamiltonproperty,thatitwillrunoffontheBrabnerproperty.HesaidMs.Brabnerhasoneofthenicesthousesintheneighborhoodandwoulddonothingtoinjuretheintegrityoftheneighborhood.Thatwhatdesignedisintotalconformity.Thatthedesignisagoodsolutiontowhatisalreadyasub-standardlot.InanswertoMs.Hamilton’sallegationthatthebuildinghasbeenaddedtoBobsaidhehasnotseenanyevidenceofthis.Mr.Puckettcalledforanyfurtherquestionsfromtheaudienceorboard.Therewerenone.Hecalledforamotiontoapproveordeny.Amotionwasnotforthcomingthereforethebuildingpermitwillstandasissued.Mr.Wynne,theCityAttorneywaspresentandcautionedtheBrabner’sthatthereisa15dayappealtimeandthattheyshouldwaituntilthistimepassesbeforecontinuingconstruction.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
