HomeMy WebLinkAboutMinutesTheBoardofAdjustmentsAppealsmetMonday,February20.1995at6:30PMattheCityAdministrationBuilding,161N.SectionStreetPresent:ChairmanPeteWalker,membersRobertVanIderstine,JimMcClure,JoePetties,ClaudePuckettSincewedidnothaveameetinginJanuarywedidnotelectofficers.Mr.Walkercalledfornominationsatthistime.RobertVanIderstinemovedthatMr.PeteWalkercontinueasChairmanforanotheryear.JimMcCluresecondedandmotioncarriedunanimously.RobertVanlderstinealsomovedthatClaudePuckettcontinuetoserveasVice-Chairman,JimMcCluresecondedandmotioncarriedunanimously.Case#556LynrKing,715FairhopeAvenue,SpecialExceptionUse—DayCareIthadbeendeterminedthatMrs.Kinghadfailedtoprovideacomplete-listoftheresidents:within300ft.ofherproperty.Mr.Walkersaidduetothiswewouldhavetocontinuetheapplicationfor30days,untiltheMarchmeeting.inorderthateveryonewouldbeproperlynotified.Case#557LilaPorter,4PopeCt..2ft.rearyardvarianceDannyCalhounwaspresentrepresentingMrs.Porter’srequestforavariance.DannysaidthisiszonedR-3whichrequires35ft.rearsetbackline.ThePorter’srequestistobuildasunroomonanareathatisnowaopendeck.Theproblemarosewhentheywishedtoencloseit.Theyareaskingfora2ft.varianceastheyfeeltheroomwouldnotbefunctionalunlessitisatleast10ft.wide.Dannysaidthelotisshallowbut106‘deep.Theadjoininglotsare250-350ftdeep.Theydonotfeelitwillhurttheneighborhoodbutenhanceit.BobLunsfordsaidhesawnoproblemwiththis,andrecommendedapproval.Mr.Walkeraskedifanyonewasherewhowishedtovoiceanopinionfor/against.Therewasnoone.ClaudePuckettmovedtoapprovethevarianceasrequested.RobertVanIderstinesecondedandmotioncarriedunanimously.Case#55822595MainStreetRobertRathe-SpecialExceptionUseMr.Rathespokewiththememberssayingthathewashavingagaragebuilt70ft.fromhishouseandwishedtoputanextraroomwithbathroomoverhisgarage.Hewasunawareofproblemof“onehouseoneachlot”whenhehadtheplansdesigned.Heshowedhisplanandpositiononthelot.Thelotisalongnarrowonerunningtothebay.Hesaidtheonlypersonsoccupyingthisroomwouldbehisguestsorfamilymembers,nokitchenfacilities,notlivingquarters.HewasaskedthelocationandsaiditisonelotbeforeSansSouci.Mr.Walkercalledforanyonepresentwhowishedtospeaktothis,noonedid.Bobsaidthathesuspectedthatthiswouldnotbethelastwewillseeoftheserequestsandasaspecialexception,relieffromthestricttermsoftheordinancecouldbegrantedtopermituseofadetachedaccessorytohousegratuitousguestsandfamilymembers,providedthattheaccessoryshallnotbeused,noworinthefuture,forrentalpurposes(includingbedandbreakfast)commercialactivityoranyotherpurpose,exceptaspermittedbytheordinanceandthisspecialexception.Mr.WalkertoldMr.Rathewehad3choices:approve,denyorgrantw/exceptionsasoutlinedabove.Hecalledforamotion.JimMcCluremovedtograntspecialexceptionusewiththerestrictionsasoutlinedabove.RobertVanIderstine2ndandmotioncarriedunanimously. Case559VaughanInvestment,3individualunits,5Ft.rearyardvariance,14Ftrearyardvariance,22Ft.rearyardvarianceSteveOwensspokerepresentingVaughan.HesaidthisisR-4propertyandthattheythoughtasopposedtobuildinga-plex,put3singlefamilyunits.But,theshapeandsizeofthelotmakesitdifficult,theydon’tfeellikeitwouldtake-awayfromtheneighborhoodbutenhanceit.Hesaidtheytriedtopulleveryunittothefrontbutstillcameupshort.ClaudePuckettsaidtheyknewthesizeofthelotwhentheyboughtitwhydotheywishtoputupmorethanwhatthesizewillallow.Mr.WalkersaidthatwhatClaudeissayingisthattheyareoverbuildingthelot.BobLunsfordaskedifthiscouldberedesignedandgetonetriplex.Mr.Owenssaidhedidnotknow.Thattheyhad,plannedtodosomethingdifferent,have3unitswithenclosedgarages.‘-“:8obsaidtheonlycriteriafortheboardgrantingavariancewouldbetoshowahardship,nothingelsecouldbebuiltonit.Claudesaidagainthatitwouldhavetoshowahardship.Mr.WalkercalledforcommentfromtheaudienceandMabryStonespokesayinghewasnotwithin300ft.buthadlandintheimmediatevacinityandhasbuilthousesformanyyearsinFairhopeandthatthereissomethingthatcouldbeputonthislandthatwouldnotneedavariance.LorrieKoppersmithaneighborfromMeadowbrooksaidsheisveryconcernedaboutthenaturaldrainagestreamthatrunstoMeadowbrook.Thatsheisnotopposed,butwondershow3unitson-’Onelotwouldimpactthem.Alsothatsheisworriedaboutwhatthiswoulddotoherpropertyvalue.BartMcPhersonspokesayingheownedadjoininglandandwishedtoseeaplatofwhatproposed.Bobcommentedthatheheardthemsaythatthesewouldbesinglefamilyunitsforsaleandthatitwouldhavetobeacondoarrangementcouldnotsubdividetheland..Mr.WalkeraskedifMr.OwenscouldnotgetwithMr.Lunsfordandseewhatcouldbedone,thatifweactedonittonightthereisastrongpossibilitythatitwoutdbeturneddownandifitwasitwouldbeayearbeforewecouldactonitagain,butitcouldbepostponedforthirtydaysinorderforhimtogetwithMr.Lunsford.Mr.Owenssaidhefeltitwouldbetotheiradvantagetopostpone.ClaudePuckettputintheformofamotionpostponingthisfor30daysJimMcCluresecondedandmotioncarriedunanimously.AtthistimeBobaskedtheboardtositasaboardofbuildingadjustmentinthematterofhisnotallowingfibermeshtobeusedinconcreteinthehousesthatarebeingconstructedinFairhope.ThathehasheretoforenotalloweditandnowMr.Sullivanhadcomeforthandchallengedhisjudgementonthis.ThatbeforeifnotspelledoutintheSouthernBuildingCodeitlefttodiscretionofthebuildingofficial,whichisnormalprocedure.Mr.WalkeraskedifMr.Sullivanwaspresent,hewasnot.ButaMr.KeithWesleywaspresenttopresentinformationthatbackedupBob’sdecisiontonotallowit.Headdressedtheboardandtoldofteststhathadbeenrunandtheresultsofsame(hehadpresentedfactstotheboardforthefile)Hepointedoutthatafter5hrstheshrinkageoftheconcretewas8-35%higherw/fibermeshmaterial.Alsothatthecrackswerelargerby73%.Hepointedoutthatthisareaveryhillyandrequiredsteelreinforcement.Bobsaidthatnothinghaschangedhismindaboutthisbutjustlookingfordirection.FurtherdiscussionledtoClaudePuckettmovingthatBobcontinueonthecoursehehasbeentakingregardingthismatter.RobertVanIderstine2ndandmotioncarriedunanimously.ThatMr.Sullivanwasgivenafairopportunitytocomepresenthiscase.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
