HomeMy WebLinkAbout08-21-2014 City Council Meeting MinutesSTATE OF ALABAMA )( COUNTY OF BALDWIN )( The City Council, City of Fairhope, met in regular session at 6:00p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Thursday, 21 August 2014. 6557 Present were Council President Jack Burrell, Councilmembers: Rich Mueller, Diana Brewer, and Kevin Boone, Mayor Timothy M. Kant, and City Clerk Lisa A. Hanks. Councilmember Michael A. Ford and City Attorney Marion E. Wynne were absent. There being a quorum present, Council President Burrell called the meeting to order. The invocation was given by Reverend Mike McKnight, pastor at Fairhope United Methodist Church, and the Pledge of Allegiance was recited. Councilmember Brewer moved to approve minutes of the 11 August 2014, regular meeting; minutes of the 11 August 2014, work session; and minutes of the 11 August 2014, agenda meeting. Seconded by Councilmember Mueller, motion passed by the following voice votes: AYE -Mueller, Brewer, and Boone. NAY -None. ABSTAIN - Burrell. items: items: Mayor Kant addressed the City Council regarding the following items: 1) Thanked everyone for coming to the Dedication of Fairhoper's Community Park on Saturday. He said everyone came together for the good of the community; and 2) Friday night is the first football game of the season and it will be in Robertsdale. Next week will be our first home game. Councilmember Brewer addressed the City Council regarding the following 1) On October 4th and 5th we will be hosting an Ultimate Frisbee Tournament at Founders Park; and 2) On Saturday, the University of South Alabama Jags will play a team scrimmage at the Fairhope Municipal Football Stadium. Council President Burrell addressed the City Council regarding the following 1) Appointed Councilmember Ford as the new Council Liaison to the Knoll Park Committee to replace Councilmember Mueller; 2) Appointed himself to the Planning Commission and thanked Councilmember Brewer for remaining on the Commission an extra month; and 21 August 2014 3) Soccer Complex -Council fully supports this project, but the numbers came in too high. We need to take time to get this done with reduced costs. He urged the Council to have financial restraints with regards to this project. 6558 Council President Burrell and Mayor Kant recognized Coach Stacy Forbess and the Eastern Shore Twirlers with Certificates of Recognition. The Elite Team won 1st Place in the Junior Beginner Small Dance Twirl Division. The members of the Elite Team are: Sydney Belyeu, Lexie Fowler, Sarah Fuller, Sarah Hall, Zoe Harris, Katherine Ming, Christy Thacker, and Morgan Williamson. The Gold Team won 5th Place in the Pre-Teen Beginner Large Dance Twirl Division. The members of the Gold Team are: McKenzie Beard, Madison Bias, Jordan Carraway, Chloe Coleman, Gracie Cox, Gabrielle Farnell, Ashley Fowler, Paige Jackson, Molly Meilunas, and Sierra Scoggin. Coach Forbess addressed the City Council and thanked them for this recognition. She commented this was a great group of girls who are dedicated and will do what it takes to be great twirlers. She also thanked the parents for their support. Council President Burrell thanked all of them for what they do and for representing the City. Councilmember Brewer introduced in writing, and moved for the adoption of the following resolution, a resolution that the City Council hereby adopts and approves the proposed fees, Mission Statement, and rules for the Quail Creek Golf Course; and Attachment No. 1 to Resolution No. 1412-07 is hereby repealed. The motion was seconded by Councilmember Mueller. Bobby Hall, Director of Golf, addressed the City Council and presented the proposed fees. Mr. Hall commented these fees are in line with other Golf Course fees; and they are competitive with other courses. He briefly explained the rules for the Golf Course; and said these will be handed to members and guests. Councilmember Brewer thanked Mr. Hall for his due diligence. It was mentioned the last increase was seven years ago. Mayor Kant stated a new irrigation system and employee are in the upcoming budget. Council President Burrell thanked Councilmember Mueller for his help with the proposed fees. After further discussion, motion passed unanimously by voice vote. * * 6559 21 August 2014 RESOLUTION NO. 2253-14 WHEREAS, on September 24, 2007, the City of Fairhope adopted Resolution No. 1412-07 with attachments; and WHEREAS, Attachment No. 1 of Resolution No. 1412-07 increased fees for the Municipal Golf Course; and WHEREAS, the City of Fairhope hereby repeals Attachment No. 1 and proposes the following fees for the City of Fairhope's Quail Creek Golf Course (see attached fee schedule); BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA, that Attachment No. 1 to Resolution No. 1412-07 is hereby repealed and adopts the proposed fees which shall take effect October 1, 2014. (The proposed fees are attached at the end of the minutes) ADOPTED THIS 21ST DAY OF AUGUST, 2014 ATTEST: * * 6560 21 August 2014 Councilmember Boone introduced in writing, and moved for the adoption of the following resolution, a resolution authorizing Mayor Timothy M. Kant to accept the FAA Grant to "acquire land; construct apron (east terminal area), Phase I grading and drainage; construct taxiway (east terminal area access taxiway), Phase 1 grading, drainage, and environmental mitigation; improve airport drainage, preliminary study" at the H. L. "Sonny" Callahan Airport. The grant amount is $990,075.00-Project Number 3-01-0029-015-2014. The motion is seconded by Councilmember Brewer. Chuck Zunk, Chairman of the Fairhope Airport Authority, addressed the City Council and explained the FAA grant which is the 3rd grant for this project. He explained the match is 90% from the Federal Government, 5% from the State of Alabama, and 5% from the Airport Authority. He also mentioned land that was purchased in 2007 and one parcel will be sold and one parcel will be reimbursed through FAA grants. Councilmember Mueller stated the Airport Authority is doing a great job. After further discussion, motion passed unanimously by voice vote. RESOLUTION NO. 2254-14 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, APPROVING AND AUTHORIZING THE MAYOR AND THE CITY TO ENTER INTO A GRANT AGREEMENT WITH THE FEDERAL AVIATION ADMINISTRATION FOR THE BENEFIT OF FAIRHOPE AIRPORT AUTHORITY AND THE FAIRHOPE AIRPORT WHEREAS, the United States of America acting through the Federal Aviation Administration has offered to pay a maximum of $990,075.00 to "acquire land; construct apron (east terminal area), Phase 1 grading and drainage; construct taxiway (east terminal area access taxiway), Phase 1 grading, drainage, and environmental mitigation; improve airport drainage, preliminary study" at the H.L. ["Sonny"] Callahan Airport in Fairhope, being project number 3-01-0029-015-2014; and WHEREAS, the purpose of this grant is that the Federal Aviation Administration pay a 90% share of the allowable costs incurred in accomplishing said project; and WHEREAS, this offer of the Federal Aviation Administration is contingent upon acceptance of the grant in accordance with its terms, namely and including, among others, the "Airport Sponsor Assurances" dated March, 2014; and WHEREAS, the grant application was originally processed with the recipient to be the City of Fairhope, Alabama; and WHEREAS, during the pendency of the processing of the grant, the City of Fairhope has fully cooperated in the creation of a new entity to own and control the H.L. ["Sonny"] Callahan Airport in Fairhope by the newly-created Fairhope Airport Authority; and WHEREAS, the transferring of the properties and assets and liabilities concerning the H.L. ["Sonny"] Callahan Airport in Fairhope is still to some extent in progress; and 6561 21 August 2014 WHEREAS, the Federal Aviation administration retains the right to approve any such transfer from the City to the Airport Authority of such assets and liabilities of and pertaining to an airport such as H.L. ["Sonny"] Callahan Airport in Fairhope which has received and retained grant money or assets from the Federal Aviation administration; and WHEREAS, the process of getting approval of the transfer from the Federal Aviation Administration is still ongoing and is not completed; and WHEREAS, the deadline date for the receipt of the grant from the Federal Aviation Administration is almost upon us; and WHEREAS, some intermediate solution to these problems is in the best interests of all concerned; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City, in a regular meeting of the City Council, that the Mayor be and he is hereby authorized to sign and execute any necessary and appropriate documents so that the City can receive the grant during this interim period, acting for and in behalf of the H.L. ["Sonny"] Callahan Airport in Fairhope and Fairhope Airport Authority as Sponsor, so that pending and during the period when the Federal Aviation Administration approves the transfer ofthe airport and the grants and liabilities concerning the airport, this grant is not lost unnecessarily but is, instead, accepted in accordance with applicable law and procedures. Kant to execute a contract with Schneider Historic Preservation, LLC to perform Historic Preservation Consulting Services to update the City's historic sites survey. The proposed cost is $9,366.00; and will be paid from the Historic Preservation Committee's funds being held in the General Fund. Seconded by Councilmember Mueller, motion passed unanimously by voice vote. Council President Burrell mentioned there is approximately $29,000.00 in the General Fund and this historic sites update will help the City and ACE as well as the new ordinance. 6562 21 August 2014 RESOLUTION NO. 2255-14 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor Timothy M. Kant is hereby authorized to execute a contract with Schneider Historic Preservation, LLC to perform Historic Preservation Consulting Services for the City of Fairhope to update the City's historic sites survey. The project involves work in and adjacent to four historic districts that are listed in the National Register of Historic Places: Bayfront Historic District, Fairhope Downtown Historic District, Montrose Historic District, and White A venue Historic District. The proposed fee for conducting this historic site survey update is $9,366.00; and will paid from the Historic Preservation Committee's funds being held in the General Fund.
