The City Council met in a Public Participation/Work Session
at 5:00 p .m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope , Alabama 36532, on
Monday, 10 September 2012.
Present were Council President Lonnie L. Mixon, Councilmembers: Debbie
W. Quinn, Daniel Stankoski, Michael A. Ford, and Rick Kingrea, and City Clerk Lisa
A. Hanks. Mayor Timothy M. Kant and City Attorney Marion E. Wynne were
absent.
Council President Mixon called the meeting to order at 5:00 p.m.
The following topics were discussed :
• Mike Odom, The Fairhope Courier, addressed the City Council and mentioned being on
the radio show with Lori Dubose . The Paul Ripp Report stated concern about Mike
Odom being offered a job and biased against candidates . He said the reason for the
article was that a council woman offered me a job. He stated Warner had called him
because of the rumor mentioned he was offered a job doing "City Sketches ." Mr. Odom
stated that Mr. Warner was offensive to him. Mr. Odom wanted the City Council and
the citizens to know that he was never offered a job; that there was no misunderstanding
about this article and his stand regarding same .
• Carole Schneider, 113 Orange, addressed the City Council regarding the geese at the
Duck Pond. Ms. Schneider stated she was speaking on behalf of the few geese that
remain. She mentioned that Mayor Kant did not agree to the killing of the geese just
relocating them. She also said that alligators were captured and relocated ; so why not
the geese.
• Council President Mixon mentioned that there are two ordinances on the agenda tonight
regarding the Compensation and Job Classification Plan. The first ordinance was
introduced at the last City Counci l meeting ; and the other one sets limitations for the
administration of the plan . The consensus was to do away with Agenda Item No. 6 and
layover Agenda Item No. 11 until the next meeting.
• The City Landfill was discussed next on the agenda. Council President Mixon said the
resolution adopted by the City Council to increase the height of the landfill and establish
a buffer was in January 2011. City Administrator Gregg Mims reported that Mayor
Kant said provided funds are available in the budget, we will begin November or
December.

• Bobby Hall , Director of Golf, addressed the City Council regarding the Quail Creek
Golf Course Snack Bar/Grill Operation . Mr. Hall explained two options and asked for
direction from the City Council. The options were for the City to maintain the snack bar
or go out on an RFQ. Council President Mixon suggested that Bobby Hall, Gregg
Mims, and Mayor Kant get with him for better figures before making a decision.
• Michelle Kurtz with the Hurricane Homeowners Insurance Initiative addressed the City
Council and presented a Power Point Presentation regarding Insurance Companies and
The Clarity Act. She stated The Clarity Act will allow claims data to be collected and
compared to all areas. She requested the following three things from the City Council :
1) in a year from now, the City Council needs to pass a resolution in s upport of The
Clarity Act; 2) requests for other speaking engagements; and connect to other City
Council in States, i.e. Mississippi , Florida, Louisiana, Texas , and Georgia.
• Councilmember Quinn requested again for a report in writing regarding the geese from
Mayor Kant. She stated once she received the report then she would g ive to Ms.
Schneider.
There being no further business to come before the City Council, the meeting
was duly adjourned at 5:52 p.m.

Per my conversation's with you, Mayor Kant and James Gillespie on Tuesday September 4th; I am submitting the following
request to be added to the Fairhope Qty Council Worlc Session on September 10th, 2012 .
Request is for direction of administration of the Snack Bar/Grill at Quail Creek Golf Course.
Option #1: Request of the Qty Council to hire one (1) Full Time Employee and and two (4) part time employees to adequatley
staff the Snack Bar/Grill at Quail Creek Golf Course Club-house. Reque st to include the acquisition (transfer) of the ABC liquor
License presently held by Greg McNally (Alan's Grill).
Option #2: Request of the Qty Counc il to direct a RFQ be put into pla ce to allow a search for a qualified food and beverage
service : company; person; restaurant, etc ... properly qualified to manage and maintain a quality food operation for the general
publ ic at the Quail Creek Golf Course Oub-house Snack Bar/Grill.
** Greg McNa/ly has submitted his letter to the City of Fairhope of his intent, that he will no longer
maintain his lease of the Quail Creek Snack-Bar, after October 2nd, 2012.)

coastal losses with inland losses .

Alabama Law & Policy requires that the DOI
insure fair pricing practices.
ALABAMA RATE STATUTES
-Alabama statute says that rates must not be:
* Excessive
* Inadequate
* Unfairly discriminatory
If Clarity Act data shows we're not more expensive
(or only 50% more expensive),
then law and policy say that the DOI must prohibit
"unfairly discriminatory"
pricing statewide .
The "Silver Bullet"
In a meeting with HHll leaders on July 23, 2012, Governor Bentley said he is
"committed to fairness " and giving HHII access to the governor's office on this issue.
The governor can play a ke y role in so lution s by ordering the Department of In surance to require:
--purity of data from insura nce com pan ies when they turn in their Clarity Act data next Oct. 1
--timely an d user-friendly publi cation of the _1!gg.rggfilgQ data on the DOI website
