COUNTY OF BALDWIN )(
The City Council, City of Fairhope, met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532 , on
Monday, 11 August 2014 .

Present were Council President Pro Tern Michael A. Ford, Councilmembers:
Rich Mueller , Diana Brewer, and Kevin Boone, Mayor Timothy M. Kant, City
Attorney Marion E. Wynne, and City Clerk Lisa A. Hanks. Council President Jack
Burrell was absent.
There being a quorum present, Council President Pro Tern Ford called the
meeting to order. The invocation was given by Gray Strickland, Pastor of The Way
Community Church , and the Pledge of Allegiance was recited. Councilmember
Brewer moved to approve minutes of the 28 July 2014 , regular meeting; minutes of
the 28 July 2014 , work session; and minutes of the 28 July 2014, agenda meeting.
Seconded by Councilmember Mueller, motion passed unanimously by voice vote.
Council President Pro Tern Ford announced that the regularly scheduled
August 25 , 2014 City Council Meeting will be moved to Thursday, August 21, 2014.
Mayor Kant addressed the City Council regarding the following items:
1) Announced on Saturday at 10:00 a.m., August 16 , 2014 will be the grand
opening of the Fairhoper's Community Park; and the Governor will be
there to help cut the ribbon. He also mentioned everyone has been
working together to get this completed; and we invited all of the children
who helped design the park;
2) Stated we are 60 "Likes" away from having 10,000 "Likes" on the City of
Fairhope 's Facebook page. We can thank Sherry Sullivan and Paige
Turberville for this achievement;
3) Mentioned the Fairhope National AAA Allstars are playing in the World
Series are at this point have one win and one loss; and
4) Forest Gunnison, who is only 10 years old, placed 2nd in the home run
derby at the national level.

Councilmember Boone addressed the City Council and stated he would be
abstaining from Agenda Item Number 8 due to a conflict of interest; he works for the
company.

Adam Winegarden, Fairhope's Head Football Coach, addressed the City
Council and thanked them for their great leadership and great vision for Fairhope. He
stated the Mayor and Councilmembers are a direct reflection of why people live here.
Mr. Winegarden said we are striving for more awareness of our games with posters,
painting windows of businesses , and flags.
He said our first game is next Friday at Robertsdale. We are now classified as a 7 A
Team and are seeded number 9 in the State. We have 97 players on our varsity team
and 50 players on our freshman team. Mr. Winegarden said football shaped him into
who he is today; and he is excited about the schedule and the football program.
A Public Hearing was held as advertised on a proposed ordinance to amend
Zoning Ordinance No. 1253. Councilmember Brewer introduced in writing
Ordinance No . 1517 , an ordinance to rezone the property of Entrust Administration of
the Southeast F/P /0 Mitchell Milner from R-1 Low Density Single Family
Residential to Planned Unit Development (PUD). This property is generally located
on the north side of Battles Road (a/k/a County Road No. 44) just east of Point Clear
Court, Fairhope , Alabama. Parcel contains 4.84 acres more or less; 05-46-09-30-0-
000-060.000 , 0 5-46-09-3 0-0-000-060 .001, 05-46-09-3 0-0-000-060.002 , 05-46-09-3 0-
0-000-060.003, and 05-46-09-30-0-000-060.004; Point Place Subdivision. The
Planning Commission gave a favorable recommendation of this ordinance.
Planning Director Jonathan Smith briefly explained the proposed ordinance. He
mentioned Low Impact Developments ("LID") impacts will be used in the plan.
Councilmember Mueller questioned pervious pavement. Mr. Smith explained that
this type of pavement should withstand our trucks and the normal traffic; and the City
would have to eventually maintain the streets.
Council President Pro Tern Ford opened the Public Hearing at 6:16 p.m. No one
present opposed the proposed ordinance , the Public Hearing closed at 6:16 p.m.
In order to take immediate action , Councilmember Mueller moved for immediate
consideration . Seconded by Councilmember Boone, motion for immediate
consideration passed unanimously by the following voice votes: AYE -Mueller,
Brewer, Ford , and Boone. NAY -None. Councilmember Brewer then moved for
final adoption of Ordinance No. 1517. Seconded by Councilmember Mueller, motion
for final adoption passed by the following voice votes: AYE -Mueller, Brewer,
Ford, and Boone. NAY -None.
Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution , a resolution that the City Council hereby adopts and
approves the Mission Statement for the Knoll Park Committee for the City of
Fairhope and the Rules to govern its operation. Seconded by Councilmember Boone,
motion passed unanimously by voice vote.

RESOLUTION NO. 2251-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, hereby adopts and approves the Mission Statement for the Knoll Park
Committee for the City of Fairhope and the following rules are set forth to govern its
operation:

MlSSION STATEMENT -The objective of the Knoll Park Longleaf Pine
Sandhill Restoration Project is to reestablish a functioning longleaf pine
sandhill ecosystem consisting of a longleaf pine forest with a species-rich
understory of native grasses and forbs; and a wide diversity of wildflowers.
MEMBERSHIP -The Knoll Park Committee shall consist of Ten (10)
members appointed by the City Council, One (I) City Council liaison, and
One (I) City Employee liaison.
VACANCIES -Any vacancy in the membership shall be filled by
appointment by the City Council at the recommendation of the City Council
liaison .
RULES OF PROCEDURES-The Committee shall:
A . Elect a Chairperson, an Acting Chairperson (to serve in the absence of
the Chairperson), and a Secretary . Each will serve for one year or until
re-elected or a successor is elected.
B . All meetings shall be opened to the public. Meetings will be held on the
Second Wednesday of each month at 5:30p.m. or as called.
C. Six (6) Committee members present shall constitute a quorum of regular
and special meetings.

Councilmember Brewer moved to amend Agenda Item Number 8 by adding
the verbiage "and authorize to rebid" at the end of Paragraph [3}. Seconded by
Councilmember Mueller , motion passed by the following voice votes: AYE -
Mueller , Brewer, and Ford . NAY-None. ABSTAIN-Boone.

Councilmember Brewer introduced in writing, and moved for the adoption of
the following resolution as amended, a resolution to reject all Bids for the Fairhope
Soccer Fields (Bid No. 003-14) for the Recreation Department; and authorize to
rebid. Seconded by Councilmember Mueller, motion passed by the following voice
votes: AYE -Mueller, Brewer, and Ford. NAY-None. ABSTAIN-Boone.
RESOLUTION NO. 2252-14
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
[1] That the City of Fairhope, by and through Preble-Rish, LLC, Project Engineer, did
request, receive, and open bids for the Fairhope Soccer Fields (Bid No. 003-14) for
the Recreation Department.
[2] At the appointed time and place , only one bid response was received from
Summit Industries , LLC.
[3] After evaluating the bid proposal with the required bid specifications, the sole bid
received far exceeded the amount budgeted for project; and given the current
circumstances , it is recommended and in the best interest of the City of Fairhope to
reject all bids. Therefore, we request that all bids be rejected for the Fairhope Soccer
Fields (Bid No. 003-14); and authorize to rebid.

unanimously by voice vote.

Councilmember Brewer moved to grant the request of Kate Fisher, Director of
the Eastern Shore Art Center, requesting permission to use the street on Bancroft
between Fairhope and Morphy Avenues beginning at 5:00p.m. on Friday, October 3,
2014 for set-up of the Grand Festival of Arts; and on Sunday, October 5, 2014 for
break-down; the street will reopen at 7:00 p.m. The festival will take place on
October 4, 2014 and October 5, 2014 on the Faulkner Campus. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote.
Councilmember Brewer moved to grant the request of Erin Langley, Eastern
Shore Repertory Theatre , Inc., requesting permission to use Henry George Bluff from
April 27, 2015 through May 3, 2015 for the tentative performance of "Hairspray"
with performances being held April 30, 2015 through May 3, 2015 at 7:30p.m. The
request is for use of City stage including set-up and barricades. Seconded by
Councilmember Boone, motion passed unanimously by voice vote.
Councilmember Brewer moved to grant the request of Karin Wilson, Good
Life Foundation on behalf of Fairhope Local, requesting permission to hold its 1st
Annual5KJ1-Mile fun run on Saturday, October 25,2014. It will be called "Fairhope
Local Annual Run Forrest Run 5K and Fun Run." The requested road closures from
11:00 a.m. to 12:30 p.m.: Church, James, Bayview, Nichols, Satsuma, Fig, Dyson,
Pecan, Pomelo , Pier, and various crossroads with approximately 20 barricades.
Seconded by Councilmember Mueller, motion passed unanimously by voice vote.
Councilmember Brewer moved to adjourn the meeting. Seconded by
Councilmember Mueller, motion passed unanimously by voice vote.
There being no further business to come before the City Council, the meeting
was duly adjourned at 6:29 p.m.
