" Minutes of Fairhope Airport Authority December 14, 2021 The Fairhope Airport Authority met December 14, 2021 at 5 :00PM in the City Council Chambers at 161 N Section Street. Present : Don Lagarde, Chairman, Chip Groner, Pel Henry, Amy Pearson and Will Bruce. Vince Boothe and Jack Burrell were absent. Also present was Josh Myrick, Attorney. Cynthia A Boothe took the minutes . The Minutes of the November 9, 2021 regular meeting were considered and approved with a motion by Pel Henry, second by Chip Groner and unanimously passed . Fairhope Airport Operations: Chip Groner stated that all the lights are working but that the AWOS is still out. He said that the part had been ordered and they would be fixing it in the next day or two. Nick VanHouten stated that the lights are working but that they were only on bright, and he would check them again in the morning. Continental Aerospace Report: Nick Van Houten stated that things at the Airport have been very busy and the EAA is planning an event for March, and he will be getting sponsors and helping to organize the event which will include a fly-in. Treasurer's Report: Amy Pearson reported that she has no printed report at this time and that at the end of November the operating account had $130,000.00 and in December that she had transferred the $166,000.00 grant money to the operating account. Legal Report: Josh Myrick reported that the 2% Surcharge took affect December 1, 2022 and the first payments of the Surcharge are due on January 20, 2022 . He also stated that he has a signed tie-down agreement with Gene Warhurst for his aircraft. The monthly amount will be $75 .00. Other Business: Erik Cortinas, Building Official for the City of Fairhope, asked the Authority Members if there are any regulations or policies in the Airport records about Owner/Builders building their own hangars at the Airport. Josh Myrick stated that he did not think so but would check to be sure. Executive Session under Section 36-25A-7(3), Code of Alabama to discuss pending or Imminent Litigation. Also, to discuss a topic involving the good name and character of an individual: Don Lagarde stated that he needed a motion to go to Executive Session under Section36 -25A-7(3), Code of Alabama to discuss pending or imminent litigation . Also, to discuss a topic involving the good name and character of an individual. The meeting should last approximately 30 minutes . Josh Myrick certified that§ 36-25A -7(3) was applicable to the portion of the executive session discussing pending or imminent litigation. A motion was made by Will Bruce to go to Executive Session, second by Chip Groner. Amy Pearson, Chip Groner, Pel Henry, Will Bruce and Don Lagarde all voted 'Aye'. The Authority members moved into Executive Session at 5 :23PM . No action is expected to be taken following the Executive Session. Return from Executive Session: The Authority Members returned from Executive Session at 5:58 PM. A motion was made by Pel Henry to reconvene the meeting, second by Chip Groner and unanimously passed. Adjournment: A motion was made by Chip Groner to adjourn the meeting, second by Pel Henry and unanimously passed . There being no further business , the meting was ad ·ourned at 5 :59PM .
