Present were Council President Jimmy Conyers, Councilmembers: Jack, Burrell, Corey Martin, Jay Robinson, and Kevin Boone (Arrived 8:38 a.m.), Mayor Sherry Sullivan, and Assistant City Clerk Jenny Opal Wilson. City Attorney Marcus McDowell and City Clerk Lisa Hanks were absent. There being a quorum present, Council President Conyers called the meeting to order. The invocation was given by Associate Pastor Bill Quinn of Trinity Presbyterian Church and the Pledge of Allegiance was recited. Council President Conyers announced he was pulling Agenda Item No. 15. Councilmember Robinson moved to approve minutes of the 14 February 2022, regular meeting; and minutes of the 14 February 2022, work session. Seconded by Councilmember Martin, motion passed unanimously by voice vote. Mayor Sullivan addressed the City Council regarding the following items: She thanked Council President Conyers for taking Item 15 off agenda, this item will require more information on truck body; all four Mardi Gras parades went well this year, City was beautiful, along with great weather, received lots of compliments, and she thanked staff for their support; looking forward to the upcoming Arts & Crafts Festival on March 18th -20th with over 400 vendors; Spring Fever Chase will be on March 19th; Church Street will be closed on March 7th for Church Street Improvement Project; Comprehensive Plan Team met on March 3rd, there were over 100 surveys completed with approximately 50-60 people in attendance, we will meet again on Tuesday, March 8th at 5:30 p.m. at the Civic Center for Concept Plan Presentation, for more information about the Comprehensive Plan, visit www.PlanFairhope.com. Councilmember Burrell commented the Mayor and Council had a great trip to Washington, D.C. They met with senators and congressional leaders of Alabama. Mayor and Council spoke in unified voice for support with grants. Councilmember Martin commented there was a lot going on in Washington, D.C. He commented the Mayor and Council had a productive trip. He asked that wepray for Ukraine and pray for our leaders at the top.Councilmember Boone commented he had returned from vacation.
9596 04 March 2022 Council President Conyers reported the trip to Washington, D.C. was a good opportunity to promote Fairhope and see items to the finish line. He thanked Mayor Sullivan for pushing forward. Council President Conyers opened the Public Hearing for application of a Lounge Retail Liquor Class I License by Ellen W. Semple, 51 South Section LLC d/b/a the Monkey Bar, located at 51 South Section Street, Fairhope, Alabama at 8:42 a.m. No one present opposed liquor license, the Public Hearing closed at 8:43 a.m. City Council reviewed application for a Lounge Retail Liquor Class I License by Ellen W. Semple, 51 South Section LLC d/b/a the Monkey Bar, located at 51 South Section Street, Fairhope, Alabama. Councilmember Burrell moved to approve the issuance of the license. Seconded by Councilmember Martin, motion passed unanimously by voice vote. Councilmember Burrell moved for final adoption of Ordinance No. 1744, an ordinance to amend Zoning Ordinance No. 1253 to change and alter the City of Fairhope Zoning Ordinance relating to Residential Accessory Structures. (Introduced at the February 14, 2022 City Council Meeting) Seconded by Councilmember Robinson, motion for final adoption passed by the following voice votes: A YE -Burrell, Martin, Conyers, Robinson, and Boone. NAY -None. Planning Director Hunter Simmons gave summary of proposed language; an accessory structure could be taller than the principal structure by no more than 5 '. However, the 30' height limit would also apply. Planning Commission approved by unanimous vote. Councilmember Burrell moved for final adoption of Ordinance No. 1745 to amend Ordinance No. 953 and Ordinance No. 1658, and amending Chapter 21, Article III Water, replacing Section 21-32 Connection Fees and Expenses, Fairhope Code of Ordinances. (Introduced at the February 14, 2022 City Council Meeting) Seconded by Councilmember Boone, motion for final adoption passed by the following voice votes: A YE -Burrell, Martin, Conyers, Robinson, and Boone. NAY -None. Councilmember Boone moved for final adoption of Ordinance No. 1746 to amend Ordinance No. 953 and Ordinance No. 1657, and amending Chapter 21, Article IV, Sewer, replacing Section 21-52 Connection Requirements and Connection Fees, Fairhope Code of Ordinances. (Introduced at the February 14, 2022 City Council Meeting) Seconded by Councilmember Martin, motion for final adoption passed by the following voice votes: A YE -Burrell, Martin, Conyers, Robinson, and Boone. NAY -None.
9597 04 March 2022 Councilmember Burrell introduced in writing, and moved for the adoption of the following resolution, a resolution that City Council hereby authorizes and selects Mayor Sherry Sullivan to be the Voting Delegate, James Reid Conyers, Jr. (Council President) to be the 1 51 Alternate Voting Delegate, and Jay Robinson (Council President Pro Tempore) to be the 2nd Alternate Voting Delegate during the annual meeting of the Alabama League of Municipalities. Mayor Sherry Sullivan announced the Fairhope clinic opened last week and announced "Open House" is today from 1 :00 p.m. -4:00 p.m. Mayor Sullivan commented she is excited to have the network of clinics and noted Riviera Utilities and the City of Foley own the clinic in Foley. Councilmember Burrell thanked Mayor Sullivan and wants employees to take advantage of this benefit and stay healthy. Councilmember Boone made compliment that the clinic looks good and City crews did an excellent job.

Neither party shall charge each other, Symbol, or the patients for reciprocal access. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Mayor Shery Sullivan announced the GOMESA Grant is for one million dollars and would be used for the Triangle Property at the entrance to our City is working. Were working on solicitation of bid for landscape architect to identify trails and restroom facilities. Council President Conyers inquired on timeline of project. Mayor Sullivan commented she hopes to have a ribbon cutting by next year. **

AUTHORIZING THE EXECUTION OF A GOMESA GRANT
AGREEMENT WITH THE ALABAMA DEPARTMENT
OF CONSERVATION AND NATURAL RESOURCES TO
CONSTRUCT THE NORTH TRIANGLE NATURE PARK

WHEREAS, the City of Fairhope was recently awarded a Gulf of Mexico Energy Security Act of 2006 (GOMESA) Grant (No. G-CFNP21CF) with the Agreement by and between the State of Alabama Department of Conservation and Natural Resources (ADCNR) to construct a nature park trail and facility improvements within the City of Fairhope; and WHEREAS, the total estimated project cost is $$999,989.28, of which the grant amount is a not-to-exceed amount of $999,989.00 to allow satisfactory completion of all Project Services following the execution of this Agreement; and WHEREAS, the City of Fairhope warrants and represents that it will use the GOMESA funds provided under this Agreement in accordance with approved GOMESA and consistent with all applicable stated and federal laws; and WHEREAS, City Staff will provide oversight of the project which shall begin on the date of the Mayor's signature and end on February 29, 2024. 9600 04 March 2022 Councilmember Robinson introduced in writing, and moved for the adoption of the following resolution, a resolution that Mayor Sherry Sullivan is hereby authorized to execute amendment to the Intergovernmental Funding Agreement between the City of Fairhope and the Baldwin County Commission, related to the construction of a roundabout at Twin Beach Road and County Road 13, to extend the term of the ISA by thirty-six (36) months from the conclusion of the initial term; and all other terms and provisions of the ISA remain in full effect. Seconded by Councilmember Martin, motion passed unanimously by voice vote. Mayor Sullivan commented the roundabout at Twin Beach Road and County Road 13 will be like other roundabouts and they will pay for utility movement. Councilmember Burrell suggested Mayor Sullivan work with COP A on an attractive entrance for this side of the City. RESOLUTION NO. 4385-22
WHEREAS, the County and the City entered into an Intergovernmental Services Agreement with
an effective date of February 5, 2019 (the "ISA"); and
WHEREAS, the ISA related to the construction of a roundabout at Twin Beach Road and County
Road 13; and
WHEREAS, the term of the ISA was thirty-six (36) months from its effective date; and
WHEREAS, additional time is needed to complete the project forming the basis of the ISA; and
WHEREAS, the ISA may be amended by a written instruments signed by the City and the
County; and,
WHEREAS, the City and the County desire to amend the ISA and extend the term of the same by
thirty-six (36) months.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, that
Mayor Sullivan is hereby authorized to execute the Amendment to the Intergovernmental Funding
Agreement between the City of Fairhope and the Baldwin County Commission, related to the
construction of a roundabout at Twin Beach Road and County Road 13, to extend the term of the

9601 04 March 2022 Councilmember Martin introduced in writing, and moved for the adoption of the following resolution, a resolution that City Council approves the Compensation and Job Classification Plan along with the Grade Order Sheet be amended and approved to fund and defund specific job positions in the Police Department; and the job descriptions and grade of pay for same. Seconded by Councilmember Burrell, motion passed unanimously by voice vote. Mayor Sherry Sullivan apologized for leaving out of budget. She commented change is to pay grades. The cost not-to-exceed the budgeted amount of $27,000.00. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Mayor Sullivan commented Councilmember Burrell asked we look at a design build on this project. She said design build was not allowed in the State of Alabama as it directly competes with competitive bid law; and we felt Sawgrass Consulting, LLC would be a good fit since they had worked with the Baldwin County School Board on projects. Adopted on this 4th day of March, 2022 President Attest: aAHnks,C City Clerk Councilmember Martin introduced in writing, and moved for the adoption of the following resolution, a resolution That Blast Soccer, Inc. d/b/a Fairhope Soccer Club ("FSC") is authorized to temporarily operate the concession stand at the Fairhope Soccer Complex at 18383 County Rd 13 from March 1, 2022 until March 14, 2022 while the terms of an annual Lease Agreement are being negotiated; and specifically that FSC will operate the concession stand for the Buccaneer Bash taking place on March 4 and March 5, 2022, with a donation of $2,000.00 plus 60% of the net concession proceeds to Fairhope High School Boys Soccer Program; and that it is in the public interest and serves a public purpose for this temporary use by FSC with the donation to Fairhope High School Boys Soccer Program and further so the City does not incur the expense of operating the concession. Seconded by Councilmember Burrell, motion passed unanimously by voice vote. Council President Conyers commented the lease agreement would cover the tournament this weekend. Councilmember Burrell inquired on the $2,000.00 donation. Mayor Sherry Sullivan replied this is an annual donation; and noted during COVID the amount was reduced. She stated this is a high school tournament and they are not the renting the fields.

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, That Blast Soccer, Inc. d/b/a Fairhope Soccer Club
("FSC") is authorized to temporarily operate the concession stand at the Fairhope
Soccer Complex at 18383 County Rd 13 from March 1, 2022 until March 14, 2022
while the terms of an annual Lease Agreement are being negotiated; and specifically
that FSC will operate the concession stand for the Buccaneer Bash taking place on
March 4 and March 5, 2022, with a donation of $2,000.00 plus 60% of the net
concession proceeds to Fairhope High School Boys Soccer Program; and that it is in
the public interest and serves a public purpose for this temporary use by FSC with the
donation to Fairhope High School Boys Soccer Program and further so the City does
not incur the expense of operating the concession.

Councilmember Burrell introduced in writing, and moved for the adoption of
the following resolution, a resolution That the City of Fairhope has voted to approve

authorizes procurement based on the option allowed by the Code of Alabama 1975,
Section 41-16-51(13). The cost will not-to-exceed $29,557.95. Seconded by

made comment that item was budgeted on green sheet for $55,000.00.

Eric Cortina Building Official reminded everyone of the Fairhope Boosters Club 26th Annual Drawdown and Silent Auction on March 12, 2022. Mayor Sherry Sullivan thanked Assistant City Clerk Jenny Opal Wilson for sitting in the absence of the City Clerk Lisa Hanks for her first meeting today. The City Council additionally extended thanks. *
