HomeMy WebLinkAboutMinutesTheBoardofAdjustments&AppealsmetMonday,June19,1995at6:30PMattheCityAdministrationBuilding,161N.SectionStreet.Present:ChairmanPeteWalker;membersClaudePuckett,JimMcClure,RobertVanlderstineandJoePetties.BobLunsford,ZoningEnforcementOfficerandBettyRivenbark,SecretaryCase#562MaryAnnLapeze103N.ChurchStreet-10ft.rearyd.varianceMrs.Lapezespoketotheboardshowingthemaplatofthenewhousetheypropose.Shesaidthatshehadanurserymancomeoutandlookatthetreesandthattheyareallveryhealthyandthereasonfortherequestistosavethe3oaktreesthatarepositionedatdifferentplacesonthelot.Ifhervarianceisgrantedshecansavethetreesandbuildthehousethattheywish.Shesaidherlotis69ft.wideand300ft.deep.Shesaidshehadbeentoallherneighborsandtheyarenotopposed.Mr.Walkeraskediftherehadnotbeenanotherhousethereandshesaidyes,arentalhousewasmovedoffofthebackofthelot,wheretheywishtobuildnow.Mr.Walkeraskediftherewasanyoneinoppositiontothispresent.Mrs.McClantocspokeaskingwhythiswasbeforethisboardnotplanning&zoning.Mr.Walkerexplainedthatitwasproperforittobebeforethisboard.Mr.Walkeraskedifanyoftheboardhadanyquestions.Therewerenone.Bobwasaskedhisopinionandhesaidhehadnoproblemwithit,theywererequestingtosavethetreesandthisisnormalrequest.RobertVanIderstinemovedtograntthe10ft.rearyardvarianceasrequested.JimMcClure2ndandmotioncarriedunanimously.Case#563CharlesEarleSpecialExceptionUse-EastendofSpringRunMr.EarlespoketotheboardsayinghewishedtobuildonthisLIacreparcelanassistedlivingfacility.ThatthiswaspetitionedforannexationasR-4andislocatedattheeastendofSpringRun.Thatthisisthefirstphaseandthattheywouldhavehomeslikethecottagestherenow,with0-lotline.HewentoverwhatplannedshowingsomepicturesofasimilarfacilitynowbuiltinMontgomery.Hedidemphasizethatthisisassistedliving,notnursinghome.HesaidSpringRungoesEastandtheywouldextendtheroad,use2acrestobuildthefacility,firstphase,thattherestwouldbedevelopedasaresidentialretirementcommunitylikewhatsurroundingitnow.Mr.Walkeraskediftherewereanyquestionsfromthemembersoraudience.Mr.BobThompsonsaidhewasrepresenting5ofthesurroundingpropertyownersthatwerenotifiedandtheyareallforit.Mrs.McClantocagainquestionedthisbeingbeforethisboardandwastoldagainthatitistheproperboardforthisaction.Bobexplainedtheprocessofrequestingaspecialexceptionuse.ThatwhathehadbeforethePlanning&ZoningCommissionwassubdivisionrequestandtotallydifferent.FurtherdiscussionledtoamotionbyClaudePucketttomovethatthespecialexceptionusebegrantedasrequested.JimMcCluresecondedandmotioncarriedunanimously.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
