The City Council, City of Fairhope, met in regular session at
4:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope , Alabama 36532 , on
Monday, 9 January 2012.

Present were Council President Lonnie L. Mixon, Councilmembers: Debbie
W . Quinn, Daniel Stankoski, Michael A. Ford, and Rick Kingrea, Mayor Timothy M .
Kant, City Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks.
There being a quorum present, Council President Mixon called the meeting to
order. The invocation was given by Dr. Jerry Henry, Pastor at First Baptist Church,
and the Pledge of Allegiance was recited . Council President Mixon asked if there
were any corrections to the minutes from the 27 December 2011, regular meeting. He
then stated if there are no corrections, the minutes stand approved as written.

Council President Mixon recognized Boy Scout Troop #47. The Boy Scouts
were working on their "Communications Badge ."
Mayor Kant addressed the City Council suggested a Work Session to iron out
what ordinances and projects needed to be changed or go forward with for this year.
This would give staff direction for the year.
Council President Mixon questioned Mayor Kant on the following items:
1) Audit Report status; Mayor Kant stated we only have a rough draft
right now .
2) Accident repo1t from electrical incident ; Mayor Kant rep I ied that an
analysis of the accident was being prepared by the in s urance company.
3) Hearing noticed for 8:00 a .m . this morning and then cancelled
which was very inconsiderate; Mayor Kant apologized for the
cancellation and said there was a step not performed . He said this step
needed to be done before it goes before the Personnel Board. Council
President Mixon requested a letter be sent to each Board member as a
formal apology. Mayor Kant said he took full responsibility for the
issue.

City Attorney Wynne gave an update on a vagrancy complaint in the gully
area owned by the City . The person living in the gully is on City property which
needs to be cleaned up. Council President Mixon questioned if the City could enact a
vagrancy law. City Attorney Wynne replied vagrancy laws are not constitutional.
The City could enforce the litter law or po sibly public intoxication . Council
President Mixon suggested for Mayor Kant and City Administrator Gregg Mim s to
work with City Attorney Wynne for a possible ordinance.
Councilmember Quinn addressed the City Council regarding Dan Burden .
She thanked Smart Coast who made the City aware that Mr. Burden was available to
help with making the City streets safe. She also thanked the AARP for funding half
of the consultant fees.
Councilmember Stankoski addressed the City Council regarding the following
items:
I) Announced that Janua1y 19, 2012 will be the cut-off date for the
Education Advisory Committee applications.
2) Mentioned that mail servers have filters and you can set the rule to send
unwanted e-mails to your n·ash folder or just block it.
Councilmember Ford addressed the City Council regarding e-mails he
received about the condition of the park across from the K-1 Center. He suggested
that the City look into cleaning up . He said it was a good idea for Burden to discuss
street safety; and agreed with the Chief that we need to look at everything before
jumping into it first. Councilmember Ford stated if we make laws , these need to be
enforced, such as u-tums downtown.
City Administrator Gregg Mims addressed the City Council regarding the
following items:
l) 2012 International Building Codes are bein g looked at and the se wi ll need
to be adopted .
2) Mentioned the Airpo1t Authority 's project.
3) Asked Ken Es lava to prepare a rcpo11 on Gov Deals for the City Council.
Charlene Lee, 60 Morphy Avenue, addressed the City Council and said she
was proud of our City and staff. She mentioned that Dan Burden has agreed to work
with the City at no charge for the remainder of the plan for our streets .
City Administrator Mims addressed the City Council and briefly explained
Agenda Items Number 6 through Number 12 prior to the City Council voting on
same.

Councilmember Kingrea introduced in writing, and moved for the adoption of
the following resolution , a resolution authorizing Mayor Timothy M . Kant to execute
a contract with Aramark Uniform Services for the Water Department. Seconded by
Councilmember Ford , motion passed unanimously by voice vote.
RESOLUTION NO. 1889-12
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that Mayor Kant is hereby authorized to execute a
Contract between the City of Fairhope and Aramark Uniform Services for rental
service for Water Department Uniforms. The cost of the unifom1s will be
approximately $4,700 .00 per year .

RESOLUTION NO. 1890-12
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, as follows:
[l] That the City of Fairhope has voted to purchase 1,040 Meters and Regulators for
the Gas Department and authorizes procurement based on the option allowed by the
Code of Alabama 1975, Section 41-16-5l(b)(7). Two Hundred Forty (240) will be
used for everyday consumption and Eight Hundred (800) will be for use in the 2012
budgeted meter installation project and the cost will be approximately $116,636 .00 .

F Al RH OPE, ALABAMA, as follows:
[ l] That the City of Fairhope has voted to purchase 1,040 Neptune Gas Electronic
Radio Transceiver Units (ERTS) for the Gas Department and authorizes procurement
based on the option allowed by the Code of Alabama 1975 , Section 41-16-51 (b )(7).
Two Hundred Forty (240) will be used for everyday consumption and Eight Hundred
(800) will be for use in the 20 12 budgeted meter installation project and the cost will
be approximately $74 ,880 .00.

Flooring (Bid Number 002-12) at 555 South Section Street in the City of Fairhope
offices , Fairhope, Alabama .
[2] At the appointed time and place , the follo w ing bids were opened and tabulated as

RESOL TIO 1 0. 1895-12
WHEREA , the City of Fairhope adopted Ordinance No . 1331 , An Ordinance estab li s hin g
Jmpact Fees on new development in the City of Fairhope on May 31 , 2007 in accordance
with Act No. 2006-30 enacted by the Legislature of Alabama on April 4 , 2006 ; and
WHEREAS, the City desires to u se fund for "Parks and Recreation" which is a Benefit Area
for (i) the acquisition of new public parks land s, (ii) the construction , development and/or
improvement of public recreational facilities , (iii) the construction , development and/or
improvement of public park amenities , (iv) the acquisition of new park vehicles , and (v) the
parks and recreation component of the "Impact Fee Study" prepared by TischlerBisc for the
City dated March 8, 2007 ; and
WHEREAS, the following proj ects shall be paid from the Impact Fees Account and have
met the criteria stated to be paid from said Account:
Survey and Field leveling work at existing Founders Park soccer fields and
currently undeveloped prope1ty on Manley Road:
l) Founders Park Project -Excavate and level fields 5 , 6 , and 7,
reinstall the iITigation system and place new sod on the new single
field, full size field that would be created; not to exceed $15,000 .
2) Manley Road Project -Conduct a survey of the site, to begin the
planning proces s of a new facility , and have as much site clearing
and leveling work be done as possible to create additional practice
s pace; not to exceed $60,000.
NOW BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, hereby authorizes Mayor Timothy M . Kant to expend Impact
Fees for the above two projects as designa ted from the Impact Fee Account for services for
the "Parks and Recreation" Benefit Area .
