HomeMy WebLinkAboutMinutesTheBoardofAdjustmentsAppealsmetMonday,October16,1995at6:30PMattheCityAdministrationBuilding,161N.SectionStreet.Present:ClaudePuckett,ViceChairman;membersCharlesSenior,RobertVanIderstine,JimMcClure,JoePetties.RobertLunsford,ZoningOfficerandBettyRivenbark,SecretaryTheminutesoftheSeptember18,1995meetingweredulyapprovedonmotionbyRobertVanIderstine,secondedbyJimMcClureandunanimouslycarried.Case#570JamesPope,211080MainStreet-2ft.sideyardvarianceMr.Pope,addressedtheboardsayinghelivedatthecornerofGabelStreetandScenicHwy98andwhatheisproposingtodoisenclosedacarportandaddanewcarporttoexistinghouse.Thatinordertodosohewouldneedthe2ft.varianceontheGabelStreetside.HesaidhehastalkedtotheMontrosehistoricgroupandtheyhavenoproblem,hehadplansifanyonewishedtolookatthem.Hesaidfurtherthatthereisaheavygreenbeltseparatinghimfromthestreet.CharlieSenioraskedhimhowfarthiswouldextendbeyondthepresentcarportandhesaid2-7feet.Mr.Puckettaskedifanyoneintheaudiencewishedtospeak,noonedid.Heaskedtheboardiftheyhadanymorequestions,theydidnot.HecalledforamotionandJimMcCluremvedtograntthevarianceasrequested,RobertVanIderstinesecondedandmotioncarriedunanimously,RickGambinoDBAGan-sbino’s-InterpretationSinceMr.Gambino’scasehadcomeuponJuly17,1995andhisrequesttocoverhisdeckhadbeengrantedhehadalsoputscreeningaroundthedeck.SeveralboardmembershadquestionedthisasattheJulymeetinghehadbeenspecificallytoldthatthiscouldnotbeanenclosedstructure.Bobhadwrittenhimaletterstatingthatheinterpretedthescreentoconstituteenclosingthedeck.Inresponsetotheletterandaftertalkingwithseveralboardmembersitwasdecidedtobringthisbackuptonightunderinterpretation.Mr.Gambinowaspresentandtheneighborswithin300ftwerenotified.Mr.Puckettsaidhewouldliketoknowfromthememberstheirinterpretationofenclosure,thatthereisnothingthatsaysscreeningis/isnotanenclosure.Bobsaiditwashisfeelingthatscreenwireisenclosure,thereforehewrotetheletter.Claudesaidhewouldliketoknowwhatwasinthemindsoftheboardatthetimethisvariancegranted.Twoladiesintheaudiencespokesayingtheyweresurprised-considerscreenenclosure.JimMcClurespokesayingheconsideredanenclosureavaporbarrier/wallandscreennotanenclosure,coulduseonlywhentheweatherpermits.Claudespokesayinghevotedforitbutremembersthattheintentwasnottoincreasediningroomseatingcapacity,thattherewouldbeadverseweatherconditionswhenitcouldnotbeused.Robertspokeandsaidatthetimehisinterpretationwasthatitnotbeenclosedanyway,shapeform-screeningisanenclosure.JoePettiessayshevotednottobeenclosed,screeningisenclosure.CharlieSenior(wasnotpresentatoriginalhearing)saidheseesscreeningasanenclosure.Aladyintheaudiencespokesayingshedoesnotconsiderascreenporchanenclosure,shehasbeentryingtoenclosehersforever.Rickspokesayinghehadtalkedtothehealthdepartmentbefore enclosingandtheyonlythingitbenefitsiskeepingbugsoutofthefood.Thatpeoplehavetoleavethebuildingtoevengetonthedeck.Hecannotseehowanyonecansayenclosedasrain,hotweather,coldwillpreventuseage.Claudeaskedforanyotherdiscussionamongtheboard.Therewasnone.RobertVanIderstinemovedthatheinterpretsscreeningasenclosure,JoePettiessecondedandvotewasformotion:RobertVanIderstine,JoePetties,CharlieSenior.OpposedtomotionClaudePuckett,JimMcClure.Claudesaidhedidnotremembercasewherewehadamotioncarrywith3votes.Bobsaidthisisnotanappealmatter,appealdone.Thatweareheretonighttointerpret,basedonthismaybeweshouldletletterforremovalstandandhewillnotpursuehistakingdownthescreenuntiltheboardhasachancetomeetataspecialorregularmeetingwiththeoriginalboardmembersanddiscussagaintheirinterpretation.Mr.Walkerwasunabletocometomeetingtonightandheisotherboardmemberwhowaspresentatoriginalmeeting.Claudesaidmaybeaskattorney’sopinion.Therebeingnofurtherbusiness,meetingwasdulyadjourned.
