C4tl44« OaW(JM/.,t4d SIGNATURE ST A TE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council met in a Special Work Session at 5:00 p .m., Fairhope Municipal Complex Council Chamber, 161 North Section Street , Fairhope, Alabama 36532, on Monday, 22 August 2011 . Present were Council President Lonnie L. Mixon, Councilmembers: Debbie W . Quinn, Michael A. Ford, Rick Kingrea, Mayor Timothy M. Kant, and City Clerk Lisa A . Hanks. Councilmember Daniel Stankoski and City Attorney Marion E. Wynne were absent. Council President Mixon called the meeting to order at 5 :00 p.m. and explained this meeting will be to addres the two Supreme Court rulings : the Mayor cannot issue a contract without the approval of the City Council; and the Mayor 's duties based on the ruling on the Fairfield decision . The City Council has authority over the City's finance , legislation, ordinances, salaries, and defines duties. The Mayor oversees the day-to-day operations of the City and fills vacant positions . Paul Myrick addressed the City Council and stated his comments were limited to the Human Resources issues . The Fairfield Council adopted an ordinance for the Mayor to hire with approval by Council. There is limited authority to appoint and dismiss by the Council; officials only mentioned in the Code of Alabama. He mentioned the Personnel Handbook was being looked at regarding this decision . There are several ordinances that need to be addressed based on this policy. Mr. Myrick said the City Clerk, City Treasurer, Chief of Police, Fire Chief, and City Attorney positions are considered appointed officials. The City Council can create the position of City Administrator and set the alary , but the Mayor must hire . This position cannot take the duties away from the Mayor. The Personnel Board does not hire and fire; and thi authority cannot be de legated. Only the Mayor can hire and fire employees. Mr. Myrick mentioned that the City Council could implement a Merit System with due process. The Police Department has a Merit System and due process must be followed . The Police General Orders ("PGO") was questioned . Mr. Myrick aid the Personnel Manual adopts the PGO for the Police Department. He also stated that the Mayor must approve any c hanges in PGO and these must not conflict with Personnel Manual.
