HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,August19,1996at6:30PMattheCityAdministrationBuilding,161N.SectionStreetPresent:ChairmanPeteWalker:membersRobertVanlderstine,ClaudePuckett,JoePetties,JimMcClure,CharlieSenior,BobLunsford,ZoningOfficerandBettyRivenbarkSecretaryMr.Walkercalledthemeetingtoorderandaskediftherewereanyadditionsorc.orrectionstotheminutesoftheJuly15meeting.Therewerenone.ClaudePuckettmovedtoapproveaspresented,JimMcCluresecondedandmotioncarriedunanimously.--BobLunsfordnotedfortherecordthatattheJulymeetingCityAttorneyTutWynnegavehisopiniononthebestknowledgethathehadavailableatthetime.Hehassincebeenapprised‘offurtherinformationrelatingt’oMrs.Smith’scaseandbasedonwhatpresentedsincethatmeetingreversedhisopinion.ThatasofthismomenttheSmithcaseisnotfinallyresolved.Case#586WadeLott/JamesGilheartSpecialExceptionUseGreenoRd&AutumnDr.JamesGilheartspokeonbehalfofWadeLottsayinghewishedtoopenafamilyrecreationcentertoincludeminiaturegolfandbattingcagesandthatitwouldhaveaconcessionstandwithan.areaforbirthdayparties.Thatheisorientingthistowardsfamilies.Hewouldhaveasecurityfenceonthenorthandeastsidea60carparkinglotontheeastsideandentrance/exitwouldbefromAutumnDrive,.haveapicketfenceonthefront,lighted,andhewouldadheretoallthecity’srulesandregulationsincludinglandscaping.Thathealsohasanoptiononthepropertyadjoiningthisanditwouldserveasabuffer,thatitiszonedR-4butwhereheisputtinghiscenterisB-2.Thatitwouldbeavailabletoschools,churchesandprivatepartiesbutthatnoalcoholorprofanitywillbetolerated.Mr.WalkeraskedMr.Lunsfordifhehadanythingfurthertoofferandhesaidno.Mr.Gilheartshowedamapofthetwolotshewastalkingaboutthathehaslittleoveranacre,254’x400’lookingatthemap.Mr.Gilheartwasaskedhisplannedhoursofbusinessandsaidnothingdefinitebutpossibly11AMto9PMweeknightsand11AMto12PMweekends.Mr.Walkeraskediftherewasanyonepresentfromtheneighborhoodwhoobjectedorwishedtospeak.DotCainofferedthatshewasconcernedaboutthetrafficandthelocationbeingnexttoretirementareas.Thecommentwasmadethatthismightdrawsomeundesirablebusinesstomoveinnext.Mr.Walkercommentedthatsupplyanddemandwilldetermineifsuccessfulorwhatwillcomenext.Acommentwasmadeonplansforaesthetics.Mr.Lunsfordsaidweshouldnotstrayintoareaswecannotcontrol,thatthecitydoeshaveplanstoputinsidewalksandthisisproperlyzonedandthegrowthisdefinitelygoingtosouthoftown.CharlesIngersollsaidhehaspropertynearthisandthathehasR-5andB-2on3sidesandnoproblems.CecilChristenberryremarkedthatheistickledtoseeitgoinginsomethingfortheteenagers.Therebeingnofurthercomments,amotionwasmadebyRobertVanIderstinetoapprove,JimMcCluresecondedandmotioncarriedunanimously.Mr.Gilheartwasremindedthathehad6monthstosecurehispermit.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
