The Airport Board of the City of Fairhope met February 6,
1985 at 8:00 A.M. at the Municipal Complex.
Present: Chairman Russ Kilgore, members
Buzz Colling, Mason McGowin and Jim Gaston
Consultant Tommie Werneth was also present.
Russ explained to the Board that the three fee
simple parcels were posing a problem. He related
that we had sent Mr. Spitzer,Sr another letter
offering him $51,000. That this was our final
offer. He had talked to FAA and they said we
needed to decide if we would offer Spitzer, Jr.
$120,000(110,600) being the original figure.
That Mr. Spitzer, Jr.'s attorney had been in
touch with us and that he indicated that this
if a figure that he might accept. The question
was raised how would this affect the situation
with Mr. Dean who refuses to negotiate at all.
Mrs. Werneth said she did not see any change
in that situation and she felt sure we would
probably have to go.into condemnation with him
as he said he wouldn't settle -except double
the original offer, which is preposperous. Further
discussion led to all deciding to make the offer
to Spitzer, Jr, Jim Gaston put this in the form
of a motion, Mason McGowin seconded and motion
carried unanimously. Letter to include that as
soon as offer is accepted by Mr. Spitzer, Jr.
permission for the City crews to come on the
land to make necessary tests will be granted.
Tommie also reported on Mrs. Frego's parcel and
that everything is tied up in probate due to Mr.
Frego's death but she feels sure a letter of com-
mitment is forthcoming.
It is noted that with the letter to Spitzer, Jr.
as soon as we receive a response from him the
other two(Spitzer,Sr and Dean) will be notified
that they have 72 hours to respond. After that
time condemnation proceedings will begin.
We are also waiting on a letter of acceptance
from Clarence Bishop and fellow property owners
about avigation easement.
The Board discussed the land swap and donation of
land from Mason McGowin, and that it was approved
at last meeting and now is up for Council action.
Direction was given for them to proceed.
There being no further business, meeting was duly
adjourned.
