HomeMy WebLinkAbout12-18-2014 City Council Meeting MinutesSTATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council , City of Fairhope , met in regular session at 6 :00 p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope , Alabama 36532 , on Thursday, December 18, 2014. 6651 Present were Council President Jack Burrell , Councilmembers: Michael A. Ford and Kevin Boone , Mayor Timothy M. Kant , and City Clerk Lisa A. Hanks. Councilmembers : Rich Mueller and Diana Brewer, and City Attorney Marion E. Wynne were absent. There being a quorum present, Council President Burrell called the meeting to order. The invocation was gi ven by Reverend Mike McKnight, pastor at Fairhope United Methodist Church, and the Pledge of Allegiance was recited. Councilmember Boone moved to appro ve minutes of the 8 December 2014 , regular meeting; minutes of the 8 December 2014 , work session ; and minutes of the 8 December 2014 , agenda meeting . Seconded by Councilmember Ford , motion passed unanimously by voice vote. Mayor Kant addressed the City Council and first said Merry Christmas and Happy New Year to everyone . He announced the Christmas luncheon being held on December 19 , 2014 at the Ni x Center. Mayor Kant thanked all of the Department Heads for a successful year. Councilmember Ford addressed the City Council and asked everyone to remember the true meaning of Christmas. He commented that recycling needs more publicity. Councilmember Boone and Council President Burrell both told everyone Merry Christmas. Council President Burrell announced that Agenda Number 6 the appointment of Haymes Snedeker to Municipal Judge would be addressed next on the agenda. Councilmember Ford introduced in writing , and moved for the adoption of the following resolution , a resolution to appoint Haymes Snedeker as Municipal Judge to serve a two year term and until a successor is elected by the council and qualified. Seconded by Councilmember Boone , motion passed unanimously by voice vote. * * 6652 I8 December 20 I4 RESOLUTION NO. 2307-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE ' ALABAMA, that HAYMES SNEDEKER is hereby appointed as Municipal Judge. The term of the Municipal Judge shall serve a two-year term (January I, 2015 - January I , 20 I7) and until a successor is elected by the council and qualified. Section 12-14-30, Code of Alabama, 1975. ADOPTED 18TH DAY OF DECEMBER, 2014 ATTEST: The Honorable Jody W. Bishop , Circuit Judge, 28th Judicial Circuit of the State of Alabama, then gave the Oath of Office to Haymes Snedeker as Municipal Judge. (A Signed Oath of Office is inserted at end of these minutes.) Haymes Snedeker addressed the City Council and thanked them for allowing him to serve as the City's Municipal Judge . Judge Snedeker said it has been 10 years and we have heard over 20.000 cases. We have a great support staff of James Gillespie , Court Clerk Betty Starks, and Audrey Anger who are all Court Magistrates. He mentioned having two other magistrates that also help. Councilmember Ford introduced in writing an Ordinance to authorizing and granting to Mediacom Southeast, LLC the right to use the rights-of-way of the City of Fairhope to provide Cable Services to the citizens of the City under the terms of a Cable Television System Franchise Agreement. Carrie Boggs from Mediacom was present to answer and questions. Ms. Boggs gave an update for completion of installation in several subdivisions: Sedgefield will be complete in mid-February, Old Battles will be complete at the end of April ; and Summer Lake will be complete at the end of June. She also stated all services will run in these subdivisions. 6653 18 December 2014 Council President Burrell commented we have had phone calls with complaints on a monthly basis; and some times more than that. Ms. Boggs stated they will be increasing call centers with employees and services , launching a mobile care application, and other options to help with issues. Due to lack of a motion for immediate consideration , this ordinance will layover until the January 12 , 2015 City Council meeting. Councilmember Boone introduced in writing, and moved for the adoption of the following resolution , a resolution to Purchase a Ford F-550 Truck Cab and Chassis for the Electric Department off the Alabama State Department Purchasing Bid list and therefore does not have to be let out for bid with a cost of $39,431.00. Seconded by Councilmember Ford , motion passed unanimously by voice vote. RESOLUTION NO. 2308-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA , as follows : [1] That the City of Fairhope has voted to purchase a Ford F-550 Truck Cab and Chassis for the Electric Department and the type of vehicle needed is on the Alabama State Department of Purchasing bid list and therefore does not have to be let out for bid ; and [2] The following IS the Alabama State Department of Purchasing contract information: Bid Number: Tl93A Contract Number: 4012910 Ford F-550 Truck Total Cost is $39,431.00 Adopted on this 18th day of December, 2014 Attest: 6654 18 December 2014 Councilmember Ford introduced in writing , and moved for the adoption of the following resolution, a resolution to purchase 3/4 inch and 2 inch P.E . 2406/2708 SDRll Gas Tubing for the Gas Department; and authorizes procurement based on the option allowed by the Code of Alabama 1975 , Section 41-16-51(b)(7) to obtain informal quotes and purchase twenty one thousand (21 ,000) feet of each size tubing. The total cost will be $21 ,000.00. Seconded by Councilmember Boone, motion passed unanimously by voice vote. RESOLUTION NO. 2309-14 BE IT RES OLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHO PE, ALABAMA , as follows: [1] That the City of Fairhope has voted to purchase 3/4 inch and 2 inch P.E. 2406/2708 SDRll Gas Tubing for the Gas Department; and authorizes procurement based on the option allowed by the Code of Alabama 1975 , Section 41-16-51(b)(7) to obtain informal quotes and purchase twenty one thousand (21 ,000) feet of each size tubing . The total cost will be $21 ,000.00. Adopted on this 18th day of December, 2014 Attest: Councilmember Boone introduced in writing , and moved for the adoption of the following resolution , a resolution that the City Council hereby approves and authorizes Mayor Timothy M . Kant to execute a Memorandum of Understanding between the Baldwin County Commission, the City of Fairhope, and the Fairhope Volunteer Fire Department regarding the shared use of certain communications infrastructure owned by Baldwin County Commission for the purpose of supporting an interoperable P-25 public safety communications system. Seconded by Councilmember Ford , motion passed unanimously by voice vote . Mayor Kant commented this will be no cost to the City of Fairhope. 6655 18 December 2014 RESOLUTION NO. 2310-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the City Council hereby approves and authorizes Mayor Timothy M. Kant to execute a Memorandum of Understanding between the Baldwin County Commission, the City of Fairhope, and the Fairhope Volunteer Fire Department regarding the shared use of certain communications infrastructure owned by Baldwin County Commission for the purpose of supporting an interoperable P-25 public safety communications system. Adopted on this 18th day ofDecember, 2014 Attest: City Council reviewed an application for a Non-Profit Tax Exempt License by Jaca McLaren, The Friends of the Fairhope Public Library, for Chocolate and Champagne Fantasy 2015 located at 501 Fairhope Avenue, Fairhope, Alabama on January 31, 2015 from 7:00 p.m. to 9:30 p.m. Councilmember Ford moved to approve the issuance of the license. Seconded by Councilmember Boone, motion passed unanimously by voice vote. Councilmember Boone moved to approve the Schedule of the 2015 City Council Meetings. Seconded by Councilmember Ford, motion passed unanimously by voice vote. * * 6656 18 December 2014 Councilmember Boone moved to adjourn the meeting.
